As used in this chapter:
ENFORCEMENT OFFICER
Shall mean any officer of the Springfield Township Police Department, Springfield Township Auxiliary Police, Director of Recreation or recreation employee or park staff.
IMPERMISSIBLE CONDUCT
Shall mean behavior that is not permitted at a recreation facility.
IMPERMISSIBLE USES
Shall mean activities prohibited at a recreation facility.
NUDITY
Shall mean a naked or unclothed person.
PARK FACILITIES
Shall mean any Township park or playground.
PUBLIC INDECENCY
Shall mean the deliberate exposure in public or in view of the general public by a person of a portion or portions of his or her body, in circumstances where the exposure is contrary to local moral or other standards of appropriate behavior.
RECREATION FACILITIES
Shall mean all land, improvements and equipment owned by the Township of Springfield used for active and passive recreation activities.
WHEELED MOTORIZED VEHICLE
Shall mean a self-propelled vehicle or machine which rolls on wheels. This definition does not include mowers, trucks, maintenance vehicles owned, leased and operated by the Township.

a. 
Hours of Closing; Special Permits. No person or group of persons shall occupy or use any public park or playground or any portion thereof for any purpose between the hours of (i) 7:00 p.m. to sunrise from November 1 through March 31 and (ii) 9:00 p.m. to sunrise from April 1 through October 31, except upon prior application for a special permit, upon good cause shown therefor, directly to the Township Committee. The granting of any such permit shall be at the discretion of the Township Committee. The parks, operating hours are not applicable to Township's lighted baseball fields. Use of the Township's tennis courts and/or basketball courts shall not exceed a two hour limit.

No person shall:
a. 
Take part in or abet the playing of any games involving throwing or otherwise propelling objects such as balls, stones, arrows, javelins, horseshoes, quoits or model airplanes before 9:00 a.m.
b. 
For any leagues or organizations, take part in or abet the playing of any games involving thrown or otherwise propelled objects such as balls, stones, arrows, javelins, horseshoes, quoits or model airplanes without a permit issued by the Recreation Department.
c. 
Bring a dog, cat or other pet, whether leashed or running free, onto any public park or playground or any portion thereof at any time.
d. 
Play or practice golfing.
e. 
Engage in fighting or violent behavior.
f. 
Spit, urinate or defecate except in designated facilities.
g. 
Litter.
h. 
Exhibit public nudity or public indecency.
i. 
Use threatening or obscene language.
j. 
Alter or adjust any fence, play surface, or piece of gym equipment (including but not limited to playground equipment or basketball rims) without the prior written approval of the Township of Springfield.
k. 
Smoke.
l. 
Possess a firearm or knife.
m. 
Build fires.
n. 
Possess any type of glass container.
o. 
Use any type of artificial illumination for any Township field or recreation facility without the prior approval of the Township of Springfield.
p. 
Operate any type of motorized vehicle except on driveways or parking lots without the prior approval of the Township of Springfield.
q. 
For-profit entities are strictly prohibited from using the Township's fields, basketball courts and tennis courts.

Exceptions will be considered in Subsection 27-2.1 only for Subsections a, b, o and p may be requested in advance, in writing, upon good cause shown, to the Director of Recreation. A permit to do any act shall authorize the same only insofar as it may be performed in strict accordance with the terms and conditions thereof. Any violation by its holder or the holder's agents or employees of any terms or conditions thereof shall constitute grounds for its revocation by the Director of Recreation or his/her authorized representative, whose action therein shall be final. The holder of such permit, together with the holder's agents and employees, who violates such terms and conditions, shall be jointly and severally liable to the Township for all damages and loss sustained by the Township. Neither the recovery or collection of such damage shall in any manner relieve such holder or person from liability to punishment for any violation of any provision of this section.

