Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Mayor or, in his/her absence, disability or inability to act, then the Chief of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours or any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute or in this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $100 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Borough of Fairview are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

A designated area "Handicap Parking Only" shall be established as per the following markers: The first space shall be on the east side of the Borough Parking Lot located at Anderson Avenue space closest to Borough Hall (as shown on attached Exhibit A).[1]

A designated area "Parking for Veterans Only" shall be established as per the following markers: The space shall be at the northeast corner of the Borough Parking Lot adjacent to the intersection of Anderson Avenue and Garfield Street (as shown on attached Exhibit A).

A designated area "Parking for Borough Administrator Only" shall be established as per the following markers: The space shall be on the east side of the Borough Parking lot located at Anderson Avenue, second space south of the sign for "Handicap Parking Only" (as shown on attached Exhibit A).
d. 
A designated area "Parking for Police Chief Only" shall be established as per the following markers: The space shall be on the south side of Garfield Street staring exactly 72 feet east of the intersection of Grant and Garfield Streets and extending east toward Anderson Avenue for 24 feet.
e. 
There shall be designated three parking spaces for "15-minute Parking for Borough Business" established as per the following markers: The spaces shall be on the west side of Anderson Avenue starting exactly 50 feet south of the intersection of Garfield Street and extending south on Anderson Avenue for 60 feet.
f. 
There shall be designated two parking spaces for "Police Vehicles Only" established as per the following markers: The spaces shall be on the west side of Anderson Avenue starting 10 feet south of the intersection of Garfield Street and extending south on Anderson Avenue for 50 feet.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fire, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs. Fine: $30; Cost: $2.50; ATS Surcharge: $2; EMTTF: $0.50.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and menace to the safe and proper regulations of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Borough of Fairview, in the County of Bergen, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstruct the normal flow of traffic. Any person, contractor, or utility who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.
a. 
Emergency Contact Phone Numbers. The person, contractor or utility shall provide the Fairview Police Department with at least two emergency contact phone numbers to be called in the case of an emergency or problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contacts cannot be reached or if the emergency contact person does not respond to a call from the Fairview Police Department to correct the hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable fees for such emergency services by the Borough shall be charged to the person, contractor or utility responsible for such condition.
b. 
Traffic Directors. Traffic officers shall be posted at all construction or maintenance sites when determined by the Fairview Police Department that the same is necessary to provide for the safety and expeditious movement of traffic. All costs associated with the traffic officers being utilized at the work site, shall be paid for by the person, contractor, or utility performing the work.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County Jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County Jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or in which a violation occurs or continues.

All ordinance or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commissioner of Transportation 20 days after passage and publication as prescribed by law.

Time metered parking shall be as follows.

For the purpose of this subsection, the following terms shall have the meanings indicated:
MANEUVERING SPACE
Shall mean the area situated between two parking spaces reserved as open area to be utilized for ingress to and egress from the parking space. The "maneuvering space" shall be established throughout the parking meter zones and shall be marked with a large yellow "X".
OPERATOR
Shall include every individual who shall operate a vehicle as the owner thereof, or as the agent, employee or permittee of the owner, or who is in actual physical control of the vehicle.
PARK or PARKING
Shall mean the standing of a vehicle, whether occupied or not, upon a street otherwise than in obedience to traffic regulations, signs or signals.
PARKING METER
Shall mean and include any mechanical device or meter not inconsistent with this section placed or erected for the regulation of parking by authority of this section. Each "parking meter" installed shall indicate by proper legend the legal parking time established by the Borough and, when operated, shall at all times indicate the balance of legal parking time and, at the expiration of such period, shall indicate illegal or overtime parking.
PARKING METER SPACE
Shall mean any space within a parking meter zone which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street adjacent to or adjoining the parking meters.
PARKING METER ZONE
Shall mean and include any restricted street or municipal parking lot upon which parking meters are installed and in operation.
PERSON
Shall include any individual, firm, copartnership, association or corporation.
STREET
Shall mean any public street, avenue, road, alley, highway, lane, path or other public place located in the Borough of Fairview and established for the use of vehicles.
VEHICLE
Shall mean any device in, upon or by which any person or property is or may be transported upon a highway, except a device which is operated upon rails or tracks.

