Reference is made to Chapter IX of the Sanitary Code of the State of New Jersey, N.J.A.C. 8:26, et seq. (entitled "Public Recreational Bathing," hereinafter referred to as "Chapter IX of the Code"). The definitions contained in Chapter IX of the Code are adopted for the purposes of this chapter.
A. 
License required. No person shall operate a public or recreational bathing place until a license therefore shall have been issued by the Board of Health.
B. 
Fees and charges.
(1) 
For the issuance or annual renewal of a license to operate a public recreational bathing facility within the meaning of Chapter IX of the Code, the fee shall be $400 each.
(2) 
For any inspection or reinspection of a public or recreational bathing place subsequent or in addition to any inspection required for the issuance of an annual license or the renewal of an annual license required by this chapter, the fee shall be $75 each.
(3) 
Crestwood Lake shall be exempt from the requirement to pay the foregoing fees and charges.
C. 
Terms of license; application for renewal. Licenses issued for the operation of a public or recreational bathing place shall expire annually on December 31 of each year, and application for renewal thereof shall be submitted together with the required fee prior to January 1 of each year.
D. 
Denial or suspension of license. Licenses required by this Chapter may be denied or suspended by the Board of Health for failure to comply with this chapter or Chapter IX of the Code.
A. 
Any person or persons, firm or corporation violating any of the provisions of this chapter or Chapter IX of the Code shall, upon conviction thereof, pay a penalty of not less than $50 but not more than $500 for each violation.
B. 
Each day a particular violation continues shall constitute a separate offense.
All ordinances, codes or parts of same inconsistent with any of the provisions of this chapter and Chapter IX of the Code are hereby repealed to the extent of such inconsistency.
