The following words, as used in this Part, shall have the meaning ascribed thereto, unless the context clearly indicates a different meaning:
AUTHORIZED PERSON
Any individual acting in his/her capacity as an employee or agent of the Town of Bloomsburg or Columbia County or as public emergency personnel.

AUTHORIZED VEHICLE
A vehicle or type of vehicle, other than an emergency vehicle, for which special operating or equipment privileges are given by the Town or Columbia County.
COLUMBIA COUNTY FLOOD RISK REDUCTION SYSTEM
Any publicly owned flood risk reduction facilities, including levees, mechanically stabilized earthen levees (MSE), H-pile walls, cast-in-place concrete structures, closures, drainage structures, pumping systems, storage facilities, or other appurtenances.
EMERGENCY VEHICLE
A Fire Department vehicle, police vehicle, sheriff vehicle, ambulance, blood-delivery vehicle, armed forces emergency vehicle, one vehicle operated by a Coroner or Chief County Medical Examiner and one vehicle operated by a Chief Deputy Coroner or Deputy Chief County Medical Examiner used for answering emergency calls, or any other vehicle designated by the State Police under Section 6106 of the Pennsylvania Vehicle Code[1] (relating to designation of emergency vehicles by Pennsylvania State Police), or a privately owned vehicle used in answering an emergency call when used by any of the following:
A. 
A Police Chief and Assistant Chief.
B. 
A Fire Chief and Assistant Chief.
C. 
A Fire Police Captain and Fire Police Lieutenant.
D. 
An Ambulance Corps Commander and Assistant Commander.
E. 
A River Rescue Commander and Assistant Commander.
F. 
A County Emergency Management Coordinator.
G. 
A Fire Marshal.
H. 
A Rescue Service Chief and Assistant Chief.
I. 
A County Flood Resiliency Officer or designated County agent.
MOTOR VEHICLES
A vehicle which is self-propelled, including, but not limited to, mini-bikes, trail bikes, go-carts, snowmobiles, hoverboards, all-terrain vehicles, except ones which are propelled solely by human power, or other vehicles similar to those listed herein.
PEDESTRIAN
A natural person afoot.
PERSON
Any natural person, corporation, organization of persons, company, association, or partnership.
PLAY OR RECREATION AREA
Any area designated by the Town Council or County Commissioners as being for public use for the purpose of recreation, amusement, or pleasure.
UNAUTHORIZED PERSON
Any individual who is not an authorized person.

VEHICLE
Any device or beast of burden in, upon, or by which any person or property is or may be transported or drawn upon the levee, including, but not limited to, skateboards, bicycles, tricycles, in-line skates, coasters, sleds, skis, and horses, except devices used exclusively to transport handicapped persons or infants and small children by a pedestrian.

No person shall, upon any portion of the Columbia County Flood Risk Reduction System, or upon the right-of-way of said system, operate, or cause to be operated thereupon, any vehicle upon which any person or property is or may be transported or drawn, including, but not limited to, any vehicle, including skateboards, in-line skates, coasters, sleds, skis, and horses, or be thereupon in possession and/or control of any vehicle, including skateboards, in-line skates, coasters, sleds, skis, and horses; provided, however, that this provision shall not apply to any official of the Town of Bloomsburg or County of Columbia, or any person authorized by said officials who is upon said system and right-of-way for purposes of inspection, maintenance, or repair of said system and right-of-way, or for purposes of flood protection or prevention in times of floods or threats of floods.
2. 
No person shall, upon any portion of the Columbia County Flood Risk Reduction System, or upon the right-of-way of said system, operate, or cause to be operated thereupon, any motor vehicle upon which any person or property is or may be transported or drawn, including, but not limited to, any motor vehicle, automobile, truck, motorcycle, motor scooter, motorized pedalcycle, trail bike, or mini-bike, or be thereupon in possession and/or control of any motor vehicle upon which any person or property is or may be transported or drawn, including, but not limited to, any automobile, truck, motorcycle, motor scooter, motorized pedalcycle, trail bike, or mini-bike; provided, however, that this provision shall not apply to any official of the Town of Bloomsburg or County of Columbia, or any person authorized by said officials who is upon said system and right-of-way for purposes of inspection, maintenance, or repair of said system and right-of-way, or for purposes of flood protection or prevention in times of floods or threats of floods.

It shall be unlawful for any person, being the parent or guardian of any child under the age of 16 years, to permit or cause to permit said child to operate any motorized vehicle, including, but not limited to, mini-bikes, motorcycles, scooters, trail bikes, go-carts, snowmobiles, or ATVs, in or upon the flood risk reduction system owned by or under the control of the Town of Bloomsburg and/or County of Columbia.