Permits for events as stated in Subsection 27-2.1a and b shall be obtained by application to the Department of Recreation in accordance with the following procedures:
a. 
A person seeking issuance of a permit hereunder shall file an application with the Department of Recreation and provide the following information:
1. 
The name and address of the applicant.
2. 
The name and address of the person, persons, corporation or association sponsoring that activity, if any.
3. 
The day and hours for which the permit is desired.
4. 
The park or portion thereof for which the permit is desired.
5. 
Any other information which the Department of Recreation shall find reasonably necessary for a fair determination as to whether a permit should be issued.
b. 
Standards of Review for Permitting Application by the Department of Recreation:
1. 
That the proposed activity or use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park.
2. 
That the proposed activities and use will not unreasonably interfere or detract from the promotion of public health, wealth or safety in recreation.
3. 
That the proposed activity or uses that are reasonably anticipated will not include violence, crime or disorderly conduct.
4. 
That the proposed activity will not entail an extraordinary burdensome expense or policing by the Township.
5. 
That the facilities desired have not been reserved for another use on that date and hour requested in the application.
c. 
An application shall be made to the Recreation Department during normal business hours, three days in advance of the proposed use. Permits shall be issued on a first-come basis.
d. 
Any person, league or organization which has obtained a valid permit shall have paramount rights to use the park or portion thereof for the activity, day and hour for which the permit is issued, and all activity which interferes with the operation of the valid permit shall yield to the permit holder.

The Department of Recreation shall apprise an applicant, in writing, of its reason for refusing a permit, and any aggrieved person or organization shall have a right to appeal to the Township Administrator by service of a written notice thereof on the Director of Recreation and the Township Clerk within five days of the refusal. The decision of the Township Administrator shall be final.

If an enforcement officer determines that a person has violated Subsection 27-2.1 above, he or she may:
a. 
First Offense: Cause the offender to be removed from all recreation facilities for the balance of the day on which the violation occurred and for two additional days immediately following the date of the first offense.
b. 
Second Offense: Cause the offender to be removed from all recreation facilities for the balance of the day on which the violation occurred and for five additional days immediately following the date of the second offense.
c. 
Third Offense: Cause the offender to be removed from all recreation facilities for the balance of the day on which the violation occurred and issue to such offender a Notice of Trespass prohibiting the offender from entering the recreation facility for the balance of the calendar year in which the third offense occurred.

In addition to the offender being removed from the recreation facility as described in Subsection 27-2.6, any person violating any of the provisions of Subsection 27-2.1 shall, upon conviction thereof, be liable to the monetary penalties provided for in § 1-5 of the Township Code.

There is hereby created and established by the Township a municipal public utility to be known as and constituted as the "swimming pool utility" of the Township, hereinafter referred to as "utility," pursuant to N.J.S.A. 40A and all other applicable Statutes of New Jersey.

As used in this section:
AGE
Shall mean the individual's age on December 1 of the year of each season.
AREA
Shall mean the total area belonging to the swimming pool utility.
POOL APRON AREA
Shall mean the eight-foot area of concrete immediately surrounding the pool.
POOL AREA
Shall mean the entire fenced area surrounding the pool.
POOL PATIO
Shall mean the concrete area in addition to the open area surrounding the pool.

Membership shall be limited to a maximum of 5,800 permanent Township residents and shall not be transferable.

The types of membership shall be:
a. 
Family Membership. Family membership shall include husband, wife and unmarried children up to and including 22 years old residing within the same household.
b. 
Joint Membership. A joint membership shall be available to any two persons residing in the same household.
c. 
Associated Individual Membership. An associated individual membership shall be available to an individual over 21 years of age not a member of the immediate family yet permanently residing within a household holding a family membership.
d. 
Individual Membership. An individual membership shall be available to any permanent resident of the Township not a member of a family group entitled to a family membership between the ages of 13 and 61.
e. 
Senior Citizen Membership. A senior citizen (individual) membership shall be available to all persons 62 years of age or older. A senior citizen (couple) membership shall be available to any married couple in which one spouse is 62 years of age or older.
f. 
Nanny/Caregiver Membership. A nanny/caregiver membership shall be available. This membership shall be available only in conjunction with any regular paid membership, and shall apply to a single person, 16 years of age or older, employed full-time as a child, elderly or health-care worker, upon proof of employment, as well as verification of employment signed by both the employer and employee. Such caregiver shall only be permitted access to the pool grounds while accompanying the person receiving such care.
g. 
Out-of-Town Family Membership. Membership shall be opened to a maximum of 250 out-of-town families. Preference shall be given to those out-of-town families sponsored by current Township residents. Out-of-town family membership shall include husband, wife and unmarried children up to and including 22 years old residing within the same household.
h. 
Any membership indicated in the prior subsections above shall be available for the period of August 1 through the end of the pool season upon payment of 1/2 of the membership fee.

