A. 
An ordinance of the Township of Polk, Monroe County, Pennsylvania, regulating driveway construction within streets, roads and rights-of-way; requiring a permit and fees; providing for correction of improper work; and prescribing penalties for violations.
B. 
Whereas, the Board of Supervisors of Polk Township has determined that improperly constructed or reconstructed driveways and roads intersecting with roads of the Township can cause inadequate drainage of water from the roadways, the accumulation of water and ice on the roadways, damage to the roadways and unsafe and hazardous conditions upon and within the roads of the Township, causing risk to the general public, as well as additional and unwarranted expenses to the Township for repairs to such roadways, the Board of Supervisors has determined that it is in the public interest to regulate the placement, design and construction of driveways and roads intersecting with roads of the Township or roads which may be dedicated to the Township.
C. 
Now, therefore, be it enacted and ordained by the Board of Supervisors of Polk Township, Monroe County, Pennsylvania, and it is hereby enacted and ordained by authority of the same, as follows.
This chapter shall be known and cited as the "Polk Township Driveway Ordinance."
Allegations that this chapter or any amendment thereto was enacted in a procedurally defective manner shall be appealed as provided in state law and filed not later than 30 days after the intended effective date of the chapter or amendment.
