As used in this chapter, the following terms shall have the
meanings indicated:
- GARAGE SALES
- Shall mean and include all sales entitled "garage sales," "yard sales," "lawn sales," "rummage sales," or any other similar casual sale of tangible personal property which is advertised by any means whereby the public at large is or can be made aware of the sale.
- GOODS
- Meant to include any goods, warehouse merchandise, or other items of personal property capable of being the object of a sale.
- PERSON
- Shall mean and include individuals, households, families, partnerships, voluntary associations and corporations.
A.
It shall be unlawful for any person to conduct a garage sale in the
City at any time outside of the hours of 7:00 a.m. to 7:00 p.m. on
Friday, Saturday and Sunday.
B.
The goods that are offered for sale shall be displayed and arranged
for sale no earlier than 4:00 p.m. on Thursday prior to the sale.
The goods that are offered for sale shall be stored and totally removed
from view of the public after 7:00 p.m. on the last day of the sale
and before the following Monday at 7:00 a.m. The goods offered for
sale shall only be visible to the public starting at 4:00 p.m. on
the Thursday prior to the sale and may remain visible during the sale.
No goods will be allowed in front, side or back yards, carports, porches,
patios, decks, truck beds, trailers, tables or covered by tarps from
7:00 a.m. Monday through 4:00 p.m. on Thursday.
C.
Garage sales shall not be located in zoning districts which permit
goods to be sold.
A garage sale may only be held four times within 12 months (January through December), only on the days and during the hours provided in § 207-2 above.
A.
Signs may be placed on private property only with the permission
of property owners. Signage may not be placed closer than 13 feet
to the curbline. No signs may be placed on the curb, sidewalk, utility
poles, poles, hydrants, bridges, trees, fencing, or on the surface
of public property or public ROWs.
B.
Only signs issued by the City may be utilized; each permit will have
three signs issued. City-issued signs may be installed 24 hours in
advance. Signage shall be removed 24 hours after the sale has come
to an end.
C.
Signage not removed will be subject to a penalty set by resolution.
A.
Licensing and/or permits shall be acquired prior to the close of
day one day before the sale begins. Licenses and/or permits are only
valid for the dates specified.
B.
Permits shall be posted clearly at each location and are nontransferrable.
C.
Any and all fees in relation to this chapter shall be set by resolution.
A.
The provisions of this chapter shall not apply to or affect the following
persons or sales:
(1)
Persons selling goods pursuant to an order or process of a court
of competent jurisdiction.
(2)
Persons acting in accordance with their powers and duties as public
officials.
(3)
Any person selling or advertising for sale an item or items of personal
property which are specifically named or designated in the advertisement
and which separate items do not exceed five in number.
(4)
Charitable organizations or persons, when all gross is used for charitable
purposes.
(5)
Estate sales and/or a duly licensed auctioneer at auction.
(6)
Anyone who is to participate in an annual city-wide garage sale.
B.
Each and every sale (including exempt sales) shall require registration.
Registration may be made by phone, fax, email or in person.
Any person, association or corporation who shall violate any
of the terms and regulations of this chapter shall, upon conviction,
be punished as provided by a fine set by resolution.
