The Council shall appoint a Clerk, pursuant to the Charter, for a term of four years beginning on the first day of January 1970 and every four years thereafter, provided that any appointment to fill a vacancy shall be for the unexpired term only. Prior to this appointment, he shall have been qualified by training and experience to perform the duties of this office.
The Clerk shall:
A. 
Serve as Clerk of the Council, keep its minutes and records of its proceedings, maintain and compile its ordinances and resolutions as required by the Charter.
B. 
Provide secretarial and clerical services for the Councilmen in the discharge of their official duties.
C. 
Have custody of the Township's seal and affix it to such books, papers and documents as may be authorized pursuant to law.
D. 
Have and take custody of all official books, papers and documents of the Township for which no other depository is provided by Charter or ordinance and preserve and keep them safely.
E. 
Administer dog licenses pursuant to law.[1]

F. 
Perform such functions as are vested in the Clerk by the licensing provisions of state law or ordinance.

G. 
Have such other, different and additional powers, functions and duties as may be prescribed by law or ordinance.
H. 
Publish ordinances as required by law and file in his office the requisite proofs of such publications.
I. 
Issue and deliver, with the assistance of the Department of Public Safety, if needed, all notices of meetings required to be given to the Council, and promptly inform Council members of action taken by the Mayor with respect to any ordinance.
J. 
Receive and transmit all communications to or on behalf of the Council.
K. 
Charge and receive for the use of the municipality such fees for transcripts or certifications as shall be authorized by the Council.
L. 
Perform all of the functions required of municipal clerks by the General Election Law and any other law or ordinance and receive for municipal use the fees prescribed therefor.
M. 
Perform such functions as are vested in municipal clerks by state law or ordinances relating to bingo and raffle licenses.
N. 
Prepare and issue certificates as to the approval of a subdivision of land, pursuant to law.[2] Prior to the issuance of any such certificate, the Clerk shall ascertain from the records of the Planning Board, Municipal Engineer and otherwise, as well as from the records in the office of the Clerk, the status of the subdivision in question.

The Clerk shall be the depository and custodian of all official surety bonds furnished by or on account of any Township office, officer or employee, except his own bond, which shall be placed in the custody of the Township Chief Financial Officer; all insurance policies upon or with respect to risks insured for the benefit of the Township or to protect it against any claims, demands or liability whatsoever; and all formal contracts for work, labor, services, supplies, equipment and materials to which the Township may be a party. The Clerk shall also have custody of all leases of property owned by the Township. The Clerk shall be the depository for and have custody of all performance bonds running to the Township as obligee and other forms of noncash security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the Township.
Questions concerning priority of Council business to be performed by the Municipal Clerk, as provided in the Charter or this code, shall be determined by the Council President.

Whenever it is deemed necessary or expedient, the Township Council may appoint a Deputy Municipal Clerk to serve during the absence or disability of the Municipal Clerk. During the period of said appointment, the Deputy Municipal Clerk shall have all the powers of the Municipal Clerk and shall perform the functions and duties of such office when authorized in writing by the President of the Council and two other Councilmen and only for the time period or time therein prescribed.
