It shall be unlawful for any owner, lessee or occupant or any agent or person in control of any occupied or unoccupied lot or plot of land or any part thereof in the Village of Dansville to permit or maintain thereon noxious weeds, long grass or other rank growths or growths which are harmful, poisonous or detrimental to the public health or safety. Weeds, grass and other growth higher than six inches shall be considered detrimental. Trees, bushes or other vegetation that may interfere or restrict firefighting or other emergency services safe or unimpeded access to a structure, lot or plot of land.
It shall be the duty of any owner, lessee, occupant or any agent or person in control of any occupied or unoccupied lot or plot of land or any part thereof in the Village of Dansville to cut and remove or cause to be cut or removed all such weeds, grass or other rank, poisonous or harmful growths as often as may be necessary to comply with the provisions of § 241-1 of this article.
A. 
If the provisions of the foregoing sections are not complied with, the Board of Trustees may cause to have a written notice to be served, either personally or by mail, upon the owner, lessee or occupant or any person having the care or control of any such lot or plot to comply with the provisions of this article. If the person upon whom the notice is served fails, neglects or refuses to comply with the demands of such notice within five days after service of such notice, the Village may enter upon such lot or plot and shall cut and remove such weeds, grass or other vegetation or shall remove such rubbish or other hazard as set forth in § 241-2 and the actual costs in connection therewith shall be certified by the Superintendent of Streets to the Village Clerk-Treasurer and shall thereupon become and be a lien upon the property on which such weeds, grass, vegetation, rubbish, etc., were located and shall be added to and become a part of the taxes next to be assessed and levied upon such lot or land and shall bear interest at the same rate as taxes and shall be collected and enforced by the same officers and in the same manner as taxes.
B. 
For any additional violations of said Weed Ordinance by same owners or tenants of same property, only one notice per year at the occurrence of the first violation that year need be sent. No further notice need be sent for any further violation of the Weed Ordinance for that particular piece of property.
Any person who shall neglect to cut and remove weeds, grass or other vegetation as directed by this article or who shall fail, neglect or refuse to comply with the provisions of any such notice herein provided or who shall violate any of the provisions of this article or who shall resist or obstruct the Village or its employees in the cutting and removal of weeds, grass, other vegetation or removal of any health or fire hazard as herein provided, shall be deemed to have violated this chapter.
