It is hereby determined and declared as a matter of Councilmanic
finding that:
A. Free
circulation of traffic of all kinds through the streets of this Borough
is necessary to the health, safety and general welfare of its citizens.
B. The
greatly increased use by the public of motor vehicles of all kinds
has caused serious traffic congestion on the streets of this Borough.
C. The
parking of motor vehicles on the streets has contributed to this congestion
to such an extent as to interfere seriously with the primary use of
such streets for the movement of traffic.
D. Such
parking prevents the free circulation of traffic in, through and from
the Borough, impedes rapid and effective fighting of fires and the
disposition of police forces in the Borough and endangers the health,
safety and welfare of the citizens.
E. Such
parking threatens irreparable loss in valuations of property in the
Borough.
F. This
parking crisis, which threatens the welfare of the Borough, can be
reduced by providing sufficient off-street parking facilities properly
located in the Borough, the situs of which are to be recommended by
the Council of the Borough.
G. The
establishment of a Parking Authority will promote the public safety,
convenience and welfare.
It is the expressed desire of the Council of the Borough of
Darby that a Parking Authority be organized under and pursuant to
the Act of Assembly of June 5, 1947, P.L. 458, its amendments and supplements, entitled the "Parking
Authority Law."
The proposed Articles of Incorporation of the said Parking Authority
shall be as follows:
A. The
name of the Authority shall be the "Parking Authority of the Borough
of Darby."
B. The
said Authority is formed under the provisions of the Act of Assembly
of June 5, 1947, P.L. 458, its amendments and supplements.
The Solicitor is hereby directed to prepare the necessary Articles
of Incorporation, and the President and Secretary of Council are directed
to execute the same under the Borough seal.
The Secretary is directed to publish briefly the substance of
this chapter and the proposed Articles of Incorporation, with reference
to the above-cited Act of Assembly.
Upon completion of the aforesaid Articles of Incorporation,
the Secretary shall publish a notice containing a brief statement
of the substance of this chapter and the Articles, making reference
to the above-cited Act of Assembly, and shall state that on a day
certain, not less than three days after publication, the Articles
of Incorporation will be filed with the Secretary of the Commonwealth
of Pennsylvania. Said notice shall be published once in the Delaware
County Legal Journal and the Ledger of Delaware County.
Upon the said day certain, the Solicitor shall file the Articles
of Incorporation with the Secretary of the Commonwealth of Pennsylvania,
together with the proof of publication of said notice.
