Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the Township.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in R.S. 39:4-138, any other New Jersey statute or as hereinafter provided.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I of Chapter 7A.
Notwithstanding anything to the contrary herein, the Township Police Department, in its discretion, may permit parking on any street described in Schedule I for a period of up to four hours to accommodate overflow parking for school or community events. The school or organization holding the event must request permission from the Mahwah Police Department 48 hours in advance of the event. Notwithstanding anything to the contrary herein, Township vehicles, may park on any street described in Schedules I, II and III, to conduct official Township business or for the health and safety of Township residents.

No person shall park a vehicle between the hours specified in Schedule II of Chapter 7A, "Traffic Schedules," of the Township's Revised General Ordinances on any day or upon any of the streets or parts of streets described in Schedule II.
Notwithstanding anything to the contrary herein, an individual can request a temporary waiver for nonconsecutive period not exceeding 48 hours from the Township Police Department from the provision on Schedule II prohibiting parking on all streets during the period commencing November 15 and terminating the following April 15 of each year provided that same does not interfere with the health, safety and welfare of residents, traffic maneuverability or with respect to leaf or snow removal. This request shall be made through the Township Police Department and the Township Police Department shall have the discretion to waive the requirements on a case by case basis.
Further, the Township Police Department, in its discretion, may permit parking on any street described in Schedule II for a period of up to four hours to accommodate overflow parking for school or community events. The school or organization holding the event must request permission from the Mahwah Police Department 48 hours in advance of the event.

No person shall stop or stand a vehicle between the hours specified in Schedule III on any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule III of Chapter 7A.

No person shall park a vehicle for longer than the time limits shown in Schedule IV at any time between the hours listed in Schedule IV on any day (except Sundays and public holidays) upon any streets or parts of streets described in Schedule IV of Chapter 7A.

Vehicles with a registered gross vehicle weight exceeding five tons, 10,000 pounds including buses used or designated for public conveyance of any nature, shall not be parked between the hours specified in Schedule VIB on any streets, roadways or highways within the Township.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police, or in his absence the ranking police officer, is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.
c. 
The effectiveness of this section is contingent on signs being erected as required by law.

a. 
Designation of Snow Emergency No-Parking Areas.
1. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on either side of any of the streets or parts thereof described in Schedule V of Chapter 7A.
2. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Removal of Vehicles. Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.
c. 
Effectiveness of Subsection. The effectiveness of this subsection is contingent on signs being erected as required by law.

Vehicles over four tons gross weight are hereby excluded from the street or parts of streets described in Schedule VI and VI A except for the pick up and delivery of materials or passengers on such streets. Vehicles over six tons gross weight are hereby excluded from the street or parts of streets as described in Schedule VI D except for the pick up and delivery of materials or passengers on such streets. b. 
Violations. Violation of the provisions of Subsection 7-4.1 shall be subject to imposition of penalties as provided in § 1-5 of the Code of the Township of Mahwah.

All vehicles with the exception of bona fide emergency vehicles responding to an emergency and public utility and Township vehicles performing public utility and/or maintenance functions are hereby excluded from the streets or parts of streets described in Schedule VI, Subsection C of Chapter 7A.
b. 
Violations. Violation of the provisions of Subsection 7-4.2 shall be subject to imposition of penalties as provided in § 1-5 of the Code of the Township of Mahwah.

Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

a. 
In accordance with the provisions of N.J.S.A. 40:48-2.46, 39:4-197 and 39:4-197.5, no person shall stand or park any vehicle on private property open to the public in any area or parking space which has been designated as a parking area or space for "Parking for Handicapped Persons Only" unless the vehicle has a special vehicle identification certificate, license plate, identification card or marker issued by the NJ Motor Vehicle Commission attached to or displayed on the vehicle.
b. 
Parking for "Handicapped Persons Only" signs as required by statute shall be posted at the parking area or spaces designated under this section.
c. 
Any person parking or standing a motor vehicle in a place restricted under this Township Code Subsection 7-13.3 without the required special vehicle identification shall be liable for a fine of $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.

