Village of Chestnut Ridge, NY Chapter 78 Public Officers, Appointed

§ 78-1 Intent.

The Village Board of the Village of Chestnut Ridge hereby finds and determines that it is in the best interest of the residents of the Village of Chestnut Ridge to find and appoint qualified people to Village Officers, including the Office of Village Clerk, Village Treasurer, Building Inspector, Assistant Building Inspector, full-time Code Enforcement Officers, part-time Code Enforcement Officers, Fire Safety Inspector, Associate Justice, and Justice Court Clerks. The Village Board also finds that the state requirement that Village Clerk, Village Treasurer, Building Inspector, Assistant Building Inspector, full-time Code Enforcement Officers, part-time Code Enforcement Officers, Fire Safety Inspector, Associate Justice and Justice Court Clerks to be Village residents and elector may limit the Village Board’s ability to find qualified people to fill those positions. Therefore, the Village Board hereby determines that the residency requirement for appointment to those positions of Village Clerk, Village Treasurer, Building Inspector, Assistant Building Inspector, full-time Code Enforcement Officers, part-time Code Enforcement Officers, Fire Safety Inspector, Associate Justice and Justice Court Clerk should include residents of the County of Rockland or an adjoining county within New York State.

§ 78-2 Residency requirements.

Persons holding the position of Village Clerk, Village Treasurer, Building Inspector, Assistant Building Inspector, full-time Code Enforcement Officers, part-time Code Enforcement Officers, Fire Safety Inspector, Associate Justice and Justice Court Clerks shall reside in the County of Rockland or any adjoining county located the State of New York.

§ 78-3 Authority; supersession of state law.

This chapter is adopted pursuant to Section 10 of the Municipal Home Rule Law and is intended to supersede New York State Public Officers Law § 3 and New York State Village Law § 3-300 and any other special law to the extent that such special law may require the Village Clerk, Village Treasurer, Building Inspector, Assistant Building Inspector, full-time Code Enforcement Officers, part-time Code Enforcement Officers, Fire Safety Inspector, Associate Justice and Justice Court Clerks to reside within the Village of Chestnut Ridge and be an elector of the Village.
