Roadways must be saw cut to a minimum of eight inches from the edge of the sidewalk. No material taken out of ditch line can be put back in. 2RC stone must be used for replacement fill. A compaction device must be used to compact the material. A jumping-jack type machine can have no more than eight-inch lift at one time, and a pad wacker can have no more than four-inch lift at one time. There must be a minimum of three inches of BCBC or an equal amount of amnesite that was removed, whichever is greater. A one-inch amount of ID-2 must be used to top. No cold patch material is acceptable unless in case of emergency or when hot mix is not available because of seasonal shutdown. If cold patch is used because of winter shutdown at the amnesite plant in the fall, the cold patch must be taken out and replaced with hot mix by June 1 of the following year. If cold patch is used after January 1, it must be taken out and replaced by June 1 of that same year.
Jackhammers can be used to open ditch lines in roadways but must be saw cut before amnesite can be replaced. All material taken out of a ditch must be hauled away and be replaced with 2RC stone. A jumping-jack style compaction machine must be used to compact material. The 2RC stone must be put in no more than eight inches at a time before compacting. There must be a minimum of four inches of BCBC put in, or an equal amount that was taken out, whichever is greater. The BCBC must be compacted with a jumping-jack type machine or a vibrator roller. There must be at least one inch to 1 1/2 inches of ID-2 top put on. The ID-2 top must be compacted with a pad wacker or vibrator roller. The contractor is responsible to contact the Streets Department before backfilling the ditch and before replacing the amnesite so an inspector can be present at the time of such work. Cold patch can only be used in case of plant shutdown or temporary use and must be taken out and replaced as stated in § 287-33 of this article.
Any contractor or individual that damages any part of the Borough's roadway for whatever reason is responsible to fix, repair or replace that section of roadway. If any damage does occur, the Streets Department must be notified as soon as possible so the contractor or individual can be told how to repair or replace the damaged area. Failure to contact the Street Department of ditch replacement or amnesite replacement so an inspector can be present on the job site can result in the contractor or individual tearing out ditch or amnesite area and made to replace same area with an inspector present.

Contractors and individuals shall be responsible for reimbursing the Borough for the cost of the inspector per the current fee of the inspector.
Any person, firm or corporation doing, causing or permitting anything contrary to this article, directly or indirectly, or in any way violating the provisions hereof, is subject to a fine for each offense not to exceed $300, or in default of payment thereof, to imprisonment not exceeding 30 days; each weekly repetition or continuation is a separate offense. The penalty herein vested is in addition to any fees required or costs or damages resulting.
