The Township of Union ("the Township") hereby joins with the Borough of Birdsboro in accordance with the Pennsylvania Intergovernmental Cooperation Act, by entering into an agreement entitled Joint Bidding and Contracting of Public Works Projects by Union Township and the Borough of Birdsboro ("the agreement"), which is hereby incorporated by reference with the same effect as if it had been set out verbatim in this article, with a copy of the agreement to be filed with the Secretary of the Township and to be available for review.
The Chairman of the Board of Supervisors, acting on behalf of the Board, is hereby authorized and directed on behalf of the Township to execute and deliver the agreement, and to execute and deliver such other additional instruments, and to take such further actions, as may be necessary or appropriate to carry forth the agreement and the purposes of this article.
All actions of any officer, agent or other representative of the Township heretofore taken in the pursuit of the establishment and implementation of this intergovernmental cooperation agreement, are hereby ratified and approved in all respects.
As required by the Pennsylvania Intergovernmental Cooperation Act, the following matters are specifically found and determined:
A. 
The conditions of the agreement are set forth in the agreement.
B. 
This agreement shall continue in effect until terminated by a subsequent ordinance of the governing body of the Township of Union or the Borough of Birdsboro. No termination shall be effective, until such time as any jointly entered into contractual obligations of the municipalities have been satisfied.
C. 
The purpose and objectives of the agreement are as set forth in this article and in the agreement.
D. 
The manner and extent of financing the agreement are that:
(1) 
No borrowing will be required by the Township;
(2) 
Funds to implement the Township's obligations under the agreement shall come from normal and usual budgeted amounts for such matters, including, but not limited to, monies available through the Pennsylvania Liquid Fuels Program; and
(3) 
Other provisions governing the manner and extent of the financing of the public works projects shall be as set forth in the agreement.
E. 
The organizational structure necessary to implement the agreement shall be coordinated by the Managers of the municipalities, as more fully set forth in the agreement.
F. 
The acquisition of real property is not included within the scope of this agreement. All personal property acquired or disposed of as part of the bidding and contracting process shall be in accordance with the terms of the agreement.
