Any person who undertakes any excavation into a City street
for any purpose shall, at his/her expense, maintain at all times during
the progress of his/her work suitable barricades, signs, or other
adequate protection for the public safety, and shall maintain such
danger lights, signals or watchmen as may be necessary to ensure the
safety of the public; this Chapter shall not be interpreted to presume
that the City will furnish, without cost of barricades, signs, flares,
or other such equipment owned by the City.

Any person who shall undertake any excavation into a City street
shall, before taking such action, pay to the City Clerk a non-refundable
fee of two hundred fifty dollars ($250.00) or shall pay a refundable
bond of two hundred fifty dollars ($250.00). If the person decides
to pay the two hundred fifty dollars ($250.00) fee, they shall be
responsible for maintaining barricades, lights, signs and gravel in
the excavation site until the Street Superintendent/Public Works Superintendent
determines the site has settled adequately to replace the street surface,
which shall be done by the City of Sweet Springs. The excavator shall
be responsible for any expenses over the two hundred fifty dollars
($250.00) fee if the excavation site is so large that added expenses
are incurred. If the excavator decides to pay a bond of two hundred
fifty dollars ($250.00), they shall be responsible for maintaining
barricades, lights, signs and gravel on the excavation site until
the Street Superintendent/Public Works Superintendent determines the
site has settled adequately for the replacement of the street surface,
which shall be done by the excavator within twenty-four (24) days
of notification that the area is ready to be replaced with materials
approved by the Street Superintendent/Public Works Superintendent.
After the Street Superintendent/Public Works Superintendent has examined
the repairs made and upon his/her recommendation, the bond will be
returned to the excavator. The excavator shall also be responsible
to repair any curbing, sidewalks or other areas disturbed during the
excavation at their own expense.

Any excavations made into a City street shall be cut twelve
(12) inches farther on all sides than is necessary for the work area.
Immediately following completion of the work that necessitated the
street excavation, the hole shall be filled with rock as approved
by the street department. The excavation area shall be maintained
by the person doing the excavation work with rock until all settling
has occurred. After the street department is satisfied that settling
is complete, the City will restore the surface of the street with
concrete.

Any person who shall make an excavation in any street within
the City, and who shall not cause the same to be enclosed or protected
and to be lighted at night so as to prevent persons, animals or vehicles
from falling therein, shall upon conviction be deemed guilty of an
ordinance violation.
