The Borough of Cliffside Park Bureau of Fire Prevention shall, pursuant to N.JA.C. 5:70-1, et seq., be ordained, the municipality's enforcing agency.

The local enforcing agency shall undertake its municipal regulatory and statutory duties within the Building Department with this agency being entitled Bureau of Fire Prevention of the Borough of Cliffside Park.

The members of the Bureau of Fire Prevention shall be directed and/or charged to enforce the Uniform Fire Code in regard to any/all buildings and/or structures erected within the boundaries of the Borough of Cliffside Park, including residential dwelling units situated above commercial establishments.

Pursuant to the New Jersey Administrative Code, the Bureau of Fire Prevention shall not have jurisdiction over:
a. 
1- and 2-family owner occupied dwellings;
b. 
Premises owned and/or operated by the Federal government;
c. 
Premises owned and/or operated by Interstate Agencies;
d. 
Premises owned and/or operated by the State of New Jersey.

The BFP shall be under the direct supervision and control of the Fire Official, who shall report directly to the Borough Administrator.

a. 
As a condition precedent to the appointment of the position of Fire Official, that person shall be certified by the State of New Jersey, Department of Community Affairs, Division of Fire Safety.
b. 
Fire Inspectors shall be certified by the State of New Jersey, Department of Community Affairs, Division of Fire Safety.
c. 
The Borough Attorney shall serve as legal counsel to the BFP.
d. 
The Fire Official or Fire Inspector shall be appointed by the Mayor, subject to consent of the Council and serve until December 31 of each appointed year.
e. 
Removal from Office. Fire Official and/or Fire Inspectors are subject to removal by the Council of the Borough of Cliffside Park for just cause, subject to a disciplinary hearing before the Borough Administrator or his designee.

The BFP shall conduct all necessary and proper inspections as required by the Uniform Fire Code as designated by the Commissioner of the New Jersey Department of Community Affairs.

All designated nonprofit IRS established 501(C)3 corporations including but not limited to churches, fraternal organizations as created pursuant to Title 15A of the New Jersey Non-Profit Act shall not be required to pay the Borough of Cliffside Park any registration or permit fees set forth in this chapter. The fee exemption does not exempt any nonprofit organization from registration, inspections and/or compliance with the Uniform Fire Code or any other fire regulations promulgated by the Department of Community Affairs.

All delineated registration fees noted in this chapter are to be paid no later than April 1 of the current year. Failure to comply with the filing and fee requirements shall result in a one hundred ($100.00) dollar per week late fee charge. The Borough Administrator shall have the right, upon petition from the property owner, to reduce the late fees to no less than twenty-five ($25.00) dollars per week, if in his opinion, the rationale presented by the property owner is bona fide and presented in good faith.

Fire Officials may affix penalties, as permitted by the Uniform Fire Act N.J.A.C. 5:70-2.12 et seq., as may be amended. Any person aggrieved by a penalty and/or summons issued by the Borough of Fire Prevention have the right to appeal the summons directly to the Bergen County Construction Board of Appeals, One Bergen County Plaza, Hackensack, New Jersey 07601.

All residential, commercial and industrial buildings located within the Borough of Cliffside Park are required to have a lock box.
a. 
Said lock box shall contain the keys for the building entrance, common areas, boiler rooms, utility room, sprinkler room and alarm access.
b. 
The following buildings are exempt from the lock box requirement:
1. 
Owner-occupied single-, two- and three-family homes.
c. 
The Fire Officials shall issue penalties for failure to install lock boxes as per the New Jersey Regulations, including but not limited to the Uniform Fire Code N.J.A.C. 5:70-2.12, as may be subsequently amended.

a. 
The use of any barbecue, hibachi, stove or any other type of unit that produces open flames and/or heat, shall be prohibited on or in any building, balcony, roof or building extension, which is more than three (3) stories or thirty (30) feet of height from grade.
b. 
Excluded from this prohibition are electrical units, which are UL approved, with covered cooking areas that will prohibit smoke or odors escaping while the unit is in use.
c. 
This provision, and only this provision, is hereby subordinate to any rules and/or regulations that govern the respective multi-family dwelling (Condominium Association by-laws) affected by the provisions of this Section 15-14, Barbecue.

Any non one-, two- or three-owner occupied residential structures which have installed automatic fire alarm systems or fire suppression systems, shall be held responsible for nuisance alarms, subject to the following:
a. 
Two (2) non-emergency activations within a calendar year;
b. 
A third and subsequent non-emergency activation in the calendar year shall result in a $250.00 penalty for the first offense; $500.00 for the second offense and $1,000.00 for the third and any subsequent occurrences during the calendar year;
c. 
In addition, the property owner shall be subject to any and all relevant provisions of the Uniform Fire Code N.J.A.C. 5:70-3 et seq., N.J.A.C. 5:70-2.12 et seq.;
d. 
Residential owners of one-, two- and three-owner occupied dwellings, shall be permitted to have three non-emergency activations per year without penalty; thereafter, a fourth and subsequent non-emergency activation shall result in a $50.00 fine to be issued to the residential property owner.

Any building structure, complex excluding one-, two- and three-owner occupied residential dwellings that has changed building ownership, management or agency is required to complete any and all updated fire prevention registration forms.
The fee for the updated form shall be $250.00. Failure to comply within sixty (60) days of the transfer of ownership shall result in an additional fee of $250.00 per month, with a maximum fine to be levied at not to exceed $1,000.00.

All funds generated pursuant to the terms of this chapter which is subject to the New Jersey Administrative Code, shall be used to support the Fire Prevention Bureau and fire education programs.

The Borough of Cliffside Park has adopted and will operate and enforce the Department of Community Affairs, Division of Fire Safety New Jersey State Uniform Fire Code.

A fire watch is defined as a Borough ordered temporary measure intended to insure continuous and systematic surveillance of a building or portion thereof, by one or more qualified individuals, for the purpose of identifying and controlling fire and other life/property hazards.

A fire watch may be ordered by the Fire Official at any time and after attorney review and written notice to the Borough Administrator, and Construction Code Official opining that a fire watch is required. A fire watch may be posted in any public and/or privately owned buildings and/or properties.

Fire watches shall be performed by active members of the Borough of Cliffside Park Fire Prevention Bureau, Cliffside Park Volunteer Fire Department or Cliffside Park Police Department or designated individuals appointed by the Administrator.

a. 
All fire watch services ordered for the benefit/protections of private property shall be paid at the rate of twenty-five ($25.00) dollars per hour, per person with a minimum payment of four (4) hours per worker plus a fifteen (15%) percent administration fee. Additionally, there will be a one hundred ($100.00) dollar fee for the use of any Borough motor vehicle plus a one hundred twenty-five ($125.00) dollar fee for each onsite fire apparatus. All payments shall be made within ten (10) days after receipt of insurance. Payments shall be made payable to the Borough of Cliffside Park.
b. 
The Council does hereby authorize the Tax Collector to lien any parcel if payment is not made within sixty (60) days of invoice.

The Fire Prevention Official and/or the Cliffside Park Police Department shall have the exclusive jurisdiction to issue motor vehicle summonses for any vehicle parked within the fire lane.