a. 
The following named and described areas, streets or portions of streets, and such other area, streets or portions of streets as may hereafter be included in this subsection by amendment hereto lying within the corporate limits of the Borough of Fairview shall constitute a parking meter zone, namely:
1. 
Both sides of Anderson Avenue from Park Avenue to Fairview Avenue; and
2. 
North side of Fairview Avenue to east of Lincoln Street.
b. 
All frontages in the squares, streets or avenues defining the zones are to be included therein.

The Department of Public Works is hereby directed and authorized to cause to be marked off individual parking spaces in the parking zones designated and described in Subsection 7-11.4 and in such other zones as may hereafter be established, the parking spaces to be designated by lines painted or durably marked on the curbing or surface of the street. At each space so marked off, it shall be unlawful to park any vehicle in such a way that the vehicle shall not be entirely within the limits of the space so designated.

In parking meter zones, the Department of Public Works shall cause parking meters to be installed upon the curb or sidewalk immediately adjacent to the parking spaces provided in Subsection 7-11.5 as shown on the plans therein referred to, and the Department of Public Works shall be responsible for the regulation, control, operation, maintenance and use of such parking meters. Each device shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin or coins, lawful money of the United States of America, for the period of time prescribed by this section. Each device shall be so arranged that, upon the expiration of the lawful time limit, it will indicate by a proper visible signal that the lawful period has expired, and in such cases the right of such vehicle to occupy such space shall cease, and the operator, owner or possessor or manager thereof shall be subject to the penalties hereinafter provided.

Except in a period of emergency determined by an officer of the Fire Department or Police Department or in compliance with the directions of a Police Officer or traffic control sign or signal, when any vehicle shall be parked in any parking space alongside of or next to which a parking meter is located, the operator of such vehicle shall, upon entering the parking meter space, immediately deposit or cause to be deposited for such parking meter and as is designated by proper directions on the meter, and, when required by the directions on the meter, the operator of such vehicle, after the deposit of the proper coin or coins, shall also set in operation the timing mechanism on such meter in accordance with directions properly appearing thereon, and failure to deposit such proper coin and to set the timing mechanism in operation when so required shall constitute a violation of this section. Upon the deposit of such coin (and the setting of the timing mechanism in operation when so required), the parking space may be lawfully occupied by such vehicle during the period of time which has been prescribed for the part of the street in which the parking space is located, provided that any person placing a vehicle in a parking meter space adjacent to a meter which indicates that unused time has been left in the meter by the previous occupant of the space shall not be required to deposit a coin so long as his occupancy of the space does not exceed the indicated unused parking time. If the vehicle shall remain parked in any such parking space beyond the parking time limit set for such parking space notwithstanding that additional coins have been inserted, then, and in such event, such vehicle shall be considered as parking overtime and beyond the period of legal parking time, and such parking shall be deemed a violation of this section.

a. 
Parking a vehicle in the designated space in a parking meter zone shall be lawful only for the period of time therein fixed and upon the depositing of a coin of the value stated herein for the time period as follows:
1. 
$0.50 for each hour with a maximum of two hours.
b. 
Parking meters shall be operated in parking meter zones on the days and between the hours designated herein as follows: Every day between the hours of 9:00 a.m. and 5:00 p.m., six days per week Monday through Saturday, inclusive of holidays except; New Year's Day, Presidents' Day, Memorial Day, third Friday in June known as "Juneteenth," Labor Day, Columbus Day, Election Day, Veterans' Day, Thanksgiving Day and Christmas Day.