All memberships shall be granted subject to the rules and regulations of the pool as established by the Township Committee by ordinance or resolution. Failure to abide by these rules and regulations may result in revocation or suspension of membership.

a. 
Guest tickets shall be valid or usable from and including the day of opening of the swim pool facility to and including the day of closing of the swim pool facility.
b. 
Members shall be fully responsible for the conduct and behavior of their guests and shall be subject to all of the sanctions and penalties contained herein for their guests' violations of this section as though they themselves had committed such violations.
c. 
A guest ticket shall entitle a person not a resident of Springfield to the issuance of a daily identification badge, good for one day only and only if accompanied by a pool member.
d. 
Failure of a member to return a guest badge at the end of the day of use shall result in an automatic two week suspension of all membership privileges.
e. 
Memberships may be granted to families who are unable to pay the fees set forth in Subsection 27-6.7c, provided that there is no waiting list for membership and upon investigation and recommendation of the Municipal Welfare Department and approval of the Township Committee. The applicant for membership shall execute a properly acknowledged agreement to reimburse the municipality.
f. 
Membership shall automatically terminate when the member shall no longer be a permanent Township resident.
g. 
No person shall obtain membership through fraudulent or false statements or representations. Any violation hereof shall result in the membership of such person, as well as the membership of all other members of such person's family, being revoked for the remainder of the season without refund.
h. 
The maximum allowable number of guests in any one day shall be 100.
i. 
Nothing contained herein shall prohibit the entry into the pool of any person pursuant to any program sponsored or approved by the Township, pursuant to rules and regulations in connection therewith.
j. 
Springfield residents may purchase and use guest tickets, without being accompanied by a pool member, at the weekend and holiday fee set forth herein, for use only on weekends and holidays prior to the pool opening on a daily basis.
k. 
Children 12 years of age and under must be accompanied by an adult pool member.

a. 
Collection. The Township shall charge and collect for the use and operation of the utility, and all such fees, rents and other charges shall be placed in a separate account of the Township.
b. 
Use of Receipts.
1. 
All fees, rents and other annual charges received from the operation of the utility shall be applied solely to the annual payment of principal and interest on any obligations issued for the swimming pool, and then applied towards the operation, maintenance and improvement of the utility.
2. 
The provisions of this subsection shall not, however, supersede the specific dedication of receipts from the utility as provided in any law which authorizes the establishment or creation of such utility.
3. 
The anticipated revenues from the operation of the utility and the appropriations to be made therefor shall be set forth in a separate section of the annual municipal budget.
c. 
Fees for Municipal Pool.

Party/meeting rental of the Springfield Community Pool multipurpose room (full room) (up to four hours) on weekdays/weekends during the non-pool operational season: $400 for Springfield residents and businesses, $500 for non-Springfield residents and businesses.
Party/meeting rental of the Springfield Community Pool multipurpose room (half room) (up to four hours) on weekdays/weekends during the non-pool operational season: $200 for Springfield residents and businesses, $250 for non-Springfield residents and businesses.
Additional hours (nonrefundable) during the non-pool operational season: $60 per hour.
13. 
Private party rental of the Springfield Community Pool picnic grove (four hours) on nights and weekends during the pool operational season, no access to indoor multipurpose room or kitchen, available to pool members only: $90 reservation fee, plus $6 per non-pool-member guest for access to pool grounds for the duration of the party.
14. 
Fee exceptions. The Township Committee may, at its sole discretion, set aside a certain date or dates each year, which date(s) shall be specified annually by resolution of the Township Committee and published by the Township, on which date(s) all pool fees shall be waived for Township of Springfield residents.

