Reference is made to Chapter 9 of the Sanitary Code of the State of New Jersey (Entitled "Public Recreational Bathing") (hereinafter referred to as "Chapter 9 of the Code"). The definitions contained in Chapter 9 of the Code are adopted for the purposes of this chapter.

No person shall locate and construct, alter or operate a Public or Recreational Bathing Place until licenses therefor shall have been issued by the Board of Health.

a. 
For the filing of an application and plans to locate and construct a public recreational bathing facility: two hundred fifty ($250.00) dollars.
b. 
For the filing of an application and plans to alter an existing public recreational bathing facility: one hundred ($100.00) dollars.
c. 
For issuance of a permit to construct or alter a public recreational bathing facility: fifty ($50.00) dollars.
d. 
For the issuance or renewal of a license to operate a public recreational bathing facility including but not limited to individual swimming pools, spas, hot tubs and bathing beaches: two hundred ($200.00) dollars each.
e. 
In the event that a public recreational bathing facility is closed in accordance with N.J.A.C. 8:26, Chapter 9: one hundred ($100) dollars to re-open the pool during regular working hours of the Township Municipal Building and two hundred fifty ($250.00) dollars during evening, weekend, and holiday hours.
f. 
For the pre-operational inspection of a youth or adult camp: two hundred ($200.00) dollars.

Licenses issued for the operation of a Public or Recreational Bathing Place shall expire annually on December 31 of each year and application for renewal thereof shall be submitted together with the required fee prior to January 1 of each year.

Licenses required by this Chapter may be denied or suspended by this Board of Health for failure to comply with this Chapter or Chapter 9 of the Code.
This Board of Health shall afford the person whose license to locate and construct, alter or operate has been denied or suspended an opportunity to be heard in public hearing; and following this to be informed of the Board's decision as provided by Chapter 9 of the Code, Section 8:26-2.3.

a. 
Any person or persons, firm or corporation violating any of the provisions of this Chapter or Chapter 9 of the Code, shall, upon conviction thereof, pay a penalty of not less than five ($5.00) dollars but not more than five hundred ($500.00) dollars for each violation.
b. 
Each day a particular violation continues shall constitute a separate offense.

All ordinances, codes or parts of same inconsistent with any of the provisions of this Chapter and Chapter 9 of the Code are hereby repealed to the extent of such inconsistency.

In the event that any section, sentence or clause of this Chapter or Chapter 9 of the Code shall be declared unconstitutional by a court of competent jurisdiction such declarations shall not in any manner prejudice the enforcement of the remaining provisions.