a. 
It shall be unlawful and a violation of the provisions of the section for any person to:
1. 
Cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described or to deposit in any parking meter any coin for the purpose of parking beyond the maximum legal parking time for the particular parking meter zone. Fine: $30; Cost: $2 AF; $0.98 SR; 1 AV; $2 DN; $0.50 EM; $0.02 SM; $1 BI; $3 AM.
2. 
Permit any vehicle to remain or be placed in any parking space adjacent to any parking meter while the meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space. Fine: $30; Cost: $2.50; ATS Surcharge: $2; EMTTF: $0.50.
3. 
Park any vehicle across any line or marking of a parking meter space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings. Fine: $30; Cost: $2.50; ATS Surcharge: $2; EMTTF; $0.50.
4. 
Deface, injure, tamper with or open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this section, as the Court may fix. Minimum fine: $250.
5. 
Deposit or cause to be deposited in any parking meter, any slug, device or metal substance or other substitute for lawful coins. Fine: $85; Cost: $12.50; ATS Surcharge: $2; EMTTF: $0.50.
6. 
Park any vehicle in a manner which encroaches or overhangs any part of a maneuvering space (as herein defined). Fine: $30; Cost: $2.50; ATS Surcharge: $2; EMTTF: $0.50.
7. 
Park any vehicle with the front or rear bumper, as appropriate, more than three feet distant, measured parallel to the curb, from the parking meter for the space. Fine: $30; Cost: $2.50; ATS Surcharge: $2; EMTTF: $0.50.
b. 
Any person violating this section shall pay the fine listed for such violation.

It shall be the duty of the Fairview Police Department to enforce the provisions of this section as directed by the Mayor and Council.

The Mayor and Council shall designate an officer or employee of the Borough to make regular collections of the money deposited in the meters. It shall be the duty of the designated person to remove the coins deposited in the meters and to deliver the coins to the Chief Financial Officer or his designee.

The coins deposited in the parking meters shall be paid into the general treasury of the Borough.

Nothing in this section shall be construed as prohibiting the Borough from providing for bus stops, for taxicab stands and other matters of similar nature, including the loading or unloading of trucks, vans or other commercial vehicles.

Board of Education employees and Borough employees shall be exempt from the requirement for a parking permit while parked on Borough streets for the purpose of conducting Borough business.
b. 
Borough employees shall be exempt from depositing or causing to be deposited for such parking meter coin or coins while parked in the Borough for the purpose of conducting Borough business.

One digital permit may be issued for each business owner where metered parking is located on Anderson Avenue and Fairview Avenue only.
b. 
The vehicle must be registered to the business or to the owner or manager of the business.
c. 
The business shall file an application for a permit with the Fairview Police Department.
d. 
The digital permit will allow the business owner to park at metered spots on Anderson Avenue and Fairview Avenue only.
e. 
The digital permit can only be registered to use for two vehicles.
f. 
The permits can be purchased for $50 per month.
g. 
The permit does not guarantee reserved parking for the business.
h. 
The permits are not transferable to other vehicles without the consent of the Police Department.
i. 
Required documentation for the permit to be issued a business certificate: vehicle registration, driver’s license and proof of ownership or employment.[1]