a. 
All members shall be issued identification badges, which must be shown for admission and be pinned to their exterior garments at all times within the area.
b. 
Identification Badges Are Not Transferable. No member shall deliver to or authorize any other person to wear or use that member's badge for admission to the pool or pool area. Any member who so transfers, delivers or authorizes another to wear or use that person's badge as aforesaid, as well as any member who is the recipient or user of a transferred badge as aforesaid, shall each pay a penalty of $25 to the swimming pool utility of the Township, and if such penalty is not paid, the member who does not pay same shall have all membership privileges revoked for the remainder of the season without refund. This revocation shall continue in force to succeeding seasons until the penalty is paid.
c. 
No Person Shall Deface Any Badge. Any person who defaces a badge shall lose swimming privileges for seven days and shall pay a penalty of $1 to the swimming pool utility of the Township. Second offense shall result in revocation of membership privileges for the remainder of the season without refund.
d. 
No person who is not a member shall enter the pool or pool area:
1. 
Using as identification for such entry a badge which was not issued to such person; or
2. 
Without a temporary badge, or in lieu thereof, written permission of the Director of Recreation of the Township. Violation of this subsection shall subject such person to arrest and, upon conviction of the offense, to payment of a fine not exceeding $50.
e. 
Lost identification badges must be reported to the pool manager immediately. Temporary replacement identification badges shall be issued, valid for only one week, upon payment of a fee of $2. At the expiration of the week, a new season identification badge will be issued.
f. 
All persons purchasing a Student five-Trip Pass will be issued a special identification badge, which must be shown for admission and punched. The badge shall be surrendered upon the fifth use thereof.

The municipal pool shall be open during the following hours:
a. 
Monday through Friday: 12:00 noon to 8:00 p.m.
b. 
Saturdays, Sundays and holidays: 11:00 a.m. to 8:00 p.m., except Memorial Day weekend and each weekend thereafter until the pool opens on a daily basis: 12:00 noon to 5:00 p.m.
c. 
Monday through Friday mornings as per schedule, there will be beginner's swimming lessons for all children who permanently reside in the Township.
d. 
After 6:00 p.m., use of the pool will be restricted to members 15 years or older and to members under 15 years only if accompanied by their parents.
e. 
One dance may be held during the Labor Day weekend for swim pool members only, on Friday night, Saturday night or the night preceding Labor Day, to proceed past sundown. Notwithstanding any contrary provision contained in this section, alcoholic beverages may be served and consumed during the aforesaid dance.
f. 
Five additional evening activities may be held at the swim pool which may continue until the hour of 12:30 a.m. upon the recommendation of the Recreation Director or the Recreation Committee, but subject to the approval of the Township Committee, during any swim pool season. Attendance at such activities need not be limited to swim pool members.
g. 
All pool opening and closing times are subject to adjustment upon recommendation of the pool management and approval by the Township Committee.

