A. 
Recyclables shall be kept separate from and disposed of separately from municipal waste, to the extent required by the following provisions:
(1) 
Owners and occupants of all residential properties shall keep separate from municipal waste, but may commingle, the following recyclables: clear glass, colored glass, Class Nos. 1 through 7 plastics, mixed paper, mixed cardboard, corrugated cardboard, aluminum, steel, bimetallic cans, newspapers and magazines.
(2) 
Recyclable materials shall be empty and placed in blue containers furnished by the Township (except e-waste and household hazardous waste collected separately).
(3) 
Owners and occupants of all commercial, municipal and institutional establishments and properties and sponsors or organizers of community activities shall keep the following recyclables separated: clear glass, colored glass, Class Nos. 1 through 7 plastics, mixed paper, mixed cardboard, corrugated cardboard, aluminum, steel, bimetallic cans, high-grade office paper, mixed paper, newspapers, magazines and leaf waste.
(4) 
The Township Supervisors may, by resolution, enumerate alternative or additional recyclables that will be required to be separated from municipal waste and collected in accordance with this chapter, but not less than required by applicable law.
B. 
Recyclables shall not be placed in the same garbage can or other container as, or otherwise mixed with, municipal waste for collection, removal or disposal.
C. 
Recyclables may be set out for collection in a manner different from the requirements in Subsection A if an alternative manner is designated by the collector and is approved by the Township.
A. 
For residential properties, all recyclables that are required to be kept separate in residential properties pursuant to § 313-12 shall be placed at the appropriate location on the premises to be collected at times designated by the authorized hauler in accordance with the "Fairview Township Terms and Conditions for Solid Waste and Recycling Haulers."
B. 
If the recyclables are to be collected by an authorized hauler, then the recyclables shall be set out within or directly adjacent to the public right-of-way for collection, but not to disrupt the use of the public right-of-way.
A. 
Owners of multifamily residential dwelling units with four or more units, including, but not limited to, rentals, townhouses, condominiums and apartments, shall comply with their responsibilities under this section by establishing a common system for collection by an authorized collector of municipal waste and recyclable materials for all residents of such property.
B. 
For multifamily housing properties, all recyclables that are required to be kept separate in residential properties pursuant to § 313-12 shall be picked up by an authorized hauler separately from municipal waste in a prearranged manner consistent with the "Fairview Township Terms and Conditions for Solid Waste and Recycling Haulers."
C. 
The owner of every multifamily housing property shall require, by clause in the lease or other enforceable rule or regulation, that the tenants in such property comply with the requirements of this chapter governing separation and placement for removal of recyclables in multifamily housing properties. Every such owner shall establish a convenient and practical collection system on such properties for the collection, storage and regular disposal or placement for removal of recyclables generated by the residents of such property.
D. 
The collection system must include suitable containers for collection and sorting materials, easily accessible locations for the containers, and written instructions to the occupants concerning the use and availability of the collection system.
E. 
Owners who do not comply with the aforementioned requirements shall be liable for the noncompliance of occupants of their building.
A. 
Any person occupying any commercial, institutional and municipal establishments within the Township shall separate clear glass, colored glass, Class Nos. 1 through 7 plastics, high-grade office paper, mixed-grade paper, aluminum, mixed cardboard, corrugated cardboard, newspapers, magazines and leaf waste generated at such establishments and from community activities and store the materials until collection by a private collector.
B. 
All recyclables that are required to be kept separate pursuant to § 313-12 shall be picked up by a permitted hauler separately from municipal waste in a prearranged manner consistent with the "Fairview Township Terms and Conditions for Solid Waste and Recycling Haulers."
It shall be a violation of this chapter for any person that is not the owner of the recyclables or the authorized hauler to collect or pick up or cause to be collected or picked up any such items. Any and each such collection in violation thereof from one or more locations shall constitute a separate offense punishable as hereinafter provided. It shall be unlawful for a person other than the owner of the recyclables or the authorized hauler to remove recyclables placed at curbside for collection.
