The functions, powers and duties of the Solid Waste Management Department for the County of Cayuga are hereby incorporated into and merged with the functions, powers and duties of the Planning and Economic Development Department under the supervision and direction of the Director of the Department of Planning and Economic Development.
A. 
The person who holds the position of Environmental Engineer in the Planning Department will act as administrator of the County Solid Waste Management Program. That person and the County Planning Department shall perform all of the duties heretofore performed by the Cayuga County Solid Waste Management Department.
B. 
Wherever the term "Director of the Cayuga County Solid Waste Management Department" is referred to in any law, contract, ordinance or any other reference, hereafter, by authority of this article, whatever function, power, or duty imposed upon the Director will be performed by the person who holds said position of Environmental Engineer in the Cayuga County Planning Department or, if it is a delegable matter, County Planning Department personnel assigned by the Planning Director.
C. 
Notwithstanding the above, the Environmental Engineer and the County Solid Waste Management Program shall be under the ultimate supervision and control of the Planning Director. The Planning Director shall have exclusive authority to appoint and remove personnel associated with the Program as in the case of any Planning Department personnel.
If any clause, sentence, paragraph, section or part of this article shall be adjudged by any court of competent jurisdiction to be invalid, such judgment, decree or order shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section or part thereof directly involved in the controversy in which such judgment, decree or order shall have been rendered and the remainder of this article shall not be affected thereby and shall remain in full force and effect.