Use of the swimming facilities shall be subject to such rules and regulations as may be promulgated by the Township Committee by ordinance or resolution, which shall be posted at all times upon the bulletin board at the swimming facilities. A copy thereof shall be filed with the Township Clerk for public inspection. The following rules shall be in effect:
a. 
Pool Rules.
1. 
All bathers, including babies, shall wear bathing suits in both the swimming and wading pools. Babies shall wear rubber pants in wading pools.
2. 
Women, girls, men and boys with long hair shall wear bathing caps at all times in the pool.
3. 
All persons using the pool must shower prior to entering the pool, using warm soap and water.
4. 
Any persons having a communicable disease, open blisters or cuts, sore or inflamed eyes, ears, nose or mouth infections, excessive sunburn or any type of skin disease shall be excluded from the pool area.
5. 
No inflatable water paraphernalia shall be allowed within the pool area.
6. 
Diving shall be permitted in designated areas only.
7. 
No one shall be allowed in water unless a lifeguard is present.
8. 
No swimming shall be permitted in diving areas, except as permitted by the pool manager.
b. 
General Rules of Conduct.
1. 
Dress in and out of the pool shall be consistent with standards of good taste. Brief-type swimming attire is not considered suitable.
2. 
Street shoes shall not be permitted within the pool apron area.
3. 
Street clothing shall be left in designated areas.
4. 
Women and girls of any age shall not comb their hair or wear pin curlers within the pool apron area.
5. 
Dressing and undressing shall be done in locker rooms only. Dressing or undressing shall not be permitted in parking areas.
6. 
All food shall be served and consumed within designated areas only. Under no circumstance shall food or beverages be brought into pool area.
7. 
Children under 13 years of age shall not be permitted unless accompanied by a responsible adult member. Children members between the ages of 10 and 13 shall be admitted without an adult only upon successful completion of a swimming proficiency test.
8. 
Destruction of property shall result in suspension or revocation of membership.
9. 
The pool management shall not be responsible for valuables brought into the area.
10. 
All litter, paper or debris shall be placed in designated trash receptacles.
11. 
All vehicles shall park front-end in only.
12. 
All vehicles shall park only in lanes and areas designated or as requested by the pool employees.
13. 
All vehicles must move in the pool area at a speed not to exceed 10 miles per hour.
14. 
All vehicles must move in the direction and the lanes which are established.
15. 
All sections of the municipal parking lot regulations of § 7-36 and supplements thereto must be strictly obeyed.
c. 
Prohibited Acts.
1. 
There shall be no glass or glass containers or metal containers within the pool area.
2. 
There shall be no alcoholic beverages within the pool area.
3. 
There shall be no pets or animals within the pool area.
4. 
Bicycles, baby carriages and strollers shall not be allowed unless parked in designated areas.
5. 
There shall be no wrestling, running, ball playing or other similar activity within the pool apron and parking area.
6. 
No radios shall be operated in the parking area.
7. 
There shall be no blowing of horns or loitering in the parking area.
8. 
There shall be no smoking on pool grounds, except for in a designated area, which shall be outside the pool fencing.
9. 
There shall be no food consumption in cars.
10. 
There shall be no spitting, unnecessary expectoration, spouting of water.
11. 
There shall be no roughness, rowdiness, profanity or other conduct affecting the safety and comfort of others.

a. 
The regulations shall be posted at the pool and strictly enforced.
b. 
The Township Committee, pool manager or the assistant manager may close or limit the swimming facilities to all or anyone whenever in their judgment such action is deemed necessary or desirable for the protection of health or safety of such persons entitled to use the facilities.
c. 
Members of the Police Department, pool manager and all other lifeguards when on duty at the swimming facilities shall have authority to prohibit any action or conduct which they may consider to be dangerous, improper or immoral or any act or actions in violation of the rules and regulations hereinbefore provided and shall have the power of expulsion or suspension of the privileges otherwise granted to the holder of the membership badge.

The Swimming Pool Code (1955) of New Jersey approved by the State Department of Health shall be hereby incorporated in this section and shall become a part thereof.

The provisions of this section shall not relieve any person of the duty to observe other provisions as set forth in any New Jersey Statute or regulation of the Township or as hereinafter provided.

Any person violating any of the provisions of this section shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, § 1-5.

Every person who uses any municipal tennis court in the Township shall wear in full view a badge issued by the Township or shall be a guest of a badge owner.

Fees payable for tennis court badges shall be as set forth below and are subject to change by amendment.
Municipal Tennis Courts:

NOTE: However, notwithstanding anything to the contrary herein, in the event that any individual uses the tennis courts for profit wherein that individual receives moneys, goods or services in return for providing lessons or services which involve the use of the municipal tennis courts, there shall be an additional charge of $50 for each hour of such use.

The Township Committee may from time to time in its discretion, by resolution, establish rules and regulations governing the use and conduct of all recreational and athletic facilities in the Township.

