All owners of Village real property which abuts upon or is contiguous to a public sidewalk shall be responsible for the maintenance of said sidewalk and shall be required to keep such sidewalk reasonably clear of snow and ice and shall not permit the same to accumulate.

A. 
The Village Board deems it to be a matter of public safety and that from October 1 of each year until April 15 of the following year the following time limits for removal of snow and ice shall be in effect, and the property owner shall be responsible for the removal of ice and snow within the time limits prescribed below without any further notice by the Village:
(1) 
Snow and ice shall be removed within 24 hours after the end of a snowfall on noncommercial establishments.
(2) 
Sidewalks in front of commercial establishments and commercial parking lots shall be kept free of snow and ice at all times between the hours of 9:00 a.m. and 5:00 p.m.
B. 
The failure to remove ice and snow in the time period set forth above shall be deemed to be a public emergency, thus allowing the Village to have such ice and snow removed, pursuant to § 140-29I(3)(a) above, without any further notice to the property owner.
In case snow and ice on any sidewalk shall be frozen so hard that it cannot be removed without injury to the sidewalk, it shall, within the time specified in § 140-32, be strewn and kept strewn with ashes, sand, sawdust or other suitable material, so as to be no longer dangerous to life and limb. As soon as practical thereafter, the sidewalk shall be completely cleared of snow, ice and other materials strewn thereon, as provided in this article.

A. 
Whenever the owner or occupant of any parcel of real estate adjoining a public sidewalk and/or public pathways fails to remove the snow and ice from such sidewalk and/or public pathways adjoining such property within the time specified in this article, or within four hours after notice from the Office of Code Enforcement to remove the same, it shall be the duty of the Supervisor of Public Works to remove said snow and/or treat the ice from such sidewalk and/or public pathways and notify the Village Clerk of the expense incurred by the amount of labor, equipment and materials used.
B. 
If the Code Enforcement Officer determines that the ice and/or snow on a particular sidewalk and/or public pathways are of a condition to impose an immediate threat to health and public safety, he shall notify the Supervisor of Public Works who shall then remedy the situation without waiting for the four hours to expire.

A. 
The Village Clerk shall promptly present to the owner or occupant of each parcel a bill for the removal of snow and ice as certified by the Supervisor of Public Works.
B. 
All such bills so rendered by the Village to the property owner or person shall be paid to the Village within 30 days.
C. 
Penalties for the late payment of any such bill are established as follows and shall be added to such bills:
(1) 
First 30 days: no penalty.
(2) 
First month thereafter: 10%.
(3) 
Second and any successive month thereafter: 2% each month.
D. 
A final or aggregate bill for work performed under this section shall be rendered to the property owner or person before February 1 of each year covering the amount of such work or services performed for the entire year preceding February 1.
E. 
Any such bill which remains unpaid after February 15 shall become a lien upon and be assessed against the real property upon which the work was performed and shall be added to the next annual tax levy as prescribed by Article 2 of the Village Law.
F. 
The filing of a lien shall not prevent the imposition of penalties under § 140-35C above.
Without restricting the rights of the Village pursuant to § 140-35 above, the Board of Trustees shall also have a right to maintain a civil action to recover the cost of the ice and snow removal pursuant to § 140-34 above.
The owners or occupants of buildings adjacent to public sidewalks shall prevent the falling snow, ice or water from such buildings upon the public sidewalks.
No person, firm or corporation shall deposit, throw, place or strew, nor shall any person, firm or corporation cause to be deposited, thrown, placed or strewn, any snow or ice upon any street, avenue or roadway within the Village of Newark Valley.
A. 
No person, firm or corporation shall pile, gather up, plow up or in any way force any snow or ice upon any street, avenue or roadway within the Village of Newark Valley or from one street, avenue or roadway onto any other street, avenue or roadway within the Village of Newark Valley.
B. 
No person, firm or corporation shall pile, gather up, plow up or in any way force any snow or ice upon any terrace or parcel of land within in six feet of any street, avenue or roadway in such a manner as to cause the height of the snow and ice so piled, gathered, plowed or forced to exceed three feet six inches in height above the existing natural grade of said terrace or parcel of land within six feet of said street, except that it shall be unlawful to cover a fire hydrant with snow or ice.
C. 
No person, firm, corporation, property owner or occupant shall remove snow or ice from any parcel of real estate and place it upon another parcel of real estate without the express permission of the owner of the parcel of real estate upon which the snow or ice is to be placed.
D. 
Any person, firm, corporation piling, gathering or plowing up snow or ice on any public street, avenue or roadway or to an excess height as indicated in Subsection B of this section shall forthwith remove the same at his, hers or its expense, upon the request of the Supervisor of Public Works of the Village of Newark Valley.
E. 
Whenever any person, firm or corporation neglects or refuses to remove any snow or ice piled, gathered or plowed up by him or it in violation of this article within four hours after a request to do so by either the Code Enforcement Officer or the Supervisor of Public Works of the Village of Newark Valley, the Supervisor of Public Works may remove said snow or ice from such street or terrace and to notify the Village Clerk of the expense incurred by the amount of labor, equipment and materials used.
F. 
The Village Clerk shall promptly present to the violator of this article a bill for the removal of snow and ice, as provided for in Subsection E of this section as certified by the Supervisor of Public Works. If not paid within 30 days, in the case of a property owner, the cost thereof shall be collectable by the Village under either § 140-35 or 140-36 above.
A. 
Any person violating any of the provisions of this article shall be guilty of a violation and, upon conviction thereof, shall be punishable by a fine not exceeding $250 for each offense or imprisonment not exceeding 15 days, or both such fine and imprisonment.
B. 
Each day such violation continues after notice of such violation shall constitute a separate offense punishable by a like fine and imprisonment.
