[1991 Code § 253-1]
The words or phrases listed below, for the purposes of this chapter, except when the context requires a different meaning, shall be defined as follows:
CONSTRUCTION
Shall mean building or installing a new swimming pool or enlarging an existing swimming pool or any of its facilities.
POOL
Shall mean any private swimming pool or more than 100 cubic feet capacity of permanent construction, and all equipment and appurtenances thereto, used by any person for swimming or bathing.
PORTABLE POOL
Shall mean any above-surface-type pool of more than 100 cubic feet capacity, not stationary or fixed and capable of being removed for storage.
WADING POOL
Shall mean a permanently constructed pool not designed or used for swimming, with a maximum area of 100 square feet and a maximum water depth of 12 inches.

Application for a permit to construct, establish or maintain or to alter, remodel or add to a permanent private swimming pool or permanent wading pool shall be made to the Construction Code Official by the owner of the property. The application shall be accompanied by two sets of plot plans showing property lines of the premises, all existing houses and structures thereon and the location and dimensions of the proposed private swimming pool or wading pool and its auxiliary structures and all existing fences or walls and the height thereof, and two sets of plans and specifications for the proposed private swimming pool or wading pool and all auxiliary structures and appurtenances related thereto and the location, height and aperture dimensions of the fence to be erected, together with the self-closing gate and its locking devices. The fees for construction of a private swimming pool or wading pool shall be as established by the Governing Body.

No permit for a private swimming pool or wading pool shall be issued by the Construction Code Official until the plans, specifications and plot plans have been approved by the Engineer, the Health Officer and the Plumbing Inspector of the Township and such approval has been properly certified on the plans.

Unless otherwise provided in the State Uniform Construction Code, the following regulations shall apply.

a. 
A private swimming pool, wading pool or portable pool shall not be constructed, installed or maintained within 15 feet of any side yard or rear yard line, nor shall any such pool be constructed, erected, installed or maintained in the front yard of the property. In the case of any lot less than 50 feet in width, it will be permissible to place a pool within 10 feet of a side or rear property line.
b. 
In the case of a corner lot, a pool shall not be constructed any closer to the side street line than the prevailing setback line on that street or the required setback line for front yards as set forth in the zoning regulations.
c. 
A private swimming pool or wading pool shall not be constructed or installed on any premises unless a residence building is also located on the premises or unless the premises are part of a residence curtilage.
d. 
No private swimming pool or wading pool and its accessory buildings shall cover more than 20% of the rear yard of the lot involved. The rear yard designated is to be as defined in the zoning regulations.

a. 
Permanent Pools.
1. 
A residential swimming pool barrier shall comply with the following:
(a) 
The barrier must be at least four feet high on the outside.
(b) 
The barrier may not have any gaps, openings, indentations, protrusions, or structural components that could allow a young child to crawl under, squeeze through, or climb over the barrier.
(c) 
The barrier must be placed around the perimeter of the pool and must be separate from any fence, wall, or other enclosure surrounding the yard unless the fence, wall, or other enclosure or portion thereof is situated on the perimeter of the pool, is being used as part of the barrier, and meets the barrier requirements of this subsection.
(d) 
The barrier must be placed sufficiently away from the water's edge to prevent a young child or medically frail elderly person who may have managed to penetrate the barrier from immediately falling into the water.
2. 
The structure of an aboveground swimming pool may be used as its barrier or the barrier for such a pool may be mounted on top of its structure; however, such structure or separately mounted barrier must meet all barrier requirements of this section. In addition, any ladder or steps that are the means of access to an aboveground pool must be capable of being secured, locked, or removed to prevent access or must be surrounded by a barrier that meets the requirements of this section.
3. 
Gates that provide access to swimming pools must open outward away from the pool and be self-closing and equipped with a self-latching locking device, the release mechanism of which must be located on the pool side of the gate and so placed that it cannot be reached by a young child over the top or through any opening or gap.
4. 
A wall of a dwelling may serve as part of the barrier if it does not contain any door or window that opens to provide access to the swimming pool.
5. 
A barrier may not be located in a way that allows any permanent structure, equipment, or similar object to be used for climbing the barrier.
b. 
Portable Pools. A portable pool, unless enclosed by a fence of the type and dimensions set forth in paragraph a above, when not in use or unattended shall be either emptied or covered with a suitable, strong protective covering, securely fastened or locked in place.

No artificial lighting shall be maintained or operated in connection with a private swimming pool, wading pool or portable pool in such a manner as to be a nuisance or an annoyance to neighboring properties. No lighting shall shine directly upon any abutting property. No unshielded lights shall be permitted.

