All requests for public records shall, except for requests by Borough employees/officials acting in their official capacity and non-profit organizations, be subject to the Borough's policy as to copying costs. Said policy is to charge those fees authorized by the provisions of N.J.S.A. 47:1A-2, which are incorporated herein, with the exception that all audio tape reproduction shall be subject to a ten ($10.00) dollar copying fee plus the actual cost of reproduction for each reproduced tape. If specific fees are chargeable by any other provision of the Borough Code which exceed the following fees, the fees required by said other provisions of the Code shall prevail.

Additional fees shall be charged for large-sized paper documents and maps per page cost and are as follows:
(1) 
Zoning map - $4.00;
(2) 
Street map - $2.00 per page;
(3) 
Drug-Free School Zone map - $1.00;
(4) 
Soils Survey map - $4.00;
(5) 
Site plan -$5.00 per page;
(6) 
Subdivision plat - $5.00 per page;
(7) 
Tax maps - $5.00 per page;
(8) 
Engineering plans - $5.00 per page;
(9) 
Water or Sewer maps - $5.00 per page;
(10) 
Blue Prints - $15.00 for the first page together with $5.00 for each page thereafter.

Additional fees shall be charged for the following police documents:
(1) 
Police accident reports - same as Subsection 30-1.1 above, if requested and picked up in person;
(2) 
Police accident reports, when copies are requested other than in person $5.00 for the first three pages and $1.00 per page for each additional page, as established by N.J.S.A. 39:4-131;
(3) 
Photographs or copies - $5.00 each for the first 10; $3.00 each additional;
(4) 
A fee of $10.00 is hereby established for fingerprinting of any individual;
(5) 
For Municipal Court discovery, videotapes, DVDs and CDs shall be charged at the rate of $25.00 per item; other forms of electronic or digital storage media shall be charged at a rate to be determined as needed;
(6) 
On any item that cannot be photocopied on the Borough copy machine or not otherwise provided for herein, the actual cost incurred in making the copy shall be charged;
(7) 
Actual postage shall be charged for any discovery sent by mail, as well as $0.25 for the envelope for any discovery sent by mail;
(8) 
Where Municipal Court discovery must be obtained from an entity other than the Borough of Cliffside Park, e.g., another police department, the actual cost paid to the other entity shall be paid by the requestor;
(9) 
Radio/tape - $15.00 per item;
(10) 
Operations reports - $10.00 per report;
(11) 
Investigation reports - $10.00 for one- to five-page reports; $16.00, six-or-more page reports.

Additional fees shall also be charged for the following electronic records:
(1) 
Copy of videotape where tape is supplied by the municipality - $50.00;
(2) 
Copy of audiotape where tape is supplied by the Borough - $30.00;
(3) 
Copy of electronic document of database on floppy disks - $5.00, plus cost of disk ($1.00 each);
(4) 
Copy of electronic document or database on CD - $5.00, plus cost of CD ($3.00 each).

Additional fees shall also be charged for the following miscellaneous items:
(1) 
Municipal lien search, under N.J.S.A. 54:5-11 - $10.00;
(2) 
Tax account history - $2.00;
(3) 
Assessment for improvement history - $2.00.

A special service charge, as permitted by law, shall be imposed, in addition to the actual cost of duplicating the record, where the nature, format, manner of collation or volume of printed matter is such that it cannot be reproduced by ordinary document-copying equipment in ordinary business size or where such record involves an extraordinary expenditure of time and effort to accommodate the request. The requestor shall have the opportunity to review and object to the special service charge prior to it being incurred. Charges shall be as follows:
a. 
The actual cost (materials and supplies but no staff labor) of duplication or reproduction; plus
b. 
A special service charge of $50.00 per hour or the actual direct cost of labor (if less) shall be imposed for each hour of extraordinary time predicated to be utilized to respond to the request. The rate shall be assessed in ten-minute increments. A deposit of 50 percent of the estimated amount shall be made at the time of the request if the estimated cost of reproducing and/or special service charge exceeds $15.00. The balance will be paid at the time of pickup of documents. The requestor shall be provided with an opportunity to review and object to the charge prior to the charge being incurred.
c. 
In the event a review is required by a professional, charges for extraordinary expenditures of time shall be based upon the hourly rate charged by the professional to the Borough, calculated at ten-minute intervals. The requestor shall be provided with an opportunity to review and object to the charge prior to any charge being incurred.

The Council reserves the right to amend all fees established herein annually by resolution.
