The owner, occupant or tenant of every property fronting upon or alongside of any of the streets in the Borough of Catawissa is hereby required to remove or cause to be removed from all of the sidewalks in front of or alongside of such property snow or ice thereon fallen or formed within 12 hours after the same shall have ceased to fall or form, provided that snow or ice that has ceased to fall or to be formed after 6:00 p.m. may be removed at any time before 10:00 a.m. the next morning. In the event that snow and/or ice on a sidewalk has become so hard that it cannot be removed without damage to a sidewalk, the person charged with its removal shall, within the time specified above, place enough sand or other abrasive ice remover on the sidewalk to make travel reasonably safe and shall, as soon thereafter as weather permits, clear the sidewalk as specified herein. Snow or ice which is removed shall not be deposited in the roadway of any street, alley, or public sidewalk of the Borough of Catawissa and shall not be placed adjacent to any fire hydrant. Further, the owner of a property shall be responsible for conforming to the requirements of this section.

In any case where the owner, occupant or tenants, as aforesaid, shall fail, neglect, or refuse to comply with any of the provisions of § 287-5 within the time limit prescribed therein, the Borough authorities may, but shall not be required to, proceed immediately to clear all snow and/or ice from the sidewalk of such delinquents and to collect the expenses thereof, together with an additional amount of 25% of such expense, from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under § 287-7.

Any person, firm or corporation who shall violate any provision of this article shall receive a door hanger for the first offense. After 12 hours of a door hanger, if the condition still exists, a citation will be issued. Any person, firm or corporation who shall violate any provision of this article after the first offense shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 and/or to imprisonment for a term not to exceed 90 days and after a third offense not more than $600 and/or imprisonment for a term not to exceed 90 days; provided, however, that such fine and costs and/or imprisonment may be in addition to any expenses imposed as provided in § 287-6.

A. 
Unlawful acts.
(1) 
It shall be deemed unlawful for any person to remove snow from his or her property and to place that snow on a public sidewalk, roadway, or intersection.
(2) 
It shall be deemed unlawful for any person to remove snow from his or her property and to place that snow in a manner that it obstructs any fire hydrant.
(3) 
It shall be deemed unlawful for any person to remove snow from his or her property and to place that snow on the property of another.
B. 
Violations and penalties. Any person violating this section shall be punishable for first, second and subsequent offenses as set forth in § 287-7 of this article.
