Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in N.J.S.A. 39:1-1 shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the Township.

a. 
The Township may authorize the closing of any street or portion thereof either on its own initiative pursuant to paragraph a1 of this section, or in response to a request submitted pursuant to paragraph a2 of this section.
1. 
The Mayor or, in his/her absence, disability or inability to act, the Chief of Police and, in the event of his/her absence, disability or inability to act, then the ranking officer of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
2. 
Requests for the closing of any Township street or portion thereof for a neighborhood event, such as a block party, must be submitted to the Township Administration Office no less than 14 calendar days prior to such event, and may only be submitted for events occurring on the weekend and/or a national holiday recognized by the United States federal government. All untimely requests will be denied. All requests submitted timely under this subparagraph shall be approved or denied by the Chief of Police (and in the event of his/her absence, disability or inability to act, then the ranking officer of the Police Department), who shall be authorized to provide by regulation for the closing of any Township street or portion thereof to motor vehicle traffic during the requested timeframe, and who may deny any such request whenever he/she finds that such closure would unduly inconvenience vehicular traffic, or endanger the public safety, health or welfare in any way.
b. 
Any regulations promulgated in accordance with paragraph a of this section, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any person who violates this section or any regulation promulgated thereunder shall, upon conviction, be subject to the general penalty provisions contained in Chapter 1, Section 1-5 of the Township Code.
d. 
Any regulation adopted that mandates the closing of any street or portion thereof for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute or a sub-chapter herein (94-5), every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not less than $25 nor more than $100 or imprisonment for a term not exceeding 10 days, or both.

Editor's Note: Ordinance No. 90-12 established handicapped fines at $100 for the first offense. Subsequent offenses shall be $100 plus 90 days community service. Ordinance No. 83-42 established the fine for violation of §§ 7-13 Parking Prohibited at All Times and 7-14 Overnight Parking shall be $10.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

As provided in the Adopting Ordinance for the Revision of the Township of Springfield Ordinances, all former traffic ordinances of the Township are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute, or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

As to all streets, roads and highways within the Township, whenever snow or other precipitation has fallen and the accumulation is such that it covers any such street, road or highway, an emergency shall thereby exist, and no vehicle shall be parked on or so as to cover such street, road, or highway, or any portion thereof. Such restriction shall remain in effect after the snow has ceased until any such street, road or highway has been plowed sufficiently, or in any other manner cleared, so that such parking will not interfere with the normal flow of traffic or with the removal of snow. An unoccupied vehicle parked or standing in violation hereof shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and in addition to all other fines and penalties, such vehicle shall be subject to towing, the cost of which to be paid for by the owner or operator of the vehicle before such vehicle shall be released, after reasonable attempts have been made to contact the owner of such vehicle so it may voluntarily be moved.

a. 
Location. Parking lot area located off of North Trivett, Center Street and Mountain Avenue.
b. 
Designation of Spots. There shall be 14 designated parking spaces in the Springfield Free Public Library Patron/Springfield Township First Aid Squad Parking Lot, of which eight spots shall be reserved for patrons of the Springfield Free Public Library and the remaining six spots to members of the Springfield Township First Aid Squad.
c. 
Parking Limitations.

Violations and Penalties: Any person parking a vehicle in violation of Subsection 7-7.4c shall be fined and vehicle may be towed in accordance to §(s) 7-3 and 7-4 of the Township Code.

Parking in any of the 14 angled spaces that are along the north side of South Trivett Avenue and in any of the 15 angled spaces that are along the south side of North Trivett Avenue are expressly restricted for persons tending to business in the Springfield Town Hall and/or the Springfield Annex Buildings. The hours of this restriction shall be from 8:00 a.m. through 8:00 p.m., Monday through Friday.
b. 
Signage stating "Parking for Business at Town Hall/Annex Only 8:00 a.m. - 8:00 p.m. Mon - Fri", shall be placed at both ends and in the center of these parking areas on both North and South Trivett Avenues.
c. 
Violations and Penalties: Any vehicle parked in violation of this Subsection 7-7.5 may be towed in accordance with § 7-3 of the Revised General Ordinances of the Township of Springfield, and any person parking a vehicle in violation of this Subsection 7-7.5 shall be fined in accordance with § 7-4 of the Revised General Ordinances of the Township of Springfield.