In accordance with the provisions of N.J.S.A. 39:5A-1, 39:4-202, 39:4-183.27, and 39:4-198 the following off-street parking yards as shown in Schedule XXD of Chapter 7A, are designated as handicapped parking areas. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

The owners of the premises referred to in Subsections 7-13.3 and 7-13.4 shall provide and install signs and pavement markings for each parking space reserved for use by handicapped persons, which signing and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.

The following shall apply to Chapter 7, Subsections 7-13.1 through 7-13.4. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of violating a provision of this section, or any amendment thereto, shall be liable to a penalty of not more than $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days community service on such terms and in such form as the Court shall deem appropriate, or any combination thereof. In addition to any other remedies, any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance, and detrimental to the health, safety and welfare of the residents of the Township of Mahwah and any peace officer may provide for the removal of such vehicle and the owner shall pay the reasonable cost of the removal and storage which may result from such removal before regaining possession of the vehicle.

Traffic control signals shall be installed and operated at the intersection of those streets described in Schedule XXI of Chapter 7A.
The traffic signal installation shall be in accordance with the provisions of an act concerning motor vehicles and traffic regulations, Subtitle 1 of Title 39 of the New Jersey Revised Statutes, and shall conform to the design and shall be maintained in operation as authorized by the Department of Transportation of the State of New Jersey.

No-passing zones are hereby established and maintained along those streets or parts of streets described in Schedule XXII of Chapter 7A, as authorized by the New Jersey Department of Transportation in accordance with the sketch dated and numbered as indicated.

The Township Council hereby authorizes the Mayor, if he shall find that a safety problem exists for ingress and egress to any public or private school or for the provision of recreational facilities for children attending such school, or both, due to a lack of a suitable area surrounding the school, to close by regulation any portion of any street within the block upon which such school is located to the use of through traffic during such time as he shall determine, not to exceed one hour between 7:30 a.m. and 10:00 a.m., two hours between 11:00 a.m. and 2:00 p.m. and one hour between 2:30 p.m. and 4:30 p.m., on any days on which such school is in session and to permit the use of the portion of the street, during the above hours, for ingress and egress to such school, and for the use by the pupils of such school for recreational purposes, under proper supervision and to provide adequate police facilities for such supervision and for the control of traffic upon such portion of the street, and shall, under this subsection, provide for the posting of proper warning signs in the street, indicating that the street is so closed and the purpose therefor, during the time when the same is so closed and shall provide penalties for the violation of the terms of this section or of any regulation promulgated hereunder.

No such regulation adopted pursuant to N.J.R.S. 40:67-16.8 shall become effective unless and until it shall have been approved by the Director of the Division of Motor Vehicles in the Department of Law and Public Safety.

The Township Council hereby authorizes the Mayor to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days or during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare. This subsection and regulations promulgated hereunder shall provide for the posting of proper warning signs of such closing in any street or portion thereof during the time the same is closed in pursuance thereof and shall provide penalties for the violation of this section or any regulation promulgated hereunder.

The Condominium Associations of Society Hill at Kilmer Woods I, Society Hill at Kilmer Woods II, and Society Hill at Kilmer Woods III have filed written consents with the Township of Mahwah that the provisions of Subtitle One, Title 39 of the Revised Statutes of New Jersey be made applicable to the semi-public roads, streets, driveways and parking lots of their respective properties located in the Township of Mahwah, County of Bergen and the following regulations shall be enforceable.
b. 
Parking Areas. All vehicles must park only in designated areas and between the lines provided.
c. 
Handicapped Parking. All stalls shall be 12 feet wide as shown on the approved site plans and signed with R7-8 (Reserved Parking sign and penalty plate), in the designated parking areas for persons who have been issued the Handicapped Parking permits by the Division of Motor Vehicles.
d. 
Through Streets. The following streets or parts of streets are hereby designated as through streets. Stop signs shall be installed the near right side of each street intersecting the through street.

h.

Signs. All signs, posts, bolts, or other necessary materials shall be installed and paid for by the applicants. Work shall be checked by the Police Department to insure installations meet State and Federal Specifications, and all signing shall conform to the current Manual on Uniform Traffic Control Devices.

Penalties. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than $500 or imprisonment for a term not exceeding 15 days or both.

