The Board of Aldermen, with the approval
of the Mayor, may employ a City Administrator for an indefinite term.
Said person shall be at least twenty-one (21) years of age and shall
be chosen solely on the basis of his/her administrative and executive
abilities. The person must be qualified under the laws of the State
of Missouri for the position of City Administrator under Chapter 77,
RSMo. The choice of the City Administrator shall not be limited by
residency qualification; however, he/she shall reside within the City
limits of Fayette, Missouri, within ninety (90) days of employment,
unless the residency requirement is waived at the discretion of the
Board of Aldermen. The City Administrator shall devote full time to
the performance of the duties of the office, with a minimum of forty
(40) hours per week and on call as needed.

The City Administrator, before entering
upon the duties of his/her office, shall file with the City a surety
bond to be approved by the Board of Aldermen and conditioned upon
the faithful and honest performance of his/her duties and rendering
full and proper accounts to the City for funds and property that shall
come into his/her possession or control. The cost of said bond shall
be paid by the City of Fayette.

The City Administrator shall receive
such compensation as may be determined from time to time by the Board
of Aldermen and such compensation shall be payable biweekly.

The City Administrator shall serve
at the pleasure of the Board of Aldermen on an at will employment
basis. The Board of Aldermen may remove the City Administrator from
office by a majority vote with approval of the Mayor. The City Administrator
shall be entitled to ninety (90) days' notice of removal or, if the
Board of Aldermen chooses to make the removal immediate, the City
Administrator shall be entitled to severance equal to three (3) months'
salary. The City Administrator may request a public hearing within
thirty (30) days of notice of removal and the Board of Aldermen shall
immediately arrange for such a hearing. After the public hearing,
the Board of Aldermen may reconsider its removal of the City Administrator
but if the Board of Aldermen fails to reconsider the City Administrator's
removal, it shall become final. Provided, however, that if the City
Administrator is removed for acts of dishonesty or moral turpitude,
he/she may be removed effective immediately, without notice, and without
rights to any severance pay.

A. The City Administrator shall be the Chief
Administrative Assistant to the Mayor and as such shall be the Chief
Administrative Officer of the City Government. The City Administrator
shall perform such duties as may be required by the Board of Aldermen,
not inconsistent with the State Statutes, laws or ordinances and including,
but not limited to, the following:
1.
The City Administrator shall be the
Chief Administrative Assistant to the Mayor and shall coordinate and
advise on the activities of the Administrative, Police, Fire and Public
Works Departments.
2.
The City Administrator shall be the
purchasing agent for the City and all purchases amounting to less
than five thousand dollars ($5,000.00) shall be made under his/her
direction and according to the purchasing rules approved by the Board
of Aldermen.
3.
The City Administrator shall act
as the personnel officer for the City of Fayette and shall recommend
an appropriate position classification system and pay plan to the
Mayor and Board. The City Administrator, after consultation with department
heads, shall approve advancements and appropriate pay increases within
the approval pay plans and position classification system. The City
Administrator shall have the power to recommend employment, removal
or disciplinary actions. The Board of Aldermen shall make all final
employment decisions.

The City Administrator shall recommend
standard personnel policies, classifications and pay schedules.
5.
The City Administrator shall assure
the preparation of annual budgets and budget messages, including the
annual report.
6.
The City Administrator shall advise
the Mayor and Board of Aldermen of financial conditions, including
biweekly reports to the Mayor and Board of Aldermen relative to the
financial condition of the City in relation to the budget.
7.
The City Administrator shall prescribe
administrative rules and regulations.
8.
The City Administrator shall investigate
the affairs of the City or any department.
9.
The City Administrator shall attend
all meetings of the Board of Aldermen and work closely with all City
boards, committees and commissions.
10.
The City Administrator shall supervise
the preparation of all bid specifications for services and equipment
and receive sealed bids for presentation to the Board of Aldermen.
11.
The City Administrator shall coordinate
and advise on the activities of the Administrative, Police, Fire and
Public Works Departments and make recommendations to the City Engineer.
12.
The City Administrator shall coordinate
Federal and State programs which may have application to the City
of Fayette.
13.
The City Administrator shall be responsible
for keeping the public informed of the purposes, progress, projects
and methods of City Government to all available news media.
14.
The City Administrator shall submit
to the Mayor and Board of Aldermen a proposed agenda for each Board
of Aldermen meeting at least twenty-four (24) hours before the time
of scheduled meeting and take steps to assist the Board in compliance
with all requirements of the Sunshine Law.
15.
The City Administrator shall keep
full and accurate records of all actions taken by him/her in the course
of his/her duties and he/she shall safely and properly keep all records
and papers belonging to the City. All such records shall remain the
property of the City and be open for inspection by the Mayor and Board
of Aldermen. At the time of discharge from employment all personal
computers and laptops, including hardware and software, cell phones,
beepers or other items provided by the City, shall be returned in
usable condition to the City prior to the issuance of the last paycheck.
16.
The City Administrator shall be responsible
for all real and personal property of the City of Fayette. He/she
shall have responsibility for all real estate files and vehicle records
of such property and for the supervision of maintenance of such property.
Personal property may be sold by the City Administrator only with
the approval of the Board of Aldermen by resolution or ordinance.

At such times as the office of the
City Administrator shall become unfilled and vacant, the duties and
powers of the City Administrator shall be vested in the office of
the Mayor and Board of Aldermen. During any such vacancy all ordinances
directing or authorizing any such activity or directive to be carried
out by the City Administrator shall be read as if the Mayor and Board
of Aldermen were inserted for the words "City Administrator."

A. The City Administrator or City Clerk shall be responsible for disbursing
money to pay the obligations of the City when:
1.
The purchase or expense was budgeted or otherwise authorized
by the Board of Aldermen; and
2.
The amount of the invoice is less than five thousand dollars
($5,000.00).
B. The City Administrator or City Clerk shall provide to the Board of
Aldermen at each Board meeting a report showing all payments made
since the last meeting.
