A. 
No person owning, harboring, keeping, walking or protecting any dog, whether licensed or unlicensed, shall permit said dog to run at large or unleashed off the premises owned, leased, rented or occupied by such person within the territorial limits of the Borough.
B. 
No person owning, harboring, keeping, walking or protecting any dog shall permit such dog to be taken upon any municipally owned park, playground or athletic field.
C. 
Any dog found running at large in violation of this chapter shall be subject to seizure, and if not redeemed within a period of seven days as provided by N.J.S.A. 4:19-15.16, the Chief of Police or the Animal Control Officer may, in his discretion, place each such unclaimed dog in a legitimate home or have it destroyed.[1]

No owner, keeper or walker of any dog shall permit his or her dog to discharge its feces upon any public or private property within the Borough, other than property on which the owner or keeper of such dog lives, if such owner, keeper or walker does not immediately thereafter remove and dispose of in a sanitary manner such feces from the public or private property.[1]

A. 
Terms defined. As used in this section, the following terms shall have the meanings indicated:
DOG OF LICENSING AGE
Any dog which has attained the age of seven months or which possesses a set of permanent teeth.
B. 
All provisions of N.J.S.A. 4:19-15.1 through 4:19-15.29, as amended, are hereby adopted in their entirety and are recognized as the controlling regulations and procedures governing the registration, licensing and control of dogs in the Borough, and all Borough officials and employees shall comply with the requirements of the foregoing statutory provisions.
C. 
The Borough Clerk of the Borough of Demarest or such other official as may from time to time be designated by resolution of the Board of Health of the Borough shall register and issue licenses for dogs pursuant to N.J.S.A. 4:19-15.1 et seq. and this chapter.
D. 
The Chief of Police and Animal Control Officer of the Borough of Demarest or such other official as may from time to time be designated by resolution of the Mayor and Council of the Borough shall be empowered to enforce all the provisions of this chapter, including but not limited to the provisions of N.J.S.A. 4:19-15.16 and 4:19-15.17, which are incorporated herein.

Fees.

(1) 
The annual license and registration fee for a single dog shall be $11. Moreover, pursuant to the Animal Population Control Program, there will be an additional $3 annual surcharge on all licenses issued for non-spayed and non-neutered dogs.
(2) 
Any person failing to pay by March 1 of each year the annual fees for a dog license as required under this chapter or for a cat license renewal as required under Chapter 189, Sanitary Code, of the Code of the Borough of Demarest shall be required to pay, in addition to the annual fees, a late charge of $25.
F. 
Any person who shall own, keep or harbor any dog of licensing age shall, in the month of January of each year, apply for and procure a license and official registration tag for each such dog so owned, kept or harbored and shall place upon each such dog a collar or harness with the registration tag securely fastened thereto.
G. 
Any person who owns, keeps or harbors a newly acquired dog of licensing age or any dog attaining licensing age or who moves into the Borough of Demarest while owning, keeping or harboring a dog of licensing age shall make application to the Borough Clerk for a license and registration tag for such dog within 30 days after such acquisition, age attainment or move into the Borough.
H. 
In the event that the registration tag shall become lost or misplaced, a new registration tag shall be issued for a fee of $2.[1]

A. 
All provisions of N.J.S.A. 26:4-78 through 26:4-95 are hereby adopted in their entirety and recognized as the controlling regulations and procedures governing rabies control.
B. 
When any person is bitten or attacked by a dog or other animal subject to rabies or other like contagious or dangerous disease, such person, his parents or guardian if he is a minor, the owner of the animal or the person having possession or control thereof, the physician who treats the bite or wound and any veterinarian or lay person having knowledge of such bite or wound must immediately notify the Police Department. The person owning or having possession or control of the offending animal must immediately provide for the examination and observation of such animal by a licensed veterinarian of the State of New Jersey. Said veterinarian shall immediately report his findings to the Board of Health by telephone and shall confirm such report, in writing, within 24 hours. After such preliminary examination, the animal may be returned to the custody of the person from whom it was received or be confined in a veterinary hospital or other place approved by the Board for such period of observation as the Board may direct. An animal must be returned after preliminary examination for reexamination after 10 days to the veterinarian who made the preliminary examination, and said veterinarian shall report his findings to the Board immediately by telephone and in writing within 24 hours. The animal shall then be released to the person from whom it was received unless the animal is rabid or suspected of being rabid.

Any person who violates any of the provisions of this chapter shall be subject to the following penalties, except where otherwise required by state law (e.g., N.J.S.A. 4:19-15.19; N.J.S.A. 26:4-94):
A. 
First offense: $50 fine. No court appearance shall be required if the fine is paid in full prior to the scheduled court date.
B. 
Second offense: $100 fine. No court appearance shall be required if the fine is paid in full prior to the scheduled court date.
C. 
Third or subsequent offense: a fine not to exceed $1,000 or imprisonment in the county jail for not more than 90 days or a period of community service not to exceed 90 days, or all of the above, at the discretion of the Judge imposing the same.

All provisions of N.J.S.A. 4:19-17 et seq. (P.L. 1989, c. 307, as amended) are hereby adopted in their entirety and are recognized as the controlling regulations and procedures governing the treatment of vicious or potentially dangerous dogs.
B. 
Pursuant to N.J.S.A. 4:19-31, the sum to be paid annually for a potentially dangerous dog license and each renewal thereof shall be $700.