a. 
Parking along the northern side of North Trivett Avenue beginning from the southwest corner of Center Street to a point 87 feet westerly along the northern curbline shall be expressly restricted for persons tending to business at the Springfield Annex Building. There shall be a limit of fifteen-minute parking, and the hours of this restriction shall be from 8:00 a.m. through 4:00 p.m., Monday through Friday.
b. 
Signage stating "Parking for Business at Annex Building Only, Limit 15 Minutes, 8:00 a.m. - 4:00 p.m. Mon - Fri" shall be placed at the center and western end of this area.
c. 
Violations and penalties. Any vehicle parked in violation of this Subsection 7-7.6 may be towed in accordance with § 7-3 of the Revised General Ordinances of the Township of Springfield, and any person parking a vehicle in violation of this Subsection 7-7.6 shall be fined in accordance with § 7-4 of the Revised General Ordinances of the Township of Springfield.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Township of Springfield, in the County of Union, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department at least 96 hours in advance in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway except in an emergency and with the concurrence of the Police Department in the Township before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m. There shall be no construction, maintenance operation utility work at the below listed times on the below listed streets within the Township except in an emergency and with the concurrence of the Police Department between 6:30 a.m. and 9:30 a.m. and between 3:30 p.m. and 6:30 p.m. on Mountain Avenue, Springfield Avenue, U.S. Route 22, Morris Avenue (N.J. Routes 124 and 22) including the one way section, So. Springfield Avenue, Shunpike Road, Milltown Road, Meisel Avenue, Hillside Avenue, Maple Avenue and Summit Road and between 10:00 p.m. and 8:00 a.m. at any location unless the then current Township Noise Control Ordinance is complied with.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

All ordinance or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commissioner of Transportation 20 days after passage and publication as prescribed by law.

a. 
An application for a permit providing parking at any permit parking space within the Township may be filed with the Police Records Bureau by presentation of proof of a currently valid New Jersey driver's license; the payment of a fee as set forth hereafter; a completed application; and a motor vehicle registration certificate and current automobile liability insurance card for the vehicle to which the permit is to be affixed except as set forth in paragraph h below. The fee shall be due in full for the entire permit period, notwithstanding that a portion of the period may have expired; fees shall not be prorated. Permits may be obtained for a full year, beginning on the first of February, or for a three month period beginning on the first of February, May, August or November. A senior permit will be available to any person 62 years of age or older at the time of application, upon appropriate proof.
b. 
There shall be a maximum of 76 total permits issued at any given time.

c. 
In the event that an application for a permit is denied by the Police Special Services/Traffic Unit, the denial shall be communicated in writing to the applicant who shall have the right, within 10 days of the receipt of the denial, to appeal the denial to the Township Committee (unless the denial is due to the maximum number of permits having previously been issued, which denial is not appealable). Notice of the appeal shall be made in writing, and addressed to the Township Clerk. Within 30 days after receipt of the notice of appeal, the Township Committee shall schedule a hearing for action on the appeal. Failure of the Township Committee to act within 30 days of the notice of appeal shall be deemed to be affirmation of the denial and the applicant may thereafter proceed with any available legal means of appeal.
d. 
A permit shall be affixed to the vehicle as follows:
1. 
On vehicles with a rear window, on the outside surface at the lower left so that it can be read by a person standing outside the vehicle.
2. 
On vehicles without a rear window, on the outside surface of the rearmost left-hand side window at the lower right-hand corner so that it can be read by a person standing outside the vehicle.
3. 
All permits must be removed from the vehicle upon expiration. Only current valid permits may be affixed to a vehicle.
e. 
A valid permit is: a parking permit issued in accordance with this section; affixed by its own self-adhesive on the vehicle to which it is originally issued, as indicated on the permit application; clearly legible and unobscured. The permit application shall be retained in the course of business as a record of the Township. No person shall transfer, loan or sell a parking permit and no person shall knowingly permit the transfer, loaning or sale of a parking permit.
f. 
Penalty. Any person violating any of the provisions of this section shall be subject to a fine of not less than $10 nor more than $50, or, in default of the payment of the fine, imprisonment for a period not exceeding 10 days, unless otherwise stated.
g.

