a. 
Prior to any club or organization authorized to use Borough of Cliffside Park, Cliffside Park Board of Education and/or Little League facilities for athletic or any other civic and/or social functions participated in by children; all persons 18 years of age or older who are in any way involved in the sports programs, including but not limited to coaches, assistant coaches, referees or persons of authority, are required to authorize and undertake a criminal background check from the New Jersey State Police. The cost of this criminal background check shall be the obligation of the Cliffside Park Recreation Department, excepting that the Cliffside Park Board of Education shall have their own procedure addressing criminal background reviews.
b. 
In the event the criminal background check of the person attempting to or actually participating in any municipal sponsored functions reveals any prior criminal convictions for crimes and/or offenses which could negatively impact upon the health, safety and/or welfare of either the children or youth activity volunteers, this person shall be permanently barred from participating in any function or hold any voluntary or remunerated position with any borough funded and/or owned recreation and/or little league activity.
c. 
Any person who is deemed barred (see subsection 28-1.1b) or banned (see subsections 28-1.6a or b) as a result of this section shall be entitled to formally petition the borough administrator who will schedule a hearing before the borough's designated hearing officer. The cost of the hearing officer shall be the responsibility of the petitioner, who shall be reimbursed by the borough if after a plenary hearing the hearing officer is of the opinion that the petitioner, irrespective of their criminal record, should be permitted to actively participate in any youth related activities.

As used in this section, the following terms shall have the meanings as indicated.
CODE OF CONDUCT
a. 
This section shall be deemed the borough's written specifications pertaining to the behavior of the parents, guardians, coaches, volunteers, officials, spectators, etc. and youth participants.
b. 
Prior to any person participating in any municipal or little league sponsored activity, the parents or legal guardians of the minor and/or adult participant, must consent, acknowledge and stipulate that they have received, read and understand this section.
SPORTS EVENTS
Shall mean any competition, practice or instructional event involving one or more sports teams or civic events.
SPORT EVENT SPECTATOR
Shall mean any person who attends a Cliffside Park sponsored civic or sports event whether the venue is located in Cliffside Park or elsewhere.
SPORTS TEAM
Shall mean any sports (male or female) or civic organization which is affiliated with or receives monetary or any other kind of support from the Borough of Cliffside Park and/or any other sports organization who utilizes any sports facility owned, operated, funded and/or monitored by the Borough of Cliffside Park, Cliffside Park Board of Education and/or Little League.

a. 
Every sports team, sports event spectator, the persons listed in the definition of "Code of Conduct" and/or youth participant shall be required to follow the Code of Conduct as set forth in this section.
b. 
A copy of this Code of Conduct shall be given to every participant (voluntary or remunerated) and every parent/guardian of the minor sports participant.
c. 
As a condition to accepting any participant (youth, voluntary or remunerated) into any municipal or little league sports program, the participant (youth, voluntary or remunerated), shall be required to execute an acknowledgment confirming that they have received a copy, read and understand this section.
d. 
All municipal, board of education and/or little league facilities shall have posted a notice advising the public that the Borough of Cliffside Park has adopted a Youth Sports Code of Conduct.

