No sandbank, limestone and gravel pits and stone quarries and other excavations shall be permitted in the Town of Lancaster except as set forth in this article.
All sandbanks, limestone and gravel pits and stone quarries and other excavations existing and operating on January 1, 1958 shall be permitted, pursuant to ordinance duly adopted on November 4, 1957.

A. 
All sandbanks, gravel pits and stone quarries, existing or to be created, shall be subject to the requirement of obtaining from the Town of Lancaster, on an annual basis, a special use permit, said permit to expire on January 1 of each year.
B. 
Fee.
(1) 
A special use permit fee shall be imposed on an annual basis for purposes of the Town enforcement of state regulations as follows:
(a) 
A minimum fee of $200 for removal of an amount not exceeding 5,000 cubic yards.
(b) 
Any area, $0.04 per cubic yard to be removed. The fee in no event shall exceed $5,000.
(2) 
The Town Board may waive this fee where excavation is deemed to be for the benefit of the Town.
(3) 
Payment of the fee for permits shall be made at the time of application and thereafter on the first day of January of the calendar year, if said permit is renewed.

All existing ordinances of the Town of Lancaster to the contrary are hereby rescinded and repealed.
This article shall take effect immediately.