The Township may offer business parking permits to business located within the Township in order to provide adequate parking for its employees. These permits shall be issued based upon the availability of parking spaces and the needs of the employer. These permits shall be made available at the annual fee of $300 and may be transferable amongst employees as set forth in the policy established by the Township Administrator, in cooperation with the Springfield Police Department.

In addition to all other fines and penalties, a vehicle parked in violation of this section shall be subject to towing, the cost of which to be paid for by the owner or operator of the vehicle before such vehicles shall be released.

A permit providing for on-street resident parking as required by Subsection 7-12A-1 may be obtained by application to the Township Clerk by any resident of the streets restricted thereby. There shall be no fee for such application, but such application must be accompanied by proof of residence. Property owner permits shall be issued for a period of no greater than three years, tenant permits shall be issued for a period of no greater than one year, and all permits shall expire on December 31 of the appropriate year or upon termination of residence.
b. 
Residents shall be entitled to receive one resident permit for each vehicle that is principally garaged or parked at the residence address, which fact shall be certified to by the resident at the time of application. In addition, each residence shall be eligible to receive two visitor permits which shall be used only by those persons actually visiting a resident during such visit. Such visitor permits shall expire on the same date as the expiration date for the resident permits.
c. 
Resident permits shall be affixed to the vehicle to which they are issued so as to be clearly visible and unobscured, at the location hereafter set forth. Visitor permits shall be displayed in such location, but need not be affixed to the visitor vehicle. On vehicles with a rear window, the permit shall be placed on the inside surface at the lower left corner of the rear window. On vehicles without a rear window, the permit shall be placed on the inside surface of the rearmost left hand side window at the lower right hand corner of same.
d. 
All persons parking pursuant to permit shall comply with all applicable parking and traffic rules and regulations.
e. 
It shall be a violation of this section to photocopy, otherwise reproduce, or in any way create a facsimile or counterfeit permit. It shall be a violation hereof to display or otherwise use a permit known to be counterfeit. It shall be a violation hereof to furnish false information or fraudulent documents in connection with an application for a permit. It shall be a violation to use or allow anyone to use a valid permit in violation of this section. Any person violating the provisions hereof shall be subject to a fine not to exceed $300 and/or imprisonment for not more than 10 days.

A nonresident owner of a property that does not have its own on-site parking and is adjacent to a regulated street may obtain a nonresident permit by making application to the Township Clerk. There shall be no fee for such application, but such application must be accompanied by proof of ownership of property. Nonresident property owner's permits shall be issued for a period of no greater than three years, tenants permits shall be issued for a period no greater than one year, and all permits shall expire on December 31 of the appropriate year or upon termination of occupancy or ownership of the property.

The following Traffic Control Signal shall be installed and operated pursuant to the designated plan. Such traffic control signal installations shall be in accordance with the provisions of the Manual of Uniform Traffic Control Devices and Title 39 of the Revised Statutes of the State of New Jersey; shall conform to the design; and shall be maintained in operation, as authorized by the New Jersey Department of Transportation.

Any property owner within the Township shall have the right to petition the Township Committee to consider the installation of traffic calming measures on any municipal road provided the conditions precedent set forth in Subsection 7-34.2 are satisfied.

Greater than 50% of the property owners along the municipal road where the traffic calming measures are proposed to be installed will be required to sign a petition requesting the Township Committee to install calming measures as a condition precedent to the Township Committee's consideration of their installation.