a. 
Parking of commercial vehicles, as herein after defined, in all streets in the Borough of Fairview, between the hours of 9:00 p.m. and 6:00 a.m., is hereby prohibited, except for commercial vehicles parked in front of or adjacent to a legally licensed business within the Borough. The commercial vehicle must also be registered to the business which it is parked in front of or adjacent to.
b. 
In all residential zones, there shall be parking permitted for no more than one commercial vehicle, as herein after defined, per household. The commercial vehicle must be garaged at all times when parked at the household or must otherwise be parked in the rear of the household and screened from view from the street.
c. 
Nothing contained herein shall prevent temporary parking of trucks during the prohibited hours provided they are actively engaged in the delivering and/or pickup of cargo while temporarily parked.
d. 
Upon application to the Chief of Police, or his designee, limited exemptions, for periods no longer than 10 days shall be given for construction equipment in use at an existing work site.
e. 
Exempt from provisions of this subsection are any motor vehicles owned by the Borough of Fairview or any agency or department thereof.
f. 
Any person found guilty of violating this subsection shall be subject to a penalty consisting of a fine or imprisonment, or both, subject to the discretion of the Judge, the maximum of which shall be the maximum fine or term of imprisonment permitted to be imposed by the court having jurisdiction over the violation of the ordinance. The fine shall not be less than $100 nor more than $2,000 per offense and the prison term shall not exceed 90 days in accordance with N.J.S.A. 40:49-5. In the event of a continuing violation, each day shall constitute a separate offense.
g. 
Definitions of a commercial vehicle:
1. 
Any truck, being any motor vehicle designed and used or maintained primarily for the transport of property.
2. 
Any boat trailer, utility trailer, camper-type trailer or self-propelled camper or recreational vehicle, whether or not affixed or connected to another motor vehicle.
3. 
Any van or pickup truck bearing commercial license plates or having any sign, lettering or other indicia indicating that the vehicle is maintained for business or commercial purposes.
4. 
Step vans.
5. 
Buses of all types, including, but not limited to, school buses, mini-school buses and jitney buses.
6. 
Tractors.
7. 
Tractor-trailers.
8. 
Any truck trailer.
9. 
Camper vehicles, motor homes and mobile vehicles.
10. 
Commuter vans or other commuter vehicles.
11. 
Stake-body trucks.
12. 
All dump trucks regardless of size.
13. 
Limousines.
14. 
All non-passenger vehicles and/or equipment or machinery, including but not limited to construction vehicles and equipment.
15. 
Any motor vehicle passenger or non-passenger vehicle that is registered commercial and bearing commercial license plates.

For all purposes herein, the word "truck" shall be interpreted to mean any motor vehicle designated, used or maintained primarily for the transportation of property, any boat trailer, utility trailer, camper-type trailer or camper recreational vehicle; whether or not connected to any other vehicle, step vans, buses of all types, including school buses and jitney buses, tractors, tractor trailers, or any truck trailer, camper vehicles, motor homes or mobiles, and any other commuter vehicle with a registered gross vehicle weight in excess of 9,000 pounds.

Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets as described are hereby designated as route for vehicles over the designated weight. All trucks having a total combined registered gross weight of vehicle plus load in excess of the designated weight shall be excluded from all streets, except for those streets listed which form a part of the system of truck routes. Vehicles will be permitted on all streets for the purpose of the pick up and delivery of materials.

Note: Below are minimum standards for bus stop length which are based on recommendations of the Institute of Transportation Engineers and studies conducted by the Bureau of Traffic Engineering and Safety programs. Completed handicap application;
(2) 
Letter of Need from the applicant;
(3) 
Notarized affidavit to be completed by a licensed physician stating type of disability and that the applicant is currently under treatment of the condition; Copy of the Disabled Person ID card issued by Motor Vehicle Commission;
Copy of the Handicapped Parking Placard issued from New Jersey Motor Vehicle Commission;
Copy of the applicant's vehicle registration (Disabled person must own the vehicle requested for the parking space unless exigent circumstances as determined by the Police Department);
Copy of the applicant's driver's license.
2. 
If the applicant is a tenant, a notarized letter must be submitted by the landlord stating that parking is not permitted in the driveway and that the landlord has no objection to the placement of a handicap parking sign in front of the property.
3. 
If the applicant is the property owner, a letter must be submitted with the application stating why the applicant can not use the driveway or that the property does not have a driveway.

Pursuant to P.L. 1989, C. 201, the penalties for violations of this § 7-35 shall be $250 for a first offense and for a subsequent offense shall be a fine of at least $250 and up to 90 days community service on such terms and such form as the Court shall deem appropriate, or any combination thereof.