The provisions of this Part shall not apply to equipment owned by, authorized by, or under the control of the County of Columbia or Town of Bloomsburg which is being used for the care or maintenance of the grounds or facilities, or emergency vehicles.

1. 
Any person violating any of the provisions of § 8-902 or § 8-903 of this Part shall, upon summary conviction before a District Justice, be sentenced to pay a fine of not less than $200 or more than $600 and cost of prosecution. Each succeeding offense shall cause to be issued a fine to increase no less than $100 and cost of prosecution. Each separate occurrence shall constitute a new violation. Upon default of payment of the fine imposed and costs, the defendant shall undergo imprisonment for a period not to exceed 30 days.

"Rules and regulations" are any rules and regulations hereby or hereinafter established by ordinance of the Town of Bloomsburg.
A. 
Levee Usage Hours. The levee and MSE levee shall be opened daily to the public at such hours as the County of Columbia may from time to time designate, but in no event shall any unauthorized person be permitted to be in attendance on the levee between 10:00 p.m. and 6:00 a.m., or during a declared flood event, unless specific permission shall be granted by the County of Columbia. At no time shall any unauthorized person be permitted on or about the levee on the portion situate east of Market Street.

B. 
Permitted Usage. Public usage shall be limited to pedestrians, bicycles or tricycles, or devices used exclusively to transport handicapped persons or infants and small children by a pedestrian, subject to the restrictions in Subsection 1A above.

C. 
Prohibited Conduct. No person in attendance on any portion of the Columbia County Flood Risk Reduction System shall:
(1) 
Mar, deface, injure, cut, remove, or damage the earth, soil, vegetation, signs, fixtures, or any other property of the Columbia County Flood Risk Reduction System, or commit such acts upon the easements or rights-of-way of said system.
(2) 
Litter any area of the system with garbage, paper, bottles, cans, or other waste material; the same shall not be disposed of in any way except in receptacles designated for the respective purpose.
(3) 
Kindle or maintain any fire on the levee system.
(4) 
Remove any bollard, bench, handrail, seat, table, or other item from the Columbia County Flood Risk Reduction System without permission of the County of Columbia.
(5) 
Injure, deface, destroy, or remove any notice, rule, or regulation posted at any place within the County of Columbia Flood Risk Reduction System; nor shall any notice or placard be posted within the system other than by authority of the County of Columbia.
(6) 
Set up any booth, table, or stand for the sale of any article or service or for the purposes of any solicitation whatsoever within the limits of the Columbia County Flood Risk Reduction System without permission of the County of Columbia.
(7) 
Operate, stop, or park any vehicle or other means of conveyance, except in areas where permitted or designated by proper authority of the County of Columbia.
(8) 
Bring onto the premises which are part of the Flood Risk Reduction System, possess, or consume any alcoholic beverages or illegal drugs of any kind; no person shall enter the Columbia County Flood Risk Reduction System under the influence of alcohol or controlled substances.
(9) 
Carry or discharge any firearms, slingshots, firecrackers, fireworks, or other missile-propelling instruments, explosives, arrows, or other dangerous weapons which have such properties as to cause annoyance or injury to any person or property, unless permission has been granted by the County of Columbia in designated areas; law enforcement officers in the performance of their duties will be exempt from this provision.
(10) 
Play ball, swim, golf, pitch horseshoes, engage in archery, sled ride, cross-country ski, ski, or launch, dock, or land any boat, engage in finding buried objects with or without special detectors, or participate in any other form of recreation, sporting endeavor or pastime, except that pedestrian or bicycle/tricycle use is permitted only between the hours of 6:00 a.m. and 10:00 p.m.
(11) 
Disturb the peace by any act or conduct himself in an indecent or boisterous manner within the Columbia County Flood Risk Reduction System so as to annoy any other person using the levee system.
(12) 
Operate a motor vehicle on the Columbia County Flood Risk Reduction System.
(13) 
Hold any public meeting or engage in any marching as members of a military, political, or other organization without permission of the County of Columbia.
(14) 
Be on the Columbia County Flood Risk Reduction System other than a designated foot/bicycle path.
(15) 
Disobey a proper order of a police officer or County-authorized personnel, or disobey or disregard or fail to comply with any rule or regulation, warning, prohibition, instruction, or direction posted or as to its existence by the County of Columbia or the Town of Bloomsburg.
(16) 
Hunt for, capture or kill, or attempt to capture or kill, or aid or assist in the capturing or killing of, in any manner, any wild bird or wild animal of any description, either game or otherwise, without express written permission of the County of Columbia. To that end, it is unlawful for any person to carry onto, or possess on the Columbia County Flood Risk Reduction System, a rifle, pistol, or firearm of any make or kind, unless specific permission is granted for a designated area by some authority of the County of Columbia or the Town of Bloomsburg.
