For the purposes of this chapter, the Township's recreational facilities shall include the following as well as the grounds surrounding the same, the structures and buildings thereon and the areas adjacent thereto set aside for parking of vehicles and bicycles:
a. 
Commodore Perry Complex.
b. 
Winter's Park and Pond Complex, commuter parking lots excluded.
c. 
Airmount Complex, including pond.
d. 
Riverside Park Complex.
e. 
Fardale Complex.
f. 
Stag Hill Complex.
g. 
Continental Soldier Park.
h. 
Airmont Park.
i. 
Ridge Road Park.
j. 
Mary Patrick Park.
k. 
Any school facility designated the responsibility of and sponsorship of the Recreation Commission.
l. 
Any other Township-owned or leased property so designated.
m. 
Any future properties so designated as a recreational facility.

The Township recreational facilities shall open at 7:00 a.m. prevailing time, and shall close one-half hour after sunset. The time of sunset shall be as set forth by the U.S. National Weather Service. The closing time shall not apply to persons who are specifically engaged in a permitted activity or sport approved by the Township or where the facility is lighted by the Township. Then the recreational facility shall close 15 minutes after the lights are extinguished.
The Township Council can grant exceptions for a municipal event or for those events for which a permit application has been submitted in its discretion, pursuant to resolution adopted by the Township Council.

a. 
The use of the Township's pool, owing to the limited capacity, is hereby restricted to residents of the Township, members and passholders, and their guests. Notwithstanding this restriction, nonresidents who are participating or attending an activity sponsored or approved by the Township or the Township's Recreation Committee may use the Township's pool.
b. 
In scheduling use of the Township's athletic fields, owing to their limited number, the Township Recreation Committee shall give preference to Township residents.
c. 
The use of the Township's tennis courts and pickleball courts are open to all that follow the rules and regulations set forth. Due to limited capacity, commercial use of the Township's tennis and pickleball courts by tennis and pickleball professionals for private lessons is prohibited, except for instruction sponsored or approved by the Township or the Township's Recreation Committee.
d. 
Due to limited courts and capacity, court time is limited to a period of one (1) hour when the courts are at capacity with every court being in use. Once a court has been relinquished, the relinquishing player(s) may subsequently use a court once all waiting player(s) have obtained a court and a court is available.
e. 
Tennis/Pickleball players must wear non-marking footwear. Pets, skateboards, bicycles, rollerblades/skates, use of non-plastic bottles, and littering are prohibited in all court areas.
f. 
The use of the Township's parks and playgrounds are open to the public and may be used by residents and nonresidents alike.
g. 
Notwithstanding Subsection 9-1.3b, the use of Township's parks and/or playgrounds by any group authorized by, or scheduled by, the Township of Mahwah shall have priority over any other group seeking to use the Township's parks and/or playgrounds.
h. 
Dogs or other domestic animals subject to the provisions of Subsection 9-1.4 are permitted in any area except tennis and pickleball courts, but must be leashed and not left unattended at any time. Dog waste must be picked up and disposed of in a sanitary manner.