a. 
Fights, scuffles, etc. Any parent, guest, spectator, coach, youth participant or official at any youth sports event who initiates a fight, scuffle, or initiates any type of physical abuse or threats of abuse towards any player, coach, official, parent, youth participant and/or spectator shall be banned from attendance at any and all youth sports events under the direction of either the Borough of Cliffside Park, Cliffside Park Board of Education and/or Little League for a period not exceeding 12 months from the date of the incident.
b. 
Entering field of play. Any parent, guest, spectator, coach, youth participant, or official, at any youth sporting event who enters the field of play, court or rink during any youth sporting event for the purpose of physically or verbally abusing or confronting coaches, players or officials shall be banned from attendance at any and all youth sports events under the direction of either the Borough of Cliffside Park, the Cliffside Park Board of Education and/or Little League for a period not exceeding 12 months from the date of the incident.
c. 
Obscene, profane language or distractive loud language. Any parent, guest, spectator, coach, youth participant or official at any youth sports event who verbally abuses or uses distractive loud language against officials, players or spectators, including but not limited to, the use of obscene or profane language or gestures or racial, ethic or sexual slurs, shall be banned from attendance at any and all youth sports events under the direction of either the Borough of Cliffside Park, the Cliffside Park Board of Education and/or Little League for a period not exceeding 12 months from the date of the incident.
d. 
Throwing objects on field of play. Any parent, guest, spectator, youth participant or official at any youth sports event who throws or causes to be deposited any object on the field of play, court or rink during any youth sports event under the direction of either the Borough of Cliffside Park, the Cliffside Park Board of Education and/or Little League shall be barred from attendance at any and all youth events for a period not exceeding 12 months from the date of the incident.
e. 
Discipline. Any infraction of any provision(s) of subsection 28-1.4 shall subject the infracting party to discipline as provided for by this Code of Conduct.

Any parent, guardian, coach, spectator, participating minor and/or those persons listed in the definition of Code of Conduct, at any sports event shall be subject to the authority of all field officials which include but are not limited to: umpires, referees, elected league officials, director of recreation, coaches, board of education representatives, and if be, Cliffside Park Police Department. Any field officer may require the offending person(s) to immediately be removed or remove themselves from the sporting or civic venue.

a. 
If any person pursuant to this section is removed from any sports event by the recreation director, board of education representative, Little League official, Cliffside Park Police Department or their designee they shall be subject to the following minimum penalties:
1.
First Offense*
3 month ban from any sports event
2.
Second Offense*
12 month ban from any sports event
*An offense under subsection 28-1.6a or b may also subject the offender to the provisions of subsection 28-1.6d.
b. 
If any person pursuant to this section is removed from any sports event by an umpire or referee they shall be subject to these penalties:
1.
All Offenses*
Immediate removal from the sports event for the duration of the event; the removed person(s) shall be required to physically move their person not less than 200 feet from the sports facility venue.
*An offense under subsection 28-1.6b1 may also subject the offender to the provisions of subsections 28-1.6a.
c. 
If any person is removed from any sports event pursuant to subsection 28-1.6a and/or b of this section their names shall be posted and available for public inspection at either the recreation department, or board education, and/or Little League facilities.
d. 
If any person pursuant to this chapter is ordered or physically removed from any sports event by the Cliffside Park Police Department (at the discretion of the police officer), may be arrested as a disorderly person, subject to the jurisdiction of the Cliffside Park Municipal Court or Superior Court of the State of New Jersey or issued a violation pursuant to subsection 28-6.1a herein.
e. 
Sentencing guidelines.
1. 
First offense:
(a) 
Fine of not less than $250.00 nor more than $500.00; and
(b) 
Court costs of $150.00; and
(c) 
Completion of an anger management or equivalent counseling program consisting of not less than 12 hours of instruction; and
(d) 
Banned for a period of up to 12 months from any sports event; and
(e) 
Prior to any person convicted under this section being permitted to attend any sports event, they must petition the municipal court and present documented proof to the satisfaction of the municipal magistrate that they have successfully completed an anger management or counseling program.
2. 
Second offense:
(a) 
Fine not less than $500.00 nor more than $1,000.00; and
(b) 
Court costs of $250.00; and
(c) 
All penalties per subsection 28-1.6e1(c), (d) and (e).
3. 
Third and subsequent offenses:
(a) 
All penalties per subsection 28-1.6e2 et seq.; and
(b) 
Incarceration for a period not exceeding six months in the Bergen County jail.

As used in this chapter:
BOARD OF EDUCATION AREAS
Shall mean all property owned by the Cliffside Park Board of Education.
OTHER PUBLIC AREAS
Shall mean the Municipal Complex of the Borough of Cliffside Park.
PUBLIC RECREATION AREAS
Shall mean all municipal parks, municipal playgrounds, tennis courts, basketball courts and other municipal recreation and park facilities in the borough.
SPECIAL EVENT
Shall mean any activity or event conducted, sponsored or organized by a group other than the borough or its sub-entities.
WILDLIFE
Shall mean all animals that are neither human nor domesticated.

