As used in this article, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Allendale.
DEMONSTRATION
The gathering of 10 or more persons for the purpose of demonstrating, picketing, speechmaking, marching and holding vigils where such gathering shall be upon any street, sidewalk, park or other public place.
It shall be unlawful for any person or persons to organize or conduct a demonstration within the Borough without having first obtained a permit for such purpose.
Application for a permit to conduct a demonstration shall be filed with the Borough Clerk, during regular office hours, on forms approved by resolution of the Borough Council, not less than 72 hours in advance of a proposed demonstration. Such application shall be accompanied by the proper permit fee in an amount set by resolution of the Borough Council.
The Borough Clerk shall refer each application to the Chief of Police for his review and recommendations. When such application is properly made and approved, the Clerk shall issue a permit in a form approved by resolution of the Borough Council. Every permit so issued shall be valid only to the person therein named.
Immediately upon the issuance of a permit hereunder, the Borough Clerk shall send a copy thereof to the Mayor and Chief of Police.
Any person violating any of the provisions of this chapter shall, upon conviction, be punishable as provided in § 1-18 of Chapter 1, General Provisions.