a. 
Required.
1. 
A written permit is required for all groups of 25 or more persons using any portion of the facilities listed in Subsection 9-1.1 of the Township Code.
2. 
Activities sponsored by the Township of Mahwah Recreation Department or any other Department of the Township of Mahwah are exempt from the permit requirement.
3. 
All organized sports activities of any size must have a permit for use of Township facilities.
b. 
Application, Payment of Fees, Display of Permit.
1. 
Applications for permits shall be made in writing at least 30 days prior to the usage dates requested on a prescribed form submitted to the Office of Administration. Complete applications shall be forwarded to the Township Recreation Director for review. Complete applications will be issued or denied in writing by the Recreation Director within 14 days of submission.
2. 
For good cause shown, and if a facility is available, the Recreation Director may accept and process an application less than 30 days prior to the date requested.
3. 
Payment of the required fees set under Subsection 9-1.3.1f shall be paid prior to issuance of any permit.
4. 
The written permit shall be available for review while the facility is being used and shall be exhibited upon request by an official representative of the Township.
5. 
Permits are not transferable.
c. 
Permit Categories.
1. 
The allocation of facility permits will be determined by the Recreation Director in accordance with the following priority criteria. Permits are issued in priority order by category. Category 1 user/event has priority over Category 2 and so forth.
2. 
The permit categories are:
Category I. Programs or events sanctioned or sponsored by the Township of Mahwah.
Category II. Programs or events sponsored by recognized Township of Mahwah Youth Sports organizations.
Category III. Programs or events officially sponsored or sanctioned by the Mahwah Board of Education.
Category IV. Township Non-Profit Organizations.
Non-profit organizations, entities, individuals or groups for the purpose of providing programs or events primarily to Township residents, must show proof of non-profit certification. Organization address of record is a Township address. Team rosters must show 75% or higher Township residents for athletic events and at least 75% Township residents as participants for other events.
Category V. Non-Township Non-Profit Organizations.
Non-profit organizations, entities, individuals or groups for the purpose of providing programs or events must show proof of non-profit certification. Groups have fewer than 75% Township residents on the team roster, for athletic events and fewer than 75% Township residents as participants for all other events.
Category VI. Independent Organizations.
Organizations, entities, individuals or groups for the purpose of providing programs or events who do not operate as a commercial enterprise or business and cannot provide verifiable proof of operating on a non-profit basis as defined herein.
Category VII. Commercial.
Organizations, entities, individuals or groups for the purpose of providing programs or events that are operated as a for-profit commercial enterprise.
3. 
Non-profit organizations are those organizations with evidence of Federal 501(c) filing and state non-profit status.
d. 
No equipment belonging to the Township of Mahwah or the educational facility with rights to the facility being utilized shall be moved without permission. There shall be no alteration of any property.
e. 
Use of field house and concession buildings will not be permitted, other than access to bathroom facilities. It will be the responsibility of the person granted the permit to inspect the bathroom facilities for damage prior to the use. If damage is found, it is to be reported immediately to the Director. Any damage to the Township facilities found after the use by the permittee will be the responsibility of the organization which obtained the permit.
f. 
Permit fees are established as follows:
1. 
Categories I, II and III are permitted without charge.
2. 
Permit for use of a portion of the recreational facility other than limited use athletic fields shall be:
(a) 
Category IV: $25 per hour/three-hour block minimum.
(b) 
Categories V and VI: $50 per hour/three-hour block minimum.
(c) 
Category VII: $100 per hour/three-hour block minimum.
3. 
Permits for use of limited-use athletic field facilities:
(a) 
Category IV: $25 per hour/three-hour block minimum.
(b) 
Categories V and VI:
Field use
$50 per hour/three-hour block minimum
Field use w/lights
$100 per hour/three-hour block minimum
(c) 
Category VII:
Field use
$100 per hour/three-hour block minimum
Field use 2/lights
$150 per hour/three-hour block minimum
g. 
All applicants for groups of more than 50 persons shall provide the Township prior to issuance of the permit, with a certificate of general liability insurance approved by the Township Risk Manager in the minimum amounts of $1,000,000 per occurrence, $2,000,000 aggregate general liability and $10,000/person medical expense.
h. 
In the event a field is requested by another municipality for a municipal-sponsored athletic program, whether it be for practice or games, such use shall be permitted and the fee waived. The municipality requesting such use shall provide evidence of sufficient insurance coverage. The municipality shall also be responsible for the costs associated with special police/crossing marshals, or standby ambulance coverage, if required. Cleanup costs associated with the use of fields will be the responsibility of the municipality which has obtained the permit. Costs associated with personnel to operate field lighting will be the responsibility of the municipality obtaining the permit.
i. 
If the provisions of Special Event Permits under the Township Code § 4-4 are applicable, a Special Event Permit shall be required in addition to the Facilities Permit required under this section.
j. 
Penalties for violation of this subsection shall be as set forth in Subsection 9-1.12 of the Township Code.

