This chapter is enacted pursuant to the provision of N.J.S.A. 58:10-23.11a et. seq.
The Township Department of Public Safety has responded to an increasing number of hazardous materials incidents. These responses involve substantial expenditures. The purpose of this section is to insure that the Township is financially able to respond to hazardous materials incidents by requiring the person or entity who causes discharge of hazardous materials to reimburse the Township for the expenditures made in responding to that incident.
Any person who causes or permit's the discharge of hazardous materials shall be strictly liable, jointly and severally, without regard to fault for all control and clean-up costs incurred by the Township of Lawrence.
Any person or entity liable for control and clean-up costs pursuant to this section shall reimburse the Township the entire amount of such costs within 45 days after receipt of a request for payment for expenses incurred for the response.
Any person or entity who fails to reimburse the Township the entire amount of the control and clean-up costs within 45 days after receipt of the request for payment shall be subject to a fine of not less than $50 nor more than $500 per day or by imprisonment for a period of not more than four months, or both.
