Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383)[1], the New Jersey Uniform Fire Code shall be locally enforced in the Township of Springfield.

The local enforcing agency shall be the Fire Division of the Township of Springfield, under the supervision and direction of the Chief of Fire.

The local enforcement agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of Springfield, other than owner-occupied one and two family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The local enforcing agency established by subsection 18-1.2 shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The Firefighter/Fire Official shall be designated by the Township Committee from among the Fire Division personnel and shall report to the Chief of Fire.

The Fire Inspector shall be designated by the Fire Chief from among the qualified members of the Fire Department personnel and shall report to the Fire Official. For purposes of this subsection, "qualified members of the Fire Departement" shall only include those members who are certified as a fire inspector under the Uniform Fire Safety Act, and who submit a request to the Fire Chief to be designated for such duties. The Fire Chief may designate a Fire Inspector or Inspectors on an ad hoc or rotating basis, provided that all qualified members of the Fire Department are given an equal opportunity to serve as Fire Inspector

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by any order of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of Union County.

All registration fees required pursuant to the Act and the regulations promulgated thereto shall be collected and accounted for by the Bureau of Fire Safety.

The Uniform Fire Safety Act, Uniform Fire Code and Uniform Construction Code as currently enacted and as from time to time amended, shall be complied with within the Township of Springfield, and shall be enforced by the local enforcement agency as set forth herein.

In addition to the registrations required by the Uniform Fire Code, the following non-life hazard uses shall register with the local enforcement agency established herein. These uses shall be inspected yearly and shall pay an inspection fee as hereinafter set forth, which fee shall be exclusively for non-life hazard uses as provided for in subchapter 2 of the Uniform Fire Code. The enforcement and penalty provisions which govern life hazard uses are hereby incorporated herein and any party failing to obtain any inspection required, failing to furnish requested information, failing to pay inspection fees or failing to comply with any orders issued as a result of such inspection shall be subject to the enforcement and penalty provisions. (Fees are to be charged per occupant, unless otherwise noted.)

The Fire Department of the Township of Springfield may establish Fire Zones or Fire Lanes upon all properties with the approval of the Township Committee by resolution. The number, location, width, length and markings of such Fire Zones or Fire Lanes shall be determined by the Fire Department with the approval of the Township Committee.

The Fire Zones or Fire Lanes shall be established to insure fire equipment and other emergency vehicles unobstructed means of ingress and egress to such properties and the buildings, persons, vehicles, fire hydrants, Fire Department connections and standpipes thereon in case of fire or other emergency.

A description showing each Fire Zone and Fire Lane shall be filed with the Police Department and Municipal Clerk and is hereby incorporated into this section. The Fire Zones or Fire Lanes shall be clearly outlined and marked on the pavement and/or on the adjoining building wall area. Appropriate signs stating "No Parking, Fire Zone" or "No Parking, Fire Lane" shall be installed as directed by the Fire Department.

a. 
Any person, firm or corporation failing to comply with the implementation or maintenance of a Fire Zone or Fire Lane as directed by the Fire Department shall be subject to a fine not to exceed $200, or to imprisonment not to exceed 10 days, or both.
b. 
Any person, firm or corporation that has established a Fire Zone or Fire Lane which has not been approved by the Township Committee by resolution, shall be subject to the penalties set forth in paragraph a.

As used in this section:
PARKING
Shall mean standing or waiting of a vehicle not actually engaged in receiving or discharging passengers or merchandise, unless in obedience to traffic regulations or traffic signs or signals.
STANDING
Shall mean any cessation of movement of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer, or traffic control sign or signal.

It shall be a violation of this section for anyone to park or stand a vehicle in or cause an obstruction to a Fire Zone or Fire Lane.

The owner or tenant of any real property upon which a fire zone or fire lane has been established shall, within 12 hours of the daylight hour after a fall or accumulation of snow, remove such snow from all such Fire Zones or Fire Lanes, and ensure that such Fire Zones and Fire Lanes shall remain clear of snow at all times thereafter.

Any person convicted of a violation of this paragraph shall be liable for a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

The Police Department shall have concurrent jurisdiction with the Fire Department to enforce the provisions of this Article.
