Any person who fails to comply with an order stemming from a
dangerous dog proceeding held pursuant to § 123 of the Agriculture
and Markets Law shall be subject to the following penalties:
A. First offense:
a fine not less than $50 and not greater than $500 or incarceration
for a period of not more than 15 days, or both.
B. If the defendant
has a prior conviction of this section within five years of the issuance
of a new violation under this section, the defendant shall be subject
to a fine not less than $300 and not greater than $1,500 or incarceration
for a period not greater than 15 days, or both.
C. If the defendant
has more than one conviction under this section within five years
of the issuance of a new violation under this section, the defendant
shall be subject to a fine not less than $500 and not greater than
$2,500 or incarceration for a period not greater than 15 days, or
both.