No person shall be allowed in any public recreation area between the hours of 10:00 p.m. and 6:00 a.m. except when events or programs specifically authorized by the borough council are scheduled during those hours.

No person shall consume any alcoholic beverage, including beer, in any public recreation or other public area of the borough unless such consumption is approved by the borough council in connection with an event or program which has received approval by the borough.

No games of chance shall be conducted nor shall participation in such games of chance be solicited in any public recreation or other public area of the borough without the prior approval of the borough council.

No beverage or food shall be consumed in any public recreation or other public area from glass containers except by permission of the borough council.

No archery, golf, skateboarding, roller-blading, street hockey or operation of a power-driven model, mopeds or motorcycles shall be permitted in any public area or any board of education area without the prior approval of the borough council in the case of public recreation or other public areas or the board of education in the case of board of education areas.

Abusive, profane or indecent language, or any conduct that may annoy others, shall be prohibited. This shall include any conduct to obstruct, molest or interfere with any person lawfully in any public recreation or other public area including the making of unsolicited remarks of an offensive, disgusting or insulting nature or which are calculated to annoy or disturb the person or persons to whom or in whose hearing they are made.

The borough council shall have the authority to enact by resolution such reasonable rules and regulations in connection with the use and operation of any public recreation area within the borough.

No person shall feed, cause to be fed, or provide food for wildlife on any public recreation or other public areas or board of education areas as defined herein.

a. 
The parks are for the enjoyment of Cliffside Park residents and the public, for any proper purposes, subject to the restrictions set forth in this chapter.
b. 
The use of parks by any person or persons shall be subject to the prior right of use by the borough recreation department while engaged in the actual conduct of its recreational programs.

Any group or organization which desires the use of any park for the purpose of conducting a specific program or activity is required to obtain a specific permit for such purpose, obtainable at the recreation office. Application for such use must be made at lease 14 days in advance of the scheduled program or activity and must be approved by the borough council.

The person or persons seeking issuance of such a permit shall file an application, in writing, with the borough council stating:
a. 
The name and address of the applicant.
b. 
The names and addresses of the person, persons, corporation or association sponsoring the activities, if any.
c. 
The day and the hours for which the permit is desired.
d. 
The park or a portion thereof for which such permit is desired.
e. 
A reliable estimate of the anticipated attendance.
f. 
The type of activity for which such permit is desired.
g. 
The anticipated age group of the expected participants.
h. 
The names and addresses of the adult persons who would supervise and be responsible for the proposed activity.
i. 
Such other information as may be reasonably required.

Issuance of a permit shall be made by the Council of the Borough of Cliffside Park based on the following criteria and may contain special conditions as appropriate:
a. 
That the proposed activity or use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park.
b. 
That the nature and character of the proposed activity or use of the park are not reasonably anticipated to incite violence, crime or disorderly conduct.
c. 
That the proposed activity or use if the park will not entail extraordinary or burdensome expense of police operation by the borough.
d. 
That the park area or facility desired has not been reserved for other use at the date and hour desired in the application and that it does not conflict with any other activity of the borough recreation department.

Private athletic training of any sport unless sanctioned by the recreation department is strictly prohibited.

Any person aggrieved by the issuance or nonissuance of a permit may appeal the decision to the Council of the Borough of Cliffside Park within ten days from the issuance of the permit or rejection of the application.

The persons to whom any permit is issued hereunder shall be fully liable for any and all loss, damage or injury sustained by any person whatever by reason of the willful misconduct or negligence of the person, persons or one of them to whom such permit shall have been issued.

All persons obtaining a permit shall, in all respects, be required to observe the conditions of this chapter and any regulations promulgated pursuant hereto, as well as any special conditions contained in the permit.

