Any resident of the Borough of East Petersburg, Lancaster County, Pennsylvania, may make application to the Borough for a designated handicapped parking space at his or her place of residence within the Borough by filing an application with the Borough office on the form provided by the Borough.
The application form for the handicapped parking space shall be on a form as approved by the Borough Council by resolution duly adopted.
If the applicant's application is approved by Council, the handicapped parking space shall be marked and signs installed in accordance with the requirements of law.
Any unauthorized person who parks in the parking space shall be subject to the penalties provided for herein.
The designation of the handicapped parking space shall be terminated in accordance with the policy adopted by resolution of the Borough Council.
Any person who is found to be in violation of this article in a proceeding before the District Justice for the Borough shall be subject to a fine of not less than $50 and not more than $500 and/or to be imprisoned for a period of not exceeding 90 days. A separate offense shall arise for each day or portion thereof in which a violation is found to exist.
