A.
Identification cards shall be issued by the City to individuals who
can provide sufficient proof of their identity and residency in accordance
with the terms of this chapter.
B.
The administering department, as set forth herein, shall be responsible
for the implementation of this program, including the adoption of
all rules and procedures to be followed.
As used in this chapter, the following terms shall have the
meanings indicated:
The City of East Orange's Licensing Bureau.
Any person who shall apply for a City identification card
to the administering department.
The address of any hospital, shelter or any entity in the
City of East Orange serving homeless individuals or victims of domestic
abuse. Said care address may be used in place of a City address on
an applicant's identification card once the entity or organization
provides a care address letter.
A letter, dated within 15 days of its submission to the City
by the applicant, from a care address entity as defined herein, stating
that the applicant has received services from the entity in the past
15 days and may use entity's address for mailing purposes. This
letter must be notarized by the care address facility. The applicant's
identification card shall read "care of" the care address entity and
provide said care address.
An identification card issued by the City of East Orange
that shall display the cardholder's photograph, name, date of
birth, gender, city address or care address, signature, date of issuance
and date of expiration.
Any person who can establish that they are a resident of the City of East Orange in accordance with § 161-4 of this chapter.
A.
The City of East Orange identification card shall be available to
all residents of the City regardless of their race, creed, sexual
orientation, citizen status or economic status.
B.
The identification card shall display, at a minimum, the applicant's
full name, photograph, address, date of birth, signature, date of
card issuance and expiration date.
C.
The administering department shall establish, through policy and
procedures, guidelines to protect the addresses of victims of domestic
violence or alternate requirements for applicants who lack a permanent
address.
D.
The identification card shall be designated in a manner to deter
fraud, which may include barcodes, serial numbers, watermarks, the
Borough Seal or other security measures.
E.
The fee for the issuance of a City identification card shall be $15
per family or $10 for adults, senior citizens, veterans or the disabled.
A.
Proof of identity. The administering department shall establish the
criteria for determining the necessary documents and value/weight
to give said documents for purposes of establishing identity and residency.
However, at a minimum, the applicant must produce more than one of
the following documents in order to establish identity:
(1)
A United States or foreign passport;
(2)
A state-issued driver's license;
(3)
A state-issued identification card;
(4)
A United States permanent resident card;
(5)
A consular identification card;
(6)
A certified United States or foreign birth certificate;
(7)
A social security card;
(8)
A national identification card with photo, name, address, date of
birth and expiration date;
(9)
A foreign driver's license;
(10)
A current government visa;
(11)
A United States Individual Taxpayer Identification Number (TIN)
authorization letter;
(12)
An electronic benefit transfer card (EBT); or
(13)
Any other documentation that the administering department deems
acceptable.
B.
Proof of residency. In order to establish residency, the applicant
must present one or more of the following items showing both their
name and residential address located within the City:
(1)
A utility bill;
(2)
A local property tax statement or mortgage payment receipt;
(3)
A bank account statement;
(4)
Proof that the applicant has a minor child enrolled in a City school;
(5)
An employment pay stub;
(6)
A jury summons or court order issued by state or federal court;
(7)
A federal or state income tax or refund statement;
(8)
An insurance bill;
(9)
A care address letter confirming residency; or
(10)
Any other document the administering department determines is
acceptable.
All City departments shall accept the identification card issued
pursuant to this chapter as evidence of residency for the purpose
of allowing the holder therein to access City services and benefits
unless such acceptance is prohibited by federal or state law or unless
the department or authority has reason to suspect fraud by the purported
cardholder.
The records relating to the application and issuance of City
identification cards shall be maintained in accordance with law. The
administering department shall not retain original or copies of documents
provided by an applicant to prove identity or residency when applying
for a City identification card. The City shall make its best efforts
to protect the confidentiality of all City identification card applicants
to the maximum extent permissible by law unless given express permission
by the applicant.
The City of East Orange is providing the personal identification
cards for the purpose of allowing City residents to access City services
and facilities. The City will not assume any liability arising from:
1) the accuracy of the information provided by the applicant or 2)
against any acts, criminal or otherwise, committed by the individual(s)
while possessing or using the identification card. The City does not
waive any of its protections as afforded under federal, state or local
laws, including, but not limited to, the immunities under the New
Jersey Tort Claims Act N.J.S.A. 59:1-1 et seq., by processing or issuing
a City of East Orange identification card.
A.
Altering or intentionally damaging the City identification card,
using another person's identification card, or allowing a cardholder's
identification card to be used by another person will result in confiscation
of the card and shall be deemed in violation of N.J.S.A. 2C:28-7.
Submission of false statements and/or documents to obtain a City identification
card is a violation of N.J.S.A. 2C:21-4 and is punishable by law.
Any person who violates the provisions of this chapter is subject
to the statutory penalties outlined herein as well as the penalties
provided in the Code of the City of East Orange as outlined therein.