The penalty for failure to comply with this section or any rule or regulation created hereunder may be suspension, termination or denial of any or all permits and privileges hereunder and, in addition, any person violating any of the provisions of this section shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, § 1-5.

There is hereby created and established a municipal day-camp facility to be located at the Springfield Community Pool. The day-camp shall be a part of and operated by the Springfield Municipal Swimming Pool Utility. The Township Committee may promulgate additional rules and regulations concerning same by resolution.

To be eligible to be enrolled in the day camp, a child shall be at least four years of age and not older than 13 years of age on December 1 of the year of the program. All children must be toilet trained to be eligible to attend or to continue attending. Membership in the preteen summer sports camp program shall be limited to pool members who shall be entering grade 6, 7 or 8 in September of the year of the program. There shall be a Counselor in Training (C.I.T.) program available for those children who have or will become 13 years of age during the twelve-month period ending on December one of the year of the program.

The day camp shall operate the following sessions, on specific days and dates as established on a year-to-year basis.

The fee for each child enrolled in the day camp shall be as follows, and is payable in full prior to the first day of the camp season, except for Camp J or K, which are payable no later than the Thursday, preceding the first day of each session. No fees shall be returnable for any reason after the first day of the camp season, or for Camp J or K, that session.

Rental agreement: Individuals and entities seeking to rent the Springfield Community Pool's multipurpose room, picnic area, or the Chisholm Community Center shall execute a rental agreement in a form approved by the Township's Director of Recreation. The rental agreement shall include, and all renters shall be subject to, the following requirements:
a. 
Alcohol consumption.
1. 
The consumption of alcohol in conjunction with the rental of the multipurpose room is permitted subject to the terms of this chapter, New Jersey Law, the Township Code, and the rental agreement. Consumption of alcohol is restricted to beer and wine only, and is permitted inside the pool's multipurpose room and kitchen only. There shall be no alcoholic beverages outside of the aforementioned multipurpose room and kitchen on the pool grounds, which prohibition includes, but is not limited to, the parking lot, sidewalks, picnic area, grass and deck areas, playground, courts, fitness room, locker rooms, and offices.
2. 
The consumption of alcohol in conjunction with the rental of the Springfield Community Pool's picnic area and Chisholm Community Center is prohibited.
b. 
Insurance. The renter shall provide the Township of Springfield with certificates of insurance for all coverages required herein to be in place for the event.
1. 
Renters of multipurpose room, picnic area, or Chisholm Community Center shall secure and maintain general liability insurance ($1,000,000 per occurrence) coverage for the date of the event. For rentals which will not include more than 25 individuals, and will not include the consumption of alcohol, the Township may permit a waiver or reduction in limits of the general liability insurance requirements in this Subsection b1.
2. 
If alcohol will be consumed during rental of the multipurpose room, then the renter shall secure and maintain liquor liability insurance coverage, in addition to general liability coverage for the date of the event, as follows:
(a) 
If the renter is a business which manufactures, distributes, sells, or serves alcoholic beverages, and intends to serve or sell alcoholic beverages at the event, the renter shall secure liquor legal liability insurance or a properly endorsed general liability policy for liquor sale/service with a minimum limit of liability of $2,000,000 per occurrence.
(b) 
If the renter hires a vendor to serve or sell alcoholic beverages, rather than providing the alcohol him/herself, the renter shall secure a liquor legal liability insurance policy or properly endorsed general liability policy for liquor sale/service with a minimum limit of liability of $2,000,000 per occurrence.
(c) 
If the renter is providing alcohol him/herself, and not as set forth in Subsection b2(a) or (b) above, then the renter shall secure a host liquor liability insurance policy with a minimum limit of liability of $2,000,000 per occurrence.
c. 
Security. Security, in the form of a uniformed police officer(s), shall be on duty during the full rental period if deemed necessary by the Chief of Police and the Director of Recreation. The Springfield Township Police Department or an authorized substitute shall provide this security. Security fees will be the responsibility of the renter.
d. 
Indemnification. Renter shall agree to hold harmless and indemnify the Township in connection with rental.