A resident parking permit, of a design and method of application will be specified by the Chief of Police as approved by the Mayor and Council, will be issued to residents of Fairview who own a motor vehicle.
b. 
Proof of residency of the owner of a vehicle must be presented when applying for a permit, the following is acceptable proof of residency: a copy of a valid New Jersey driver’s license, a copy of a valid New Jersey motor vehicle registration for which the permit is sought showing an address in the Borough of Fairview, and proof of ownership of property or legal tenancy in an apartment.
c. 
In the case of a vehicle claimed to be leased and used by a Fairview resident, a copy of the valid New Jersey motor vehicle registration and a copy of the automobile lease reflecting the applicant's address in the Borough of Fairview shall be presented to the parking authority and proof of ownership of property or legal tenancy in an apartment.
d. 
The price of the resident parking permit will be set by resolution adopted by the Mayor and Council.
e. 
Effective Monday through Friday from 9:00 a.m. to 11:00 a.m., and Monday through Sunday, 1:00 a.m. to 5:00 a.m., subject to the following exceptions:
1. 
Announced holidays of New Year's Day, Presidents' Day, Memorial Day, third Friday in June known as "Juneteenth," Labor Day, Columbus Day, Election Day, Veterans' Day, Thanksgiving Day and Christmas Day; and
2. 
Within 500 feet of a place of worship and school from an hour before to an hour after services or school functions; and
3. 
Areas covered by metered parking, every street will be designated "Resident Permit Parking Only." Resident permit parking only zones are valid only for vehicles assigned a valid Fairview resident parking permit.

Temporary permits are to be used by Fairview residents who need permits on a temporary basis.
b. 
Temporary permits may only be issued for 30 days per vehicle per calendar year. No renewals of temporary permits will be granted.
c. 
In a household where a resident has not acquired a residential parking permit or does not have a motor vehicle operating license with a valid Borough of Fairview address, a temporary permit may be obtained by presenting a valid lease or title for a legal residential Fairview address.
d. 
Use of a temporary permit is confined to permit parking zones, as designated by the parking authority.
e. 
The price of the resident parking permit will be set by resolution adopted by the Mayor and Council.
f. 
Documentation, when applying for a permit, must include: a copy of a valid New Jersey driver’s license and a copy of a valid New Jersey motor vehicle registration for which the permit is sought.

a. 
Visitor permits are to be used while visitors are actually visiting the household of a resident to which the permit is issued. Visitor’s permits will be sold in packages of 10. The price of the visitors permit package will be set by resolution adopted by the Mayor and Council.
b. 
Only one visitor's permit shall be used at any given time. Visitor permits are not required on announced holidays.
c. 
In a household where a resident has not acquired a parking permit or does not have a motor vehicle operating license with a valid Borough of Fairview address, a visitor permit may be obtained by presenting a valid lease or title for a legal residential Fairview address, or a tax bill reflecting an address within the Borough of Fairview.

Business establishments located in the Borough of Fairview may obtain business permits for any nonresident employee or business owner of such business establishment who commutes to work. The permit shall be reasonably limited to the hours during which the nonresident employee or owner is present at the premises. Business permits are to be used while visitors are actually working at the business to which the permit is issued. Use of a business permit is confined to permit parking zones as designated by the Mayor and Council.
b. 
Business permits will be issued on an annual basis
c. 
The Mayor and Council have the right to grant business permits in special circumstances.
d. 
Each applicant for a business permit must pay an annual application fee of $50 and show proof that the business is located in Fairview. Applicant will receive one business parking permit.
e. 
Any business establishment seeking additional business parking permits must pay an annual fee of $20 for each employee. Each employee will need to provide proof of employment, valid driver’s license, and vehicle registration.
f. 
Proof of employment can be valid employment ID, or pay stub with name matching vehicle registration.
g. 
All fees to be collected pursuant to this section shall be set by the Mayor and Council.