Except for emergencies or other special reasons, the various parks in the borough shall be open to the public every day of the year during the hours of 6:00 a.m. to 10:00 p.m. The opening and closing hours for each individual park shall be posted therein and in the municipal building for public information and shall be determined, from time to time, by resolution of the borough council.

Maintenance of parks shall be provided by the borough department of public works and or the recreation department.

Any part or the whole of any park may be closed to the public at any time and for such interval of time as may be reasonably necessary in the public interest. Such closing shall be accomplished by the posting of signs containing the word "closed" and such other information as may be reasonably required to inform the public.

a. 
The regulations set forth herein shall regulate the conduct of persons, as individuals or members of a group, and groups of persons and govern their use of parks, playgrounds or recreational areas of the borough.
b. 
The borough council may, by resolution, adopt special provisions of a temporary nature inconsistent with the regulations as set forth herein.
c. 
No person or group of persons shall, while upon any borough park, playground or recreational facility:
1. 
Be in or use the same for any purpose during the hours such facility or part thereof is posted as closed.
2. 
Damage, deface, injure, destroy, remove or interfere with any property of the borough, including plant life or wildlife.
3. 
Bring any domestic animal or animals into such facility or bring or ride a horse thereon.
4. 
Kindle, build or maintain a fire of any sort.
5. 
Picnic or bring foodstuffs into any area except such area, if any, as may be clearly marked therefor by signs posted.
6. 
Bring or consume any alcoholic beverage without a permit.
7. 
Bring in or dump on or deposit or leave on any bottles, broken glass, trash, garbage or other refuse except in connection with the proper use of the property and when placed in the proper receptacles where provided for such matter, and, where receptacles are not provided, such matter shall be carried away by the person responsible for its presence and properly disposed of elsewhere.
8. 
Post or otherwise place any sign, placard or advertisement whatever, unless otherwise authorized by proper authority, except that posters, placards or notices authorized by the department of recreation dealing with the functions of the department of recreation are considered authorized.
9. 
Carry or possess firearms (which prohibition shall not apply to law enforcement officers) of any description or air rifles, spring guns, bows and arrows, slings or any other forms of weapons potentially inimical to wildlife and dangerous to human safety or any instruments that can be loaded with and fire blank cartridges or any kinds of trapping devices. Shooting into park areas from beyond park boundaries is forbidden.
10. 
Have in his possession or cause to be exploded or discharged any firecrackers, fireworks or similar things.
11. 
Ride a bicycle on other than a paved vehicular road designated for that purpose. A bicyclist shall be permitted to wheel or push a bicycle by hand over any grassy area or trail or paved are reserved for pedestrian use.
12. 
Drive, operate, use or bring into any park any automobile, motorbike, minibike, moped or motorcycle or any other motor vehicle, except that properly licensed vehicles may be brought to designated parking areas, if any, using designated roads for that purpose.
13. 
Gamble or participate in any way in a game of chance or engage in wagering or participate in any game or sport for money or other valuable thing.
14. 
Bring golf clubs or similar equipment or use the same in any park facility.
15. 
Solicit contributions or support for any purpose, public or private.
16. 
Sell or offer to sell any article of merchandise or thing or display for sale any article or thing.
17. 
Disturb or interfere unreasonably with any person or persons occupying any area or participating in any activity under authority of a permit.
18. 
Conduct himself in a disorderly or indecent manner or commit any indecent act or use profane, indecent or obscene language or gesture or interfere with or disturb any other person using or enjoying such facility.
19. 
Wildlife Feeding.
(a) 
No person shall feed, in any public park or on any other property owned or operated by the Borough of Cliffside Park, any wildlife, which includes all animals that are not domesticated; feral cats are deemed undomesticated animals.
(b) 
Violations and penalties. Any person in violation of this subsection who fails or refuses to comply therewith shall be liable to a penalty of not less than fifty ($50.00) dollars and no more than five hundred ($500.00) dollars for each offense.

The department of parks and playgrounds reserves the right, without given notice, to close any and all parks and playgrounds for reasons of inclement weather, to include snowstorms, high winds and rain.