Any accessory buildings that are to be constructed must comply with that portion of the Zoning Chapter pertaining to accessory buildings. Locker rooms, bathhouses, cabanas, shower rooms, toilets, runways and all other physical facilities or equipment incident to the operation of any private swimming pool or wading pool shall be kept in a sanitary condition at all times.

All materials used in the construction of private swimming pools or wading pools shall be waterproof and so designed and constructed as to facilitate emptying and cleaning and shall be maintained and operated in such manner as to be clean and sanitary at all times. Inlets of the treated water shall be so located and spaced as to secure satisfactory dispersion of the water throughout the pool and to permit draining, cleaning and disinfecting of the bottom and sides. Sand or earth bottoms shall not be used.

There shall be no physical connection between a potable public or private water supply system and private swimming pools, wading pools or portable pools below the maximum waterline of the pool or to a recirculating or heating system of the pool. The piping system shall be designed to fill the pool and circulate the pool water through filtering equipment. Sampling taps shall be placed conveniently for obtaining samples of the water entering and leaving the pool. Potable water shall feed the pool with a downspout with an air gap not less than six inches from the pool overflow level. Potable water siphons will not be permitted to drain the aforesaid pools. The installation, repair and control of plumbing facilities shall comply with the Plumbing and Sanitary Codes of the Township. All circulating units shall have sufficient capacity to recirculate the entire contents of a pool within 18 hours of less.

a. 
All pools not equipped with facilities for the recirculation and reuse of the pool water shall be subject to closure by order of the Board of Health during any period of emergency water shortage.
b. 
Whenever any pool by reason of mechanical defects or failure to comply with the requirements of this section is a hazard to the health of users thereof, the Health Officer is authorized to summarily close the pool and keep it closed until no further hazard to users of the same exists. The owner of the pool shall have the right of appeal to the Board of Health. An appeal, however, shall not stay the action of the Health Officer.

Chlorine gas bearing compounds in solution shall be required as disinfecting agents for swimming pools, wading pools or portable pools. The use of ozone, ultraviolet light or any other method wherein a residual cannot be determined is prohibited. Not more than 15% of the samples of water taken from any private swimming pool, wading pool or portable pool, when more than 20 samples have been examined, and not more than three samples when less than 20 samples have been examined, shall contain more than 200 bacteria per cubic centimeter or shall show positive test (confirmed) for coliform in any of five ten-cubic-centimeter portions of water at times when the pool is ready for use. For the purpose of this section, any number of samplings or water on a single day shall be considered as one sample. The local Board of Health is hereby authorized to take samples to ensure compliance with these requirements. Free chlorine residuals and pH values shall be maintained within ranges indicated below:

a. 
All private swimming pools, wading pools or portable pools with a water depth of more than one foot hereafter constructed, installed, established or maintained within the Township shall be provided with the necessary equipment to completely pump out or empty the pool or shall be emptied by providing one drainage outlet, which shall be installed at the lowest point of the pool, not in excess of three inches in diameter extending from the pool to either a storm sewer, lawn sprinkling system, adequate dry well or sand filtering pit on the premises on which the private pool, wading pool or portable pool is located.
b. 
The discharge of water from such pools into a storm sewer shall be permitted only where the capacity is adequate as determined by the Township Engineer. No private pool drain, wading pool drain or portable pool drain shall be connected into the sanitary sewer system. Pool water may not be discharged at the curb or upon the surface of any street. The discharge of such waters shall in no case cause or create a nuisance to the abutting property or to the public.

Every private swimming pool, wading pool or portable pool constructed, installed, established or maintained in the Township shall be registered by the owners thereof with the Health Officer on or before March 31 of each year, or if constructed, installed, established or maintained after the registration date, within 10 days after first use or operation of the pool.

It shall be unlawful for any pool to be operated or used between the hours of 11:00 p.m. and 7:00 a.m.

Every private swimming pool, wading pool or portable pool constructed, installed, established or maintained in the Township shall at all times comply with the requirements of the local Board of Health. Any nuisance or hazard to health which may exist or develop in or in consequence of or in connection with any such private swimming pool, wading pool or portable pool shall be forthwith abated and removed by the owner, lessee or occupant of the premises on which the pool is located upon receipt of notice from the Construction Code Official or Health Officer.

a. 
It shall be the duty of the Construction Code Official and Health Officer to enforce the provisions of this chapter.
b. 
The owner or operator of any pool within the Township shall allow the Construction Code Official and the Health Officer or other authorized official access to any private swimming pool or wading pool or portable pool and appurtenances thereto for the purpose of inspection to ascertain compliance with this chapter and all other pertinent Township ordinances, at all reasonable times.