If the condition precedent set forth in Subsection 7-34.2 has been satisfied, the Township Committee shall direct the Traffic Bureau with the Springfield Township Division of Police to conduct a traffic study as to the viability and/or need for traffic calming measures at the location(s) identified in the petition. As part of such traffic study, the following criteria shall be established and/or confirmed by the Traffic Bureau in order for such location(s) to be considered by the Township Committee for traffic calming measures installation:
a. 
The municipal road must have an average traffic volume of less than 3,000 vehicles per day (holidays and weekends excluded); and
b. 
The municipal road must have a posted speed limit of 30 miles per hour or less; and
c. 
The municipal road is at least 1,000 lineal feet in length.
A formal written recommendation by the Traffic Bureau shall promptly be issued to the Township Committee.

If the Township Committee approves the installation of such speed humps/speed cushions, (i) the specific device to be installed, (speed humps or speed cushions), (ii) the precise location where such speed humps/speed cushions are to be installed, shall be left to the Township Committee, with the recommendation of the Traffic Bureau; and (iii) the specific device shall not be removed for a minimum of five years after installation.

In accordance with N.J.S.A. 39:4-197, N.J.S.A. 39:5A-1 and N.J.S.A. 40:48-2.46, the following parking spaces within the Township are hereby designated as restricted parking spaces, which shall be used only by persons with physical handicaps who have been issued special vehicle identification cards, windshield stickers or other identification, pursuant to N.J.S.A. 39:4-205 and 4-206 or other applicable statute, when operating or using a motor vehicle on which is displayed such card, sticker or other identification.

f. 
Additional Parking Spaces. In addition to the spaces enumerated herein, these regulations, requirements and penalties shall apply to any and all additional handicapped parking spaces within the Township of Springfield established pursuant to State, County or local law, including any requirements established under the Land Use Ordinance of the Township of Springfield and any actions by the Springfield Planning Board and Springfield Board of Adjustment pursuant thereto.
g. 
Signs, Pavement Markings, Installation and Maintenance. The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual of Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.
h. 
Penalty. A person convicted of a violation of this section shall be subject to the fines and other penalties as set forth in N.J.S.A. 39:4-197, as amended.

In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate, or park a vehicle in violation of the regulations indicated.
a. 
Municipal Employee Parking Lot No. 4.
1. 
Location: At the northwest corner of Brook Street and Caldwell Place.
(a) 
On all days and times when the Township offices are open for business, parking shall be limited to employees of the Township of Springfield, who shall have been issued a parking sticker or pass, pursuant to procedures established by the Township Committee, or to such other persons as approved by the Township Committee or their designate. At all other times, parking shall be limited to such employees, as well as members of the public transacting business at the Township offices. Any vehicle parked in violation of this subsection may, in addition to any fines or other penalties, be towed away at the sole cost and expense of the vehicle owner.
(b) 
All vehicles shall be parked head in only.
b. 
Municipal Property Adjacent to the Springfield Library.
1. 
Location. Parking spaces upon the property of the Springfield Free Public Library, along the westerly side of the building, adjacent to Center Street.
2. 
Limitation. On all days and times when the Springfield Free Public Library is open for business, parking shall be limited to employees of the Springfield Library or to such other persons as approved by the Springfield Library Board, who shall have been issued a parking sticker or pass, pursuant to procedures established by the Board, in conjunction with the Township of Springfield and the Springfield Police Department. Any vehicle parked in violation of this subsection may, in addition to any applicable fines or other penalties, be subject to being towed at the sole cost and expense of the vehicle owner.
c. 
All Municipal and Board of Education Property.
1. 
Location. All property owned or leased and maintained by the Township of Springfield or by the Township of Springfield Board of Education.
2. 
Limitation. No vehicle shall be left idling while unattended, and no vehicle, under any circumstances, shall be kept idling for a period of longer than two minutes.

