The purpose of this article shall be to preserve the public
peace and good order in the Town and to contribute to the public welfare,
safety and good order of its people and to contribute to the safe
conveyance of its people over the streets and sidewalks of the Town
of Wescott by establishing certain regulations for the removal of
snow and ice from the streets and sidewalks of the Town that are consistent
with the rights and privileges of other residents of the Town.
The deposit of any snow or ice upon any alley or street of the
Town contrary to the provisions of this section shall be and is declared
to be a nuisance and, in addition to the penalty provided for violation
in this section, the Town may summarily remove any snow so deposited
and cause the cost of said removal to be charged to the owner of the
property from which said snow or ice has been removed. If the removal
cost is not paid within 30 days, such charge shall be extended upon
the current or next tax roll as a special charge as provided in § 66.0703,
Wis. Stats., with 5% interest added from date of billing until December
15. The administrative fee shall be in an amount as set from time
to time by resolution of the Town Board, plus actual Town expenses.
Fees shall be paid to the Town of Wescott.
It shall be the duty of the owner and/or occupant of every parcel
of real estate abutting a public sidewalk, whether the parcel of real
estate is occupied by a structure or not, to keep said sidewalk free
from snow and ice for the full width and length of such sidewalk.
Snow and ice shall be removed as soon as practicable, but in
any event, within 24 hours after the end of a snowfall. At any time
when an accumulation of snow and ice shall be frozen so hard that
it cannot be removed without damaging the sidewalk, it shall, within
the time specified herein, be covered with sand, salt or other suitable
material. As soon as practicable thereafter, the sidewalk shall be
completely cleared of snow and ice.
No person, firm, corporation, property owner or occupant shall
deposit, thrown, place or strew, or cause to be deposited, throw,
placed or strewn, any snow or ice upon any street, avenue or roadway
within the Town of Wescott.
This article may be enforced by the citation procedure as authorized by Chapter
37, Citations. Any person who violates this article shall, upon conviction, be subject to the forfeiture amount in the Fine and Forfeiture Schedule of the Town of Wescott that shall be as set from time to time by resolution by the Town of Wescott. Each violation and each day a violation continues or occurs shall constitute a separate offense.
