The Board of Public Works of the City of California, Missouri,
is hereby dissolved.

A. There
is hereby established a Department of Utilities for the City of California,
Missouri. It shall be the function of the Department of Utilities
to oversee the operation of any waterworks, gas works, electric light
and power plant, steam heating plant, or any other device or plant
for furnishing light, power or heat, telephone plant or exchange or
street railway or any other public transportation conduit system or
any other public utility whatsoever now owned by the City of California,
Missouri, or which may be hereafter established or acquired by said
City by purchase or otherwise and all appurtenances thereto belonging,
and specifically, this Department shall perform and oversee all functions
formally performed by the Board of Public Works of the City of California,
Missouri.
B. The
Department of Utilities shall keep and maintain books of accounts
showing accurately contemporaneous current entries of the receipts
and expenditures occurring within, or by, said Department, and such
records shall be kept in such a manner to enable the same to be understood
and investigated and shall also preserve on file in its office duplicate
vouchers for all its expenditures; all of which shall at all times
be open to inspection by the Mayor of the City of California and by
the Board of Aldermen of the City, or other duly designated committees
thereof, and said Department shall make detailed reports of its business
and transactions to the Mayor and Board of Aldermen of the City, at
least annually and at such further times as requested by the Board
of Aldermen.
C. The
Department of Utilities shall have charge of the purchase of all supplies
needed by the City and its several utilities. The assessment and collection
of rates for water, electric power, electric lights, gas or other
product or service of any utility now or hereafter owned and operated
by the City shall be under the supervision of the Department of Utilities
subject to the control of the Board of Aldermen of the City of California,
Missouri.

There shall be a position of Superintendent of the Department
of Utilities, and said position shall be appointed by the Mayor of
the City of California, with the consent and approval of the Board
of Aldermen. The Superintendent of the Department of Utilities shall
have all duties as the Superintendent of the (former) Board of Public
Works.

All property held in the name of, maintained, managed or controlled
by the (former) Board of Public Works of the City shall be and is
hereby transferred to the ownership, care and control of the City
of California. Said property shall be managed by the Department of
Utilities of the City. All debts, liabilities, obligations, rights
under contract, etc., of the (former) Board of Public Works shall
be and are hereby deemed to be valid obligations of the City of California.
All assets held in the name of the (former) Board of Public Works
shall be and are hereby deemed to be the property of the City of California.
The Mayor of the City of California, Missouri, is authorized to execute
any and all documents necessary to effect the transfer of title to
property or to transfer ownership of assets.