Health care worker permits are to be used while health care workers are visiting the household of a Borough of Fairview resident.
b. 
The applicant must submit a copy of their NJ Motor Vehicle Commission home care service employee placard, and address that the health care worker is caring for. Also, the health care worker shall provide employment badge, driver’s license and registration of vehicle.
c. 
The health care worker permit parking permit will cost $1 per permit, plus any service charges incurred by the application method, not to exceed a total of $2.

Any abuse in the use of a permit will result in its revocation for any purpose other than the one stated on the permit application.

Business permits will expire annually as reasonably determined by the Mayor and Council. Any vehicle bearing an expired permit parked on a street posted "Permit Parking Only" or "Resident Permit Parking Only" shall be subject to a fine of $25.

Enforcement of this section and further rules and regulations as may be promulgated from time to time shall be under the jurisdiction of the Fairview Police Department.

A schedule of all fees set pursuant to this section shall be available for public inspection during regular business hours at the office of the Borough Clerk/Administrator.

a. 
Government worker permits are to be used employees of state, county, municipal, Board of Education and nonprofit organization workers that are working at their place of employment.
b. 
The applicant must submit proof of employment, driver’s license, and vehicle registration. Proof of employment shall be a valid photo identification card issued by the employee or pay stub with the employee’s name on it.

Government worker parking permit will be set by resolution adopted by the Mayor and Council.

In accordance with the provisions of N.J.S.A. 39:4-197, the following municipal and Board of Education property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate or park a vehicle in violation of the regulations indicated.
a. 
Garfield and Grant Street Parking Lot. The area adjacent to and west of Grandview Firehouse is to be designated a "parking lot" for the Mayor and other Borough officials only. This area is 76 feet long on Garfield Street and 28 feet long on Grant Street, with a total appropriation of 2,128 square feet. This area shall be divided to accommodate eight parking spaces. No person shall park vehicles at any time in the parking spaces designated for the Borough officials, except for any Fairview Volunteer Firefighter, ambulance squad member, Police Officer or Borough employee provided, however, if the Borough official for whom the space is designated requests the use of his/her designated space whoever is occupying the space, including volunteer firefighter, ambulance squad member, Borough employee or Police Officer must remove their vehicle immediately. Failure to immediately remove the vehicle upon the request of the Borough official shall constitute a violation of this subsection and subject the violator to having their vehicle towed and the appropriate fines. The parking space designated for the Mayor shall only be used by the Mayor. No person shall park a vehicle in the Mayor's space at any time including any Fairview Volunteer Firefighter, ambulance squad member, Borough employee or Police Officer. Any vehicle parked in the space designated for the Mayor shall be subject to being towed and the appropriate fines.
b. 
Area Designated for Fairview Fire Department Members. The area on Fourth Street from its intersection with the northerly side of Walker Street to a point 100 feet northerly thereof is designated for the Fairview Fire Department members only. No person shall park vehicles at any time in this area designated for the Fairview Fire Department members, except for any Police Officer or Borough employee. Any vehicle illegally parked in this area shall be subject to being towed and the appropriate fine permitted by ordinance.
c. 
Tiger Hose Firehouse Parking Lot. Parking for Tiger Firehouse Firefighter members.
d. 
A designated area "Parking for Borough Administrator Only" shall be established as per the following markers: The space shall be on the west side of Anderson Avenue 35 feet north from the intersection of Garfield Street and extending on Anderson Avenue for 21 feet.
e. 
A designated area "Parking for Assistant Administrator" should be established as per the following markers: "The space shall be on the south side of Garfield Street starting exactly 72 feet east of the intersection of Grant and Garfield Streets and extending east toward Anderson Avenue for 24 feet.

The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Fairview. The owner shall be responsible for the repair and restoration or replacement of same.

For a violation of the provisions of this § 7-37 or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both; except that for a violation of N.J.S.A. 39:4-80 et seq., N.J.S.A. 39:4-105 et seq., N.J.S.A. 39:123 et seq. or N.J.S.A. 39:4-140 et seq., the offender shall be liable to a penalty of not less than $50 or more than $200 or imprisonment for a term not exceeding 15 days, or both.