a. 
No person in a public park or in a public recreation area or Green Acres or open space area shall:
1. 
Mark, deface, disfigure, injure, tamper with or displace or remove any buildings, fences, bridges, tables, goals, benches, fireplaces, railing, paving or paving materials, water lines or other public utilities or parts or appurtenances thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes, posts, or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
2. 
Fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition.
3. 
Dig or remove any soil, clay, rock, sand, stones, trees, shrubs or plants or other wood or materials, or make any excavation by tool, equipment, blasting or other means without written consent of the Municipality.
4. 
Construct or erect any building or structure of whatever kind, whether permanent or temporary, or run or string any public service utility into, upon, or across such lands, without written consent of the municipality. This provision is not intended to address the placement of materials on utility poles located within the Township's recreational facilities, which activity is governed by Chapter 15 of the Mahwah Revised General Ordinances.
5. 
Damage, cut, carve, transplant or remove any tree or plant or injure the bark, or pick flowers or seed of any tree or plant, dig in or otherwise disturb grass areas without the written consent of the Municipality, or in any other way injure the natural beauty or usefulness of any area.
6. 
Climb any tree, stand or sit upon monuments, vases, planters, fountains, railings, fences or upon any other property not designated or customarily used for such purposes.
7. 
Tie or hitch an animal to any tree or plant.
8. 
Hunt, molest, harm, frighten, kill, trap, pursue, chase, tease, shoot or throw missiles at any animal, wildlife, reptile or bird, or remove or have in possession the young of any wild animal, or the eggs or nest, or young of any reptile or bird.
9. 
Throw, discharge, or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream or other body of water in or adjacent to any park or any tributary stream, storm sewer or drain flowing into such water, any substance, matter or thing, liquid or solid, which will or may result in the pollution of the waters.
10. 
Have brought in or shall dump in, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, or refuse, or other trash. No such refuse or trash shall be placed in any waters in or contiguous to any park, or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where these are provided; where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere.
11. 
Operate any motorized vehicle on any area except the designated park roads or parking areas, or such areas as may on occasion specifically be designated as temporary parking areas by the Township or Police Department.
12. 
Park a motorized vehicle in other than an established or designated parking area, or be in accordance with posted directions or the instruction of any attendant.
13. 
Leave a motorized vehicle or trailer standing or parked at night in established parking areas or elsewhere in the park.
14. 
Leave a bicycle against trees, or in any place or position where other persons may trip over or be injured by them,
15. 
Bring into or operate any boat, raft, or other water craft, whether motor powered or not, upon any waters, except at places designated for boating by the Municipality. Such activity shall be in accordance with applicable regulations as are now or hereafter be adopted.
16. 
Navigate, direct or handle any boat in such a manner as to unjustifiably or unnecessarily annoy or frighten or endanger any person or wildlife.
17. 
Launch, dock, or operate any boat between the closing hour of the park at night and the opening hour of the park the following morning, or be on, remain on or in, any boat during the closed hours of the park.
18. 
Swim in any waters except in waters designated by the Municipality for that use and under such regulations and restrictions as have or may be prescribed.
19. 
Carry or possess firearms of any description, or air rifles, spring guns, bows and arrows, slings or any other weapons potentially inimical to wildlife and dangerous to human safety, or any instrument that can be loaded with and fire blank cartridges, or any kind of trapping device. Shooting into park areas from beyond park boundaries is forbidden,
20. 
Grill, barbecue, or maintain an open flame.
21. 
Violate the regulation that use of tables and benches follows the generally accepted rule of "first come, first served," except by authorized permit issued by the Municipality.
22. 
Use any portion of the picnic area for the purpose of holding picnics to the exclusion of other persons, except by authorized permit issued by the Municipality.
23. 
Leave a picnic area before all trash is placed in the disposal receptacles where provided. If no such trash receptacles are available, then trash shall be carried away from the park area by the picnicker to be properly disposed of elsewhere.
24. 
Set up tents, shacks, or any other temporary shelter for the purpose of overnight camping, leave in a park after closing hours any movable structure or special vehicle to be used or that could be used for such purpose, such as house-trailer, camp-trailer, camp-wagon, or the like except in those areas designated for those purposes.
25. 
Take part in or abet the playing of any games involving thrown or otherwise propelled objects such as balls, stones, arrow, javelins, horseshoes, or model airplanes except in those areas set apart for such forms of recreation. The playing of team sports such as football, baseball, lacrosse, basketball, tennis, pickleball, and soccer is prohibited except on the fields and courts or designated areas. Roller skating shall be confined to designated areas.
26. 
No horses or hoofed animals are permitted to enter into or upon a park at any time.
27. 
Possess alcoholic beverages or illegal drugs, or consume or drink same at any time or be under the influence of intoxicating liquor or drugs in a park.
28. 
Possess or explode, discharge or burn any firecrackers, torpedo rockets, or other fireworks, firecrackers, or explosives of inflammable material, or discharge or throw them in any such areas from lands or highways adjacent thereto. However, the Municipality may conduct public firework exhibitions or issue written permits for such exhibitions.
29. 
Dogs or domestic animals, excluding service animals, are prohibited from entering upon any artificial or synthetic turf fields or fenced-in playground areas.
30. 
Solicit alms or contributions for any purpose, whether public or private.
31. 
Build or attempt to build a fire. Drop, throw or otherwise scatter lighted matches, burning cigarettes or cigars, or other flammable material within any park or on any highways, roads, or streets abutting or contiguous thereto.
32. 
Gamble, or participate in or abet any game of chance, except in such areas and under such regulations as permitted by the Municipality and upon its written consent.
33. 
Go onto the ice or ice skate. Any skating shall be done at the individual's own risk.
34. 
Offer for sale any article or thing, or station or place any stand, cart, or vehicle for the transportation, sale or display of any such article or thing without written consent of the Municipality.
35. 
Paste, glue, tack or otherwise post any sign, placard, advertisement or inscription whatsoever, or erect a sign on any public lands, highways, or roads adjacent to a park.
36. 
No loud music, except for music relating to Township sponsored events.
37. 
Enter upon or use the Recreational Facility grounds or buildings or to park any vehicle thereon except during the hours of operation as outlined at Subsection 9-1.2.
38. 
During such time that a concession stand as licensed by the Township is open for business, no person shall engage in hawking, peddling or vending of any food, beverages, confections of any nature or description in Continental Soldiers Park and/or Commodore Perry Field.

