Every owner of property in the Borough of Catawissa shall, on 30 days' notice from the Borough Council, construct or reconstruct sidewalks or curbs in front of or alongside of such property which shall conform to all pertinent requirements of the ordinance or ordinances providing for the laying out and improving of said sidewalks.
Every owner of property in the Borough of Catawissa shall, on 10 days' notice from the Borough Council, repair the sidewalks or curbs, in the manner stipulated in such notice, in front of or alongside such property.
The notices referred to in §§ 287-20 and 287-21 may be written or printed or partly written and partly printed.

Concrete curbing is required whenever any existing concrete curbing is being replaced or repaired. Rolled asphalt curbing is permitted along streets where no previous curbing has existed.

The materials and construction specifications to be used in sidewalk and/or curb construction will be provided by the Borough Engineer. Concrete curbs and sidewalks shall be poured at a time when the temperature is above 35° F., provided that, in case of emergencies, the Borough Engineer may permit concrete to be poured when the temperature is below 35° F.
In all cases where sidewalks are constructed, reconstructed or repaired over coal cellars or other excavations under the sidewalks, such sidewalks shall be supported by iron or steel beams, or girders of steel, or concrete arches. Before any such construction or reconstruction shall be commenced, the plans therefor shall be submitted to and approved by the Borough Engineer. In no cases shall any waste material or other perishable material be used.
All sidewalks and all curbs shall be constructed, reconstructed and repaired and the grading therefor shall be in accordance with the line or grade fixed in the ordinance or ordinances laying out the street or streets upon which such construction, reconstruction or repair is to be performed, and the grade therefor shall be obtained by the property owner from the Borough Engineer and not otherwise. Upon notice, as provided in §§ 287-20 and 287-21, as the case may be, such work of construction, reconstruction or repairs shall be done by the owner or owners of such property or properties.
It shall be the duty and responsibility of the Borough Engineer to determine and report to the Borough Council, in the case of an individual property, whether or not the sidewalk or curb shall be reconstructed or repaired, and if so, the specific part or parts thereof to be reconstructed or repaired.
The Engineer may at any time during the course of work of construction, reconstruction or repairing any sidewalk or curb visit the site of such work to ascertain whether the same is being done according to requirements, and he or one of his assistants shall visit any such site for such purposes whenever requested by the property owner.
All curb and sidewalk forms shall be inspected and approved by the Borough Engineer before any concrete shall be poured therein and within two days after the completion of the work of construction, reconstruction or repair of any sidewalk. It shall be the duty of the owner of any property where such work is done to notify the Borough Engineer of that fact, in writing, so that he may inspect such sidewalk or curb to determine whether the grade thereof has been observed and followed.
Any property owner, upon his own initiative and without notice from any Borough official, may construct, reconstruct or repair a sidewalk or curb in front of or along his property, provided that such owner shall first make application to the Borough Engineer, which construction, reconstruction or repair shall conform with the requirements of this article and the ordinance or ordinances providing for the opening, laying out and improvement of the street[1] as to line and grade and as to material used, and he shall also notify the Borough Engineer, as required by § 287-29, within two days after completion of the work.

Upon the failure of any property owner or owners to construct, reconstruct or repair any sidewalk or curb or to grade and sod the ground between the property line and sidewalk line and between the sidewalk and curb, after receipt of the notices herein provided for, the Borough may, but shall not be required to, make such improvements, and if such improvements are made by the Borough, shall file a municipal claim for the costs thereof, together with 10% additional as attorneys' commission for collection.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 and/or to imprisonment for a term not to exceed 90 days. Every day that a violation of this article continues shall constitute a separate offense.
