As used in this chapter:
PRIVATE SWIMMING POOL
Shall mean any body of water, tank or receptacle for water, whether artificially or semi-artificially constructed or portable, having a depth at any point greater than two feet, and used or intended to be used for swimming or bathing solely by the owner, his family or guests of the household and constructed, installed, established or maintained outside any building in or above the ground upon any premises as an accessory use to the residence.
WADING POOL
Shall mean any artificially constructed pool, not designed or used for swimming, with a maximum depth of two feet, whether permanent or portable.

It shall be unlawful for any person to construct, install, establish or maintain a private swimming or wading pool, without obtaining a permit therefor from the building inspector. No permit shall be required for a wading pool of the portable type with a depth of one foot or less.

Application for a permit to construct, establish, maintain, alter, remodel or add to, a permanent private swimming pool or permanent wading pool shall be made to the building inspector either by the owner of the property or the contractor who shall construct same. The application shall be accompanied by four sets of the following:
a. 
A plot plan showing:
1. 
Property lines of the premises;
2. 
All existing houses and structures thereon;
3. 
The location and dimensions of the proposed private swimming pool or wading pool and its auxiliary structures;
4. 
All existing fences or walls and the height there of.
b. 
Plans and specifications for:
1. 
The proposed private swimming pool or wading pool;
2. 
All auxiliary structures and appurtenances related thereto;
3. 
The location, height and aperture dimensions of the fence, the gate and its locking or latching devices, which is to be erected when such fencing is required under this chapter.

Application for a permit to install, establish and maintain a portable private swimming pool or wading pool shall be made to the building inspector either by the owner of the property or the person who shall install same. The application shall show the dimensions of the pool and the system and place of discharge of the water.

No permit for a private swimming pool or wading pool shall be issued by the building inspector until the plans, specifications and plot plans have been approved by the engineer, the health officer and the plumbing inspector of the borough and their approval properly certified on the plans.

A fee of twenty five ($25.00) dollars shall be paid to the borough for a private swimming pool permit. The permit fee shall be exclusive of the permit fee required for erection of any accessory structures to be used in connection with such private swimming pool.
A fee of ten ($10.00) dollars shall be paid to the borough for a permit for a wading pool.
The above fees shall be payable annually on May 1.

All material used in the construction of private swimming pools and wading pools shall be waterproof and easily cleaned. Construction and design of the pools shall be such that they may be maintained and operated so as to be clean and sanitary at all times. The owner of every pool shall be responsible for maintaining the pool in such condition as to prevent breaks in the pool chassis or water from the pool from overflowing onto adjacent property.

There shall be no physical connection between a potable public or private water supply system and a private swimming pool or wading pool at any point below the maximum waterline of the pool or to the recirculating or heating system of the pool.

All private swimming pools or wading pools, with a water depth of more than one foot, constructed, installed, established or maintained shall be provided with one drainage outlet, not in excess of three inches in diameter, extending from the pool to either a storm sewer or lawn-sprinkling system on the premises on which the pool is located. The discharge of water from private swimming pools or wading pools into a storm sewer shall be permitted only following approval by the proper state, county and borough officials.
No private pool drain or wading pool drain shall be connected into the sanitary sewer system, except upon written approval of the borough engineer, health officer and plumbing inspector. Application for such approval shall be in writing.
The borough engineer, if such connection is authorized by the borough, shall inspect the premises on which the pool is planned to be constructed, installed, established or maintained in order to determine the proper place and type of connection with the sanitary sewage system.
Approval of an application shall not be given if it is feasible to discharge water from a pool into a storm sewer or use such water for purposes of lawn sprinkling on the premises. Approval shall not be given to discharge such water to the curb or upon the surface of any street.

Where approval is obtained to discharge water from a private swimming pool or wading pool into the sanitary sewage system, the owner, lessee or occupant of the pool may discharge the water only at the time designated and allocated by the borough health officer and endorsed on the permit. The purpose of this requirement is to prevent a strain upon the sewer s stem by controlling and distributing the discharge of water.

All private swimming pools and wading pools shall be treated with chlorine or its compounds in sufficient quantity so that there will be present in the water at all times when the pool is in use a residual of excess chlorine of not less than 4 or more than 6 parts per million of available free chlorine.

Not more than 15 percent of the samples of water taken from any private swimming pool or wading pool when more than 20 samples have been examined and not more than three samples when less than 20 samples have been examined, shall contain more than 200 bacteria per cubic centimeter or shall show positive test (confirmed) for coliform in any of five-ten cubic centimeter portions of water at times when the pool is ready for use. For the purpose of this section, any number of samplings of water on a single day shall be considered as one sample. The borough board of health is hereby authorized to take samples to insure compliance with these requirements.

Locker rooms, bath houses, cabanas, shower rooms, toilets, runways and all other physical facilities or equipment incident to the operation of any private swimming pool or wading pool shall be kept in a sanitary condition at all times.

No private swimming pool or wading pool with a capacity of more than 250 gallons, and no accessory building as set forth in section 16-12 hereof, shall be constructed, erected, installed or maintained within five feet of any property line, within ten feet of the main building on the premises or in the front yard of the property.

All permanent private swimming pools and wading pools shall be completely surrounded by a fence or wall of the type and dimensions hereinafter specified.
All portable private swimming pools and portable wading pools, unless enclosed by a fence or wall of the type and dimensions hereinafter specified, shall, when not in use or unattended, be either emptied or covered with a suitable, strong protective covering, securely fastened or locked in place.
Whenever a fence or wall is required to be erected under this chapter, it shall be at least four feet in height and shall be constructed so as not to have openings, holes or gaps larger than four inches in any dimensions except for doors or gates. If a picket fence is erected or maintained the horizontal dimension shall not exceed four inches. A dwelling house or accessory building may be used as part of such enclosure. All gates used in conjunction with the fence or wall shall meet the same specifications as the fence or wall itself and shall be equipped with approved locking and latching devices which shall be locked at all times when the pool is not in use.

Artificial lighting shall not be maintained or operated in connection with private swimming pools or wading pools in such a manner as to be a nuisance or an annoyance to occupants of neighboring properties. There shall not be any underwater lighting facilities in any private swimming or wading pool.

Every private swimming pool or wading pool constructed, installed, established or maintained or to be constructed, installed, established or maintained shall at all times comply with the requirements of the borough board of health.
It shall be the duty of the building inspector and the health officer, respectively, to enforce the provisions of this chapter.
The owner or operator of any pool within the borough shall allow the building inspector, the health officer or other authorized official, access, at all reasonable times, to any private swimming pool, wading pool or appurtenances thereto for the purpose of inspecting to ascertain compliance with this chapter and all pertinent borough ordinances.

Any nuisance or hazard to health which may exist or develop in or in consequence of or in connection with any private swimming pool or wading pool shall be abated and removed by the owner, lessee or occupant of the premises on which the pool is located within ten days of receipt of notice from the building inspector or health officer of the borough.