The Condominium Association of Ridge Gardens has filed a written consent with the Township of Mahwah so that the provisions of Subtitle One, Title 39 of the Revised Statutes of New Jersey be made applicable to the semi-public roads, streets, driveways and parking lots of the condominium property located in the Township of Mahwah, County of Bergen and as such, the following regulations shall be enforceable.
b. 
Parking Areas. All vehicles must park only in designated areas and between the lines provided.
c. 
Handicapped Parking. All stalls shall be 12 feet wide as shown on the approved site plan and signed with R7-8 (Reserved Parking sign and penalty plate), in the designated parking areas for persons who have been issued the Handicapped Parking Permits by the Division of Motor Vehicles.

The Birchwood Hills Condominium Association has filed a written consent with the Township of Mahwah that the provisions of Subtitle One of Title 39 of the Revised Statutes of New Jersey be made applicable to the semi-public roads, streets, driveways and parking lots at The Birchwood Hills Condominiums located in the Township of Mahwah, County of Bergen.
The New Jersey Department of Transportation, by letter dated May 21, 1996 recommended approval of the establishment of such regulations.
The provisions of Subtitle One of Title 39 are applicable at The Birchwood Hills Condominium.
b.

Restricted Parking. No vehicles shall park in any parking spaces located on property designated as 92, 94 and 98 Ramapo Valley Road, except for vehicles whose operators are residents, employees or guests of residents, of 92, 94 and 98 Ramapo Valley Road.

All trucks with a gross vehicle weight exceeding four tons or more shall not be permitted to have their engines running while the vehicle is unattended, or shall such vehicles be permitted to have their engines running for more than 15 minutes while the vehicles are stationary.

Any person who is convicted of a violation of Subsection 7-18.1 or any supplement thereto, unless another penalty is expressly provided by New Jersey Statute shall be liable to a penalty of not more than $500 per violation.

The Township of Mahwah does hereby adopt the current Manual on Uniform Traffic Control Devices, hereafter known as the M.U.T.C.D., and further adopts any subsequent supplements or amendments to the extent that it controls and regulates construction, maintenance operations or utility work conducted on the streets and highways of the Township of Mahwah. Any person, contractor, utility, or other entity who fails to comply with the provisions of this M.U.T.C.D. while performing such work is in violation of this section.

a. 
Pre-Construction Meetings. It shall be the responsibility of the person, contractor, or public utility wishing to conduct work on, under or above the roadway to contact the Traffic Bureau of the Mahwah Police Department in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor, or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Traffic Bureau of the Mahwah Police Department is in violation of this section.
b. 
Hazardous Conditions. The person, contractor, or utility shall provide the Traffic Bureau with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contacts cannot be reached, or if the emergency contact does not respond to the call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor, or utility responsible for such condition.
c. 
Hours. There shall be no construction, maintenance operations or utility work under, on or above any roadway before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work before 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Traffic Bureau of the Mahwah Police Department. If it is determined by the officer in charge of the Traffic Bureau of the Mahwah Police Department that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. on any roadway would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.
d. 
Road Closings and Detours. Road closings and/or traffic detours shall not be permitted unless approved by the Traffic Bureau of the Mahwah Police Department.
e. 
Traffic Directors. Traffic directors shall be posted at all construction or maintenance sites when determined by the Traffic Bureau of the Mahwah Police Department that same is necessary to provide for the safety and expeditious movement of traffic.
f. 
Stop Work. The Traffic Bureau of the Mahwah Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.
g. 
Site Preparation. It is to be expressly understood that no materials, vehicles, or equipment are to be placed in the roadway or sidewalk area until all construction signs, lights, devices, and pavement markings are installed in compliance with the provisions of the M.U.T.C.D.
h. 
Emergency Construction. In the case of emergency repair work where construction, maintenance operations or emergency utility work must be performed that will obstruct, interfere with, or detour traffic on any roadway in the Township, the person, contractor, or utility performing such operation shall notify the Mahwah Police Department of such emergency operation. The person, contractor, or utility shall disclose the nature of the emergency, location and hours of operation.
All emergency construction and maintenance operations shall be performed with full regard to traffic safety and conducted in such a manner as to keep traffic interference to an absolute minimum. During such emergency repair work the person, contractor, or utility shall comply with the provisions of the M.U.T.C.D. while performing such emergency repair work.

Any person, contractor, or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County Jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County Jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
