No. 3-2016]
No person shall urinate or defecate in any public place. For
purposes of this section, the term "public place" shall mean any highway,
street, sidewalk, park, playground, parking lot, shopping center,
mall or any other place to which the public or a substantial group
of persons has access, but excluding restrooms.
Any person who shall violate any provision of § 244-9 of this article shall pay the sum of $250 for a first offense; the sum of up to $500 for a second offense within 12 months; and a fine of up to $1,000 for each offense thereafter within 12 months, and/or shall be subject to imprisonment for up to 30 days. Each daily offense shall be considered a separate offense.
