In the event a volunteer fireman of the Township of Washington
has died or shall have died as a result of injuries sustained in the
course of the performance of duty as a member of the Volunteer Fire
Department of the Township of Washington, then his widow shall be
eligible for an annual pension not to exceed the sum of $2,500 per
year, which shall be payable upon the following terms and conditions
as follows: $1,300 payable to the widow so long as she shall remain
unmarried and the widow of the deceased fireman, and an additional
sum to the widow of $400 for each minor child of the deceased fireman,
not to exceed the sum of $1,200.
In the event the deceased fireman shall leave no widow surviving
him but shall leave a minor child or children under the age of 18
years, then, in such event, the sum not to exceed $2,500 annually
shall be paid to such minor child or children equally, share and share
alike. Nothing in this section shall authorize an increase in any
pension heretofore authorized by any ordinance or resolution.
The amount of money pursuant to §§
33-1 and
33-2 shall be appropriated by the Township Council and paid annually to the designated widow or minor children.
The funds appropriated under §§
33-1 and
33-2 of this article shall be provided for by the Township in its budget and shall be paid to the designated beneficiaries in the same manner as to other Township employees.
The initial payment of such pension shall be made as soon as
funds are made available therefor and on the first of the month following
the death of such fireman if said funds are available.
The date of the first payment of the pension and the total amount
of said pension shall be determined by resolution of the Township
Council of the Township of Washington.

To be eligible for benefits under this article, the individual
must have complied with the following:
A. Have entered the Township of Washington Fire Department subsequent
to his 35th birthday.
B. Have qualified for death benefits under the constitution and bylaws of the New Jersey State Firemen's Association, except for the qualification contained in Subsection
A.
C. Be not entitled to death benefits under the constitution and bylaws
of the New Jersey State Firemen's Association.
Persons entitled to payment of death benefits under the constitution and bylaws of the New Jersey State Firemen's Association, upon the death of an individual who was qualified under the terms of §
33-7 of this article, shall be paid a sum equal to the death benefits paid by the New Jersey State Firemen's Association for firemen who joined the Volunteer Fire Department prior to the age of 35 years.
Upon the death of an individual who might qualify under the
provisions of this article, the Fire Chief shall certify that person's
qualifying or not qualifying to the Township Council of the Township
of Washington, which shall pay the benefits set forth in the constitution
and bylaws of the New Jersey State Firemen's Association to the persons
named therein.