In the event of any emergency or necessity or for any other purpose, the Township Recreation Committee, the Chief of Police (or his duly authorized representative) or the Township Council (or its duly authorized representative) may modify for limited periods the hours and dates or use as hereinabove provided by the issuance of a special regulation, which shall be published and posted upon the grounds of the recreational facility so affected.

The cost of group tags for one season or part thereof shall be as follows:
a. 
For Little League organizations, civic organizations, or recreational teams sponsored by the Township: $1 per organization.
b. 
For organized leagues with rosters of at least 75% Mahwah residents: $100 per team.
c. 
For organized leagues with rosters of less than 75% Mahwah residents: $200 per team.
d. 
For nonleague teams: $500 per team.

The purpose of this section is to establish rules and regulations for the use of the Township of Mahwah's skate park facilities:
a. 
All users must obtain a nontransferable badge from the Township of Mahwah Recreation Department at which time the user will receive a copy of the rules and regulations. The badge will be forfeited for violating the rules and regulations. The user must have the badge in possession at all times when using the facility and shall display same at the request of a representative of the Township of Mahwah Police Department and/or Township of Mahwah Recreation Department. To obtain a badge a user who is under 18 years of age must have written permission from the user's legal guardian.
b. 
The skate park will not be supervised. Use of the skate park will be at the user's own risk. The facilities shall only be used for skateboards with a maximum length of 34 inches and in-line skaters. Bicycles, roller skates, scooters, go-peds, and any other kind of motorized vehicles are not permitted at any time.
c. 
All users must skate responsibly. All users must wear full safety equipment which shall include helmet, elbow and knee pads, gloves and wrist protection. In addition, users must have proper shoes satisfactory for participating in the activity. All equipment is to be worn in accordance with the manufacturer's specifications.
d. 
Use of the skate park and facility shall only be permitted in accordance with the dates and hours posted. The facility shall be closed during periods when the equipment or services are wet and/or icy. The facility shall also be closed to allow for reasonable inspection and maintenance.
e. 
Organized events involving participation of seven or more people shall require the prior approval of the Township Recreation Department.
f. 
No food, drinks, drugs, smoking, amplified music or pets shall be permitted.
g. 
The participants are required to inspect the skating surfaces before use and to remove any trash debris or objects. Participants are required to report any damage to the skate park to the Township of Mahwah Recreation Department or Township of Mahwah Public Works Department.
h. 
Signs shall be posted at the skate park setting forth the requirement to wear safety equipment and advising users of the rules and regulations for use of the skate park.
i. 
This subsection shall be enforced by representatives of the Township of Mahwah Police Department and the Township of Mahwah Recreation Department.

b. 
Definitions.
1. 
Family membership shall mean head of household, spouse and children, unmarried legal dependents living at home.
2. 
Individual membership shall mean individual two years of age or older.
3. 
Senior citizens shall mean individuals 65 years of age or older.
4. 
Adult shall mean individual 18 years of age or older.
5. 
Municipal employee shall mean any employee employed on a full-time basis in any capacity. This definition shall exclude all elected or appointed persons or volunteers in any organization and all part-time or contract employees.
6. 
Nonmember resident walk-ins are any members of the public who reside in the Township of Mahwah, who have not joined as a member of the municipal swimming pool.
7. 
Guests are any member of the public who seek to use the municipal pool with a member of the pool. Guests are limited to 12 guests per membership per pool season.
c. 
General Conditions to Membership.
1. 
Children under the age of two years will be admitted FREE. They must be accompanied by an adult member.
2. 
Children under the age of 12 years must be accompanied by an adult member.
3. 
Membership is limited to 1,400 people over the age of two on a first come, first served basis.
4. 
Residency in the Township is required unless waived by the Township Council on or after June 1 of each year.

The Township Council reserves the right to set, by resolution, additional fees for teaching lessons at the Township's recreational facilities.

It shall be unlawful for any resident or nonresident to park a motor vehicle in any recreational area enumerated in Subsection 9-1.1 unless said parking shall be incidental to the use of the Township's recreational facilities. In addition, a nonresident must first meet the nonresident qualifications previously set forth in this chapter.

For each and every violation of any of the provisions of this chapter, the person violating the same or permitting the violation thereof shall be subject to a fine not exceeding $100 or to imprisonment for 30 days, or both.