In accordance with the provisions of N.J.S.A. 40:48-2.46, on the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the types of regulations indicated. For a violation of the provisions of this § 7-37 or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both; except that for a violation of N.J.S.A. 39:4-80 et seq., N.J.S.A. 39:4-105 et seq., N.J.S.A. 39:4-123 et seq. or N.J.S.A. 39:4-140 et seq., the offender shall be liable to a penalty of not less than $50 or more than $200 or imprisonment for a term not exceeding 15 days, or both.

Municipal Parking Lot No. 1 is hereby designated as the municipally owned property located between the easterly side of Center Street, the northerly side of Hannah Street and the westerly side of Mountain Avenue, being known and designated on the Tax Map as Block 707, Lot 1. Parking spaces therein shall be numbered sequentially beginning with 001 and running through 199, as needed.
b. 
Municipal Parking Lot No. 2 (commonly known as Duffy's Corner) is hereby designated as the municipally owned property located on the north side of Morris Avenue, opposite Caldwell Place, being known and designated on the Tax Map as Block 206, Lot 6. Parking spaces therein shall be numbered sequentially beginning with 201 and running through 299, as needed.[1]

a. 
General regulations.
1. 
No person shall park any vehicle longer than three successive hours and they shall pay hourly parking fees during the time parked, except as otherwise set forth herein between the hours of 6:00 a.m. and 6:00 p.m., except Sundays or legal holidays, except for vehicles displaying a valid parking permit issued by the Township.
2. 
No parking is permitted between the hours of 2:00 a.m. and 5:00 a.m., except for vehicles displaying a valid parking permit issued by the Township.
3. 
Parking during the hours of 6:00 p.m. to 2:00 a.m. and 5:00 a.m. to 6:00 a.m. shall be free and shall not be time limited.
4. 
Commercial activities. It shall be a violation of this section for any person to cause or permit the transaction of any commercial business within or upon any municipal parking lot. Any person violating the provisions of this paragraph shall be subject to a fine of not less than $25 nor more than $100.
5. 
In municipal parking lots, a vehicle shall be parked head-in only. In the event the vehicle is not parked head-in, it shall be deemed to be illegally parked and subject to the penalties provided in this chapter.
6. 
No person shall park a vehicle in any municipal parking lot whenever snow or other precipitation has fallen and the accumulation is such that it covers any such parking lot, to such a degree that plowing or other removal of such snow will reasonably be necessary. Such restriction shall remain in effect after the snow has ceased until such parking lot has been plowed, or in any other manner cleared, so that parking will not interfere with the normal flow of traffic within such lot, or with the removal of snow.
7. 
Senior citizen parking. Residents of Springfield Township, 62 years of age and up, may obtain, monthly, a one-day parking pass to park in Lot 2 (Duffy's Corner). The parking pass is valid only for the date issued, allocated to one per household and must be obtained 72 hours prior to the requested date of use. Parking shall be allocated to permit-only parking spaces. Residents seeking such a pass must present a valid driver's license and registration to the Township Clerk's office.

b. 
Lot 1 regulations. There shall be 31 parking spaces located along the easterly side of the lot, adjoining Mountain Avenue, designated as "permit only" parking, numbered P108 through P138. There shall be seven parking spaces located along the northerly edge of the lot, designated as "permit only" parking, numbered P139 through P145. All remaining spaces shall be hourly parking.

c. 
Lot 2 regulations. There shall be 45 spaces designated as Permit Only parking, which shall be numbered P219 through P263. All remaining spaces shall be hourly parking.
d. 
No person shall park any vehicle in a Permit Only designated parking space without displaying a valid permit pursuant to § 7-12 hereof.[1]

a. 
All persons parking in an on-street hourly parking zone or in a municipal parking lot hourly parking space during designated hours shall pay a fee of $1 for each hour of parking.
b. 
It shall be unlawful and a violation of the provisions of this section for a vehicle to remain in an hourly parking space beyond the time period paid for or beyond any stated time limit even if paid for.
c. 
It shall be unlawful to place into or cause to be placed into any parking fee collection device any slug, device, or metallic substitute for a coin, any counterfeit or fake dollar bill, or in any other manner to fraudulently pay required fees.
d. 
It shall be unlawful for any person to tamper with, open, willfully break or destroy any parking fee collection device.
e. 
Penalty. Any person violating any of the provisions of this section shall be subject to a fine of not less than $10 nor more than $50 or, in default of the payment of the fine, imprisonment for a period not exceeding 10 days, unless otherwise stated.

