The annual fee for the collection and disposal of trash, garbage and rubbish for residential properties is set at $58 for 1989, as provided in the budget for said year. The annual fee shall apply to each family unit in dwellings containing multiple families.
Upon the failure of any person or corporation to pay the trash and garbage collection fee, the Borough of Darby shall, at its option, institute proceedings for the collection of the same before the District Justice. Anyone in default shall, upon institution of the proceedings, be assessed all fines and costs involved in the prosecution of the action.
Upon the failure of any person or corporation to pay the aforesaid trash and garbage collection fee, the Borough of Darby, at its option, shall have the authority to file a lien for said delinquency against the property of said person and/or corporation. The filing of said lien shall not preclude the filing of an action before the District Justice. The Borough of Darby may elect to institute both proceedings in order to collect any unpaid trash and garbage collection fee.
The Tax Collector of the Borough of Darby is hereby designated as the collector of the trash and garbage collection fee. Said Tax Collector is authorized to collect said fee by placing the amount due on all real estate bills issued by said Tax Collector. The annual fee of the Tax Collector for performing the work prescribed by this article shall be determined by Borough Council by motion or resolution duly adopted.
