Effective February 1, 1980, there is hereby created within the
City of Corbin City the position of Zoning and Code Enforcement Officer
to be appointed by the Mayor, with the approval of the Common Council,
to hold office for a period of one year, which term shall expire on
December 31 of each year. Effective as of January 1, 2009, the official
title for this position shall be "Zoning and Code Enforcement Officer",
and wherever, in these ordinances, the term" Zoning and Code Enforcement
Officer" shall appear, it shall be inclusive of that new title.
The Zoning and Code Enforcement Officer shall maintain a permanent
record of all matters considered and all action taken by him. The
record shall form a part of the records of his office and shall be
available for the use of the Common Council and other officials of
the City, county and state. The records to be maintained shall include
at least the following:
A. Application files. An individual permanent file of each application
for a permit provided for by this section shall be established at
the time the application is made. The file shall contain one copy
of the application and all supporting documents, maps and plans, as
well as notations regarding pertinent dates and fees; one copy of
the resolution of the Board of Adjustment in acting on an application
and the date the permit applied for was issued or denied by the Zoning
and Code Enforcement Officer.
B. Monthly report. The Zoning and Code Enforcement Officer shall prepare
a monthly report for the Common Council. The report shall cite all
actions taken by the Zoning and Code Enforcement Officer, including
all referrals made by him, all permits and certificates issued and
denied and all complaints of violations received and all violations
found by him, as well as the action taken by him consequent thereon.
A copy of the monthly report shall also be transmitted by the Zoning
and Code Enforcement Officer to the Tax Assessor, Planning Board and
Board of Adjustment at the same time it is transmitted to the Common
Council.
In the event that the Zoning and Code Enforcement Officer, pursuant
to the procedures herein set forth, shall determine that a violation
exists which has not been properly remedied within the time permitted,
he or she may pursue any appropriate actions in a municipal court
or other courts of the State of New Jersey for lawful redress of said
violations.
All applications for zoning permits shall be made to the Zoning
and Code Enforcement Officer. The Zoning and Code Enforcement Officer
shall carefully consider the application and all supporting documents
in accordance with the Zoning and Planning Ordinances of this municipality
and shall make a determination of the application's compliance with
the provisions thereof and, based upon that determination, shall either
issue or deny the zoning permit applied for within 15 days thereof.
Upon obtaining a zoning permit, the applicant may then apply to the
Construction Official for a construction permit and/or certificate
of occupancy in the manner prescribed by the Uniform Construction
Code as enacted for this municipality.
The Zoning and Code Enforcement Officer shall receive for his
services hereunder a salary as shall be determined, from time to time,
by ordinance of the Common Council.