Parking Spaces Designated for Park and Ride.
1. 
There shall be designated in Municipal Pool Parking Lot parking spaces for Springfield Park and Ride patrons only. Such spaces shall be designated by signs indicating restricted parking as noted herein or such other municipal parking lot as designated by resolution of the Township Committee. The number of such spaces shall be designated from time to time by resolution of the Township Committee. From 6:00 a.m. to 9:30 a.m., Monday through Friday, except legal holidays, only persons actually using the Park and Ride at the time their vehicle is parked may use such designated spaces. In addition to penalties otherwise designated for violation of this section, any vehicle not parked in accordance herewith may be towed away at the sole cost and expense of the vehicle owner.
The Township Committee may by resolution, designate additional parking spots in other municipal parking lots as Park and Ride designated spaces, which shall be subject to all restrictions as noted herein.
b. 
Special Use Parking Permit and Park and Ride Bus Permit.
1. 
Any Springfield resident receiving a Park and Ride identification permit shall concurrently receive a Special Use Parking Permit for same period of time, at no extra fee. Special Use Parking Permits issued to nonresidents shall be issued at the fee set forth herein.
2. 
Special Use Permits shall be available to any person having been granted a Springfield Park and Ride identification. Such Special Use Permit will be subject to all appropriate regulations in this section, but will only entitle the vehicle to park within those parking spaces in Municipal Parking Lot No. 2 (Duffy's Corner) so designated as Park and Ride spots. A regular Township parking permit will not entitle a vehicle to park within the Park and Ride designated spots.

a. 
The Township hereby determines to install and utilize a traffic control signal monitoring system (the "System") at the intersections of (i) Morris Avenue and Maple Avenue and (ii) Morris Avenue and Springfield Avenue as approved by the Commissioner of Transportation pursuant to P.L. 2007, Chapter 348 (the "Act").
b. 
The System to be installed shall be approved by the Township Committee by Resolution.
c. 
The Township shall have the authority to enter into a contract, following a lawful procurement process, for the installation of the System. Any contract that shall contain provisions contrary to the Act shall not be deemed invalid but rather reformed to conform to the Act.
d. 
The signs notifying drivers that the System is being utilized shall be approved by the Township Engineer, and shall be placed on each street converging into the affected intersection as required by the Act.
e. 
The Township Engineer shall inspect and certify the System at least once every six months from the date of its installation.

The Division of Police of the Township shall review the recorded images produced by the System, to determine whether sufficient evidence exists demonstrating that a traffic control signal violation has occurred and shall issue summons when appropriate in accordance with the Rules of the Court.

a. 
Except as otherwise provided in this section, the recorded images produced by the System shall be available for the exclusive use of the Division of Police for the purpose of discharging his or her duties under the Act.
b. 
Any recorded image or information produced in connection with the System shall not be deemed a public record in N.J.S.A. 47:1A-1 et seq., or common law. The recorded images shall not be: (i) discoverable as a public record by any person, entity, or governmental agency, except upon a subpoena issued by a grand jury or a court order in a criminal matter, or (ii) offered as evidence in any civil or administrative proceeding not directly related to a traffic control signal violation.
c. 
Any recorded image or information collected in connection with a traffic control signal violation shall not be retained after 60 business days following the collection of any fine or penalty.
d. 
If a summons is not issued within 40 business days following the traffic control signal violation, all recorded images and any information collected with respect to the traffic control signal violation shall be removed by the Division of Police within two business days.
e. 
The Township shall certify compliance of this section by filing a report with the Commissioner of Transportation in accordance with the Act.

The liability of the owner and operator of a motor vehicle for a traffic control signal violation summons pursuant to the System shall be joint, subject to provisions of the Act.
