As used in this chapter, the following terms shall have the
meanings indicated:
APPLICANT
Any person who shall apply for a City identification card
to the administering department.
CARE ADDRESS
The address of any hospital, shelter or any entity in the
City of East Orange serving homeless individuals or victims of domestic
abuse. Said care address may be used in place of a City address on
an applicant's identification card once the entity or organization
provides a care address letter.
CARE ADDRESS LETTER
A letter, dated within 15 days of its submission to the City
by the applicant, from a care address entity as defined herein, stating
that the applicant has received services from the entity in the past
15 days and may use entity's address for mailing purposes. This
letter must be notarized by the care address facility. The applicant's
identification card shall read "care of" the care address entity and
provide said care address.
IDENTIFICATION CARD
An identification card issued by the City of East Orange
that shall display the cardholder's photograph, name, date of
birth, gender, city address or care address, signature, date of issuance
and date of expiration.
RESIDENT
Any person who can establish that they are a resident of the City of East Orange in accordance with §
161-4 of this chapter.
All City departments shall accept the identification card issued
pursuant to this chapter as evidence of residency for the purpose
of allowing the holder therein to access City services and benefits
unless such acceptance is prohibited by federal or state law or unless
the department or authority has reason to suspect fraud by the purported
cardholder.
The records relating to the application and issuance of City
identification cards shall be maintained in accordance with law. The
administering department shall not retain original or copies of documents
provided by an applicant to prove identity or residency when applying
for a City identification card. The City shall make its best efforts
to protect the confidentiality of all City identification card applicants
to the maximum extent permissible by law unless given express permission
by the applicant.
The City of East Orange is providing the personal identification
cards for the purpose of allowing City residents to access City services
and facilities. The City will not assume any liability arising from:
1) the accuracy of the information provided by the applicant or 2)
against any acts, criminal or otherwise, committed by the individual(s)
while possessing or using the identification card. The City does not
waive any of its protections as afforded under federal, state or local
laws, including, but not limited to, the immunities under the New
Jersey Tort Claims Act N.J.S.A. 59:1-1 et seq., by processing or issuing
a City of East Orange identification card.
