Police officers of the Fulton Police Department are responsible for enforcement of the City Code provisions found in Chapter
608, Vehicles and Traffic, and Chapter
335, Article
I, Fire Lanes, and for those violations found in the New York State Vehicle and Traffic Law relating to parking of vehicles. Further, under the authority of the Municipal Home Rule Law, any parking enforcement attendant designated as such by resolution of the Common Council shall be a public servant and is authorized to serve an appearance ticket for violations of those laws and ordinances stated herein.

A. Certain fines designated.
(1) Any person, firm or corporation who shall violate or permit or allow
anyone to violate the provisions of the following infractions shall,
upon conviction, be therefore fined as follows:
(a)
The following violations shall be subject to a fine of $30 per
violation:
[2] Blocked crosswalk/intersection.
[6] Expired vehicle registration.
[7] Expired vehicle inspection.
[10] No valid parking permit (i.e., permit parking only).
[11] Restricted parking (i.e., on-street parking time limit).
[12] Snow Ordinance (time limit).
(b)
The following violations shall be subject to a fine of $80 for
the first violation within 24 months: stopping, standing or parking
a vehicle in any area designated as a place for handicapped parking,
unless the vehicle bears a permit issued under § 1203-a
or a registration issued under § 404-a of the New York State
Vehicle and Traffic Law and such vehicle is being used for the transportation
of a severely disabled or handicapped person by a person not authorized
to park in a handicapped parking zone. For a second or subsequent
offense within 24 months, the fine will be $100.
(c)
Violation of the parking ban in §
608-32G shall be subject to a fine of $50.
(d)
For any violation of the City Code or New York State Vehicle
and Traffic Law relating to parking, for which a penalty is not otherwise
specified in this chapter, the fine shall be $30.
(2) Except as provided in Subsection
A(3) herein, if the fine is not paid within 30 days of the date of issue, the fine will double to a maximum of $60, and a warrant for the arrest of the violator may be issued. Further, should a violator fail to respond to three or more tickets, he or she will be scofflawed, and the matter will be referred to the New York State Department of Motor Vehicles for its action.
(3) If the fine for a violation involving handicapped parking is not
paid within 30 days of the date of issue, the fine will double to
a maximum of $160, and a warrant for the arrest of the violator may
be issued.
B. Except as herein otherwise provided, any person violating any provision
of the chapter of willfully disobeying any order or direction of the
police as to traffic is guilty of a public offense and punishable
by a fine not exceeding $50. A person violating any provision of this
chapter for which a fine or penalty is not provided, or for willfully
disobeying any order or direction of the police, is guilty of an offense,
punishable by a fine not exceeding $50.
C. The City Attorney or his/her designee shall prosecute all violations
of this chapter before the City Court. The violator has the right
to a hearing before the City Court but shall have no right to a jury
trial.
All prior ordinances, regulations and rules, or parts thereof,
of this City regulating traffic and parking are hereby repealed, except
that this repeal shall not affect or prevent the prosecution or punishment
of any person for any act done or committed in violation of any ordinance,
regulation or rule hereby repealed prior to the taking effect of this
chapter.
