[HISTORY: Adopted by the Board of Trustees of the Village of Chestnut Ridge 5-19-1988 by L.L. No. 2-1988. Amendments noted where applicable.]
The Board of Trustees of the Village of Chestnut Ridge hereby determines that the protection of the environment is essential for the health, safety and welfare of the public. To accomplish this goal, it is necessary that the amount of garbage and trash to be disposed of at landfills be reduced, and that recyclable materials be separated from garbage and trash and marketed for reuse where feasible. This chapter is intended to accomplish this goal.
A. 
When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
B. 
The following words shall have the following meanings when used in this chapter:
ASHES
The residue from the burning of wood, coal, coke or other combustible materials.
CONSTRUCTION AND DEMOLITION DEBRIS
Any waste resulting from construction, remodeling, repair and demolition of structures, road building and land clearing, and such wastes include bricks, concrete and other masonry materials, soil, rock and lumber, road spoils, paving material and tree and brush stumps. Construction and demolition debris does not include:
(1) 
White goods, such as refrigerators, stoves, household appliances, water heaters and the like.
(2) 
Tires and batteries.
(3) 
Paint cans and paint in other containers.
(4) 
Garbage.
(5) 
Septic waste.
(6) 
Sewage sludge.
(7) 
Liquid wastes.
(8) 
Containers (cans and/or drums that held solvents, paint thinner, oil, etc.).
(9) 
Putrescible waste.
(10) 
Pesticides.
(11) 
Cardboard and wastepaper.
(12) 
Contaminated soil.
(13) 
Significant quantities of wallboard.
(14) 
Industrial waste.
(15) 
Hazardous waste as defined in 6 NYCRR 371.
CUSTOMER
Property owner, or occupant, of a non-multifamily residence.
GARBAGE
Normal, usual household waste other than newspapers, primarily from perishable or disposable items such as leftover food matter, food packaging and containers, disposable plastic eating utensils, dishes, pots, pans, glass, bottles and crockery, including putrescible animal and vegetable waste resulting from the preparation, handling, cooking and consumption of food.
MULTIFAMILY RESIDENCE
Any residence legally containing in excess of two families.
NEWSPAPERS
Printed material on a paper product known as "newsprint," including newspapers, newspaper advertisements, supplements, comics and newspaper enclosures. Newspapers shall not include magazines, books of any kind, or cardboard.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
RECYCLABLES
All items designated by the Board of Trustees as required to be separated from garbage and trash and placed for collection in separate containers. Recyclables shall include white glass, glass in certain other colors, plastic bottles, cans, and any other items designated as recyclables by the Board of Trustees.

REFUSE
All putrescible and nonputrescible solid wastes (except body wastes), including garbage, wastepaper, trash, construction and demolition debris and ashes. Refuse shall not be deemed to include dead animals or abandoned automobiles.
TRASH
Any item of solid waste not included within the definitions of garbage, newspapers, or construction and demolition debris, that is nontoxic and/or nonputrescible and is placed in a clearly fastened container or bag which is filled at a maximum weight of 30 pounds and a maximum volume capacity of 30 gallons. Said items include, but are not limited to:

(1) 
Discardable household items of a durable nature, such as furniture, cardboard cartons or packaging, household appliances and large appliances, such as refrigerators, washing machines, dryers, dishwashers and hot water heaters.
(2) 
Garden, yard and lawn waste, such as clippings, leaves, only if placed in containers, cartons or bags which are securely fastened; Christmas trees, tree branches and fallen trees cut into sections less than four feet long and tied or weighing no more than 30 pounds per piece.
(3) 
Ashes and other refuse resulting from the burning of wood or coal in a residence for heating purpose, so long as the same is placed in containers, cartons or bags.

A. 
It shall be unlawful for any person to place, deposit or permit to be placed or deposited any newspapers or other recyclables within the same receptacle, package or place as garbage and/or trash within the Village of Chestnut Ridge.
B. 
Newspapers shall be separately tied, bundled or packaged and placed, deposited or left in a place designated by the Board of Trustees of the Village of Chestnut Ridge. Other recyclables shall be separately packaged and placed, deposited or left in a place designated by said Board of Trustees. The deposit of said newspapers and/or recyclables shall be made on the days and times designated by the Board of Trustees.
C. 
No person shall place, deposit or leave newspapers, recyclables, garbage or trash in such a manner that it becomes or will become a hazard or potential hazard to public travel, health or safety, or that will clutter or encroach on the public right-of-way, or that it will be aesthetically offensive or a public health hazard.
D. 
Ownership of newspapers and/or recyclables set out for collection shall vest in the Village of Chestnut Ridge. It shall be unlawful for any person, firm or corporation to collect, remove or dispose of any newspapers or recyclables which are the property of the Village without first having obtained permission from the Board of Trustees.

A. 
The Board of Trustees of the Village of Chestnut Ridge may, by resolution, determine that other items of garbage and/or trash shall be separated from the waste stream for collection. The Board of Trustees shall, by resolution, promulgate rules and regulations for the collection and disposal of such items, to be designated as "recyclables," and for the implementation of this chapter, as amended.
B. 
All resolutions of the Board of Trustees relating to the designation of items as "recyclables" and all other rules and regulations adopted pursuant to this section shall be enforced in the same manner as other provisions of this chapter.
The Police Department of the Town of Ramapo, the Mayor, or the Code Enforcement Officers of the Village of Chestnut Ridge shall have the power, right and authority to enforce the provisions of this chapter.
Any property owner upon whose real property newspapers, garbage or trash are left, placed or deposited in such a manner as to be in violation of this chapter or whose real property abuts or adjoins the public right-of-way on which newspapers, garbage or trash create a violation of this chapter shall be presumed to be the person who left, placed or deposited such newspapers, garbage or trash in such place.
A. 
The Village of Chestnut Ridge shall not be required to remove, collect or pick up garbage or trash from the real property of any person who violates the provisions of this chapter.
B. 
Duties of customers.
(1) 
Customers must purchase their own containers.
(2) 
All refuse must be in containers. The contractors shall not be required to collect any refuse which is not placed therein.
(3) 
For collection pursuant to a schedule set forth by contract with the Village of Chestnut Ridge, any refuse bags or containers from which refuse is collected and which is placed at the curbside shall be set out at the curbside no earlier than 3:00 p.m. on the day prior to collection nor later than 6:00 a.m. on the day of collection, and all containers shall be removed no later than 8:00 p.m. on the collection day. When a regular collection day falls on a legal holiday, refuse or containers shall not be set out at the curbside until the next regularly scheduled collection day unless special announcement of collection is made by the Village. Except as provided herein, no refuse bags or containers from which refuse is collected may be placed within 10 feet of a public road. This provisions shall not apply to the collection of garden, yard or lawn waste, such as leaves, which are placed in bags or containers.
(4) 
The customer shall not require collections from the interior of any structure.
(5) 
Unless otherwise provided herein or by regulations established by the Village Board of Trustees, only trash, garbage and newspapers shall be included in the items picked up by the contractors under contract with the Village.
In addition to the provisions of § 238-7A of this chapter, any person who is determined to be guilty of a violation of this chapter in a court of competent jurisdiction shall be subject to a fine of not less than $25 and not more than $50 for each such violation.
This chapter shall take effect on June 1, 1988.
