It shall be unlawful for children under the age of 18 years of age to be or remain in any of the streets, alleys, parks or places open to the public in the Township of Vanport after the hour of 10:00 p.m. during that time of the year between the first and last day of school of the Beaver Area School System and at all other times of the year after the hour of 11:00 p.m., prevailing time, unless said child is accompanied by a parent, guardian or other adult person having legal custody for the time being of said child.

It is hereby made unlawful for any parent or other person having the legal care and custody of a child of the age above designated to allow or permit such child, ward or other person under such age, while in such legal custody, to go or be in or upon any of the streets, alleys, parks or places open to the public in said Township after the time prohibited in § 86-1 of this chapter, except as therein provided.

Any child as above designated found upon the streets, alleys, parks or places open to the public within the Township in violation of § 86-1 of this chapter shall be taken into custody by the Township police and delivered to his or her parents, guardian or person having the legal custody of said child and report thereof made in a book to be kept by the Police Department for that purpose. If said parent, guardian or person having the legal custody of said child shall again allow him or her to be on said streets, alleys, parks or places open to the public in violation of § 86-1 of this chapter, said parent, guardian or person having the legal custody of said child so offending shall, upon conviction thereof before a District Justice, be sentenced to pay a fine of not more than $600 and costs and, in default of payment of such fine and costs, to be imprisoned in the county jail for not more than 30 days at the discretion of the District Justice, and a like fine or imprisonment shall be imposed upon any person aiding or abetting in the violation of the intent and purpose of this chapter.
The police officers of the Township in taking children into custody under this chapter shall use their discretion in determining age and in doubtful cases may require positive proof, and until such proof is furnished, the officer's judgment shall prevail.
