The power of the municipality to adopt ordinances concerning traffic and parking is contained in R.S. 39:4-197. Various statutory provisions throughout Title 39 control the manner in which municipalities may regulate parking and traffic. R.S. 39:4-8 requires that all traffic and parking ordinances be approved by the Department of Motor Vehicles.

Whenever any words and phrases are used in this chapter the meaning respectively ascribed to them in subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

The provisions of this section imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in R.S. 39:4-138, any other New Jersey Statute, or as hereinafter provided.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I of Chapter 12.1.

No person shall park a vehicle for longer than the time limit shown in Schedule IV of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV of Chapter 12.1.

Pursuant to the authority granted to this municipality by N.J.S.A. 39:4-197, the locations listed in Schedule IVA of Chapter 12.1 are designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces.

Pursuant to R.S. 40:67-16.1, the streets or parts of streets as described in Schedule VB of Chapter 12.1 are hereby designated as route for trucks over four tons. All trucks having a total combined gross weight of vehicle plus load in excess of four tons shall be excluded from all streets except from those streets which form a part of the system of truck routes.

a. 
No person shall park or store any truck, cabs, pick-up coaches, boats, buses, mobile homes, recreational vehicles or any and all types of trailers (including but not limited to truck trailers, boat trailers, house trailers, camp trailers, recreational trailers and equipment trailers) on any street in any zone of the Township of Ocean, except while actually loading or unloading or making pick-ups or deliveries or during installations. This prohibition shall also apply to any other vehicles which exceed any of the following dimensions:
1. 
Nine feet, six inches in height.
2. 
Eight feet in width.
3. 
Twenty feet in length.
4. 
12,000 pounds in registered weight.
b. 
Vehicles with commercial plates not otherwise prohibited in section a shall be restricted to no more than one per household parked on any street in any zone of the Township of Ocean.
c. 
No prohibition outlined in paragraph a shall be applicable to any vehicle or trailer owned and/or operated by an authorized public safety organization.

Pursuant to the provisions of R.S.39:4-98 the streets or parts of streets described in Schedule XVIII of Chapter 12.1 are hereby regulated by speed limits as set forth in Schedule XVIII.

Whenever snow has fallen and the accumulation is such that it covers the streets or highway, no vehicle shall be parked on the streets described in Schedule XIX of Chapter 12.1.
Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets which have been temporarily declared no parking under the conditions set forth in Schedule XIXA of Chapter 12.1.
No person shall park a vehicle at any time upon land owned by the board of education unless conforming to the provisions set forth in Schedule XX of Chapter 12.1.
A traffic control signal shall be installed and operating at the intersections listed in Schedule XXI of Chapter 12.1. The traffic signal installation shall be in accordance with the provisions of an act concerning motor vehicles and traffic regulations, Subtitle 1 of Title 39 of the revised statutes; shall conform to the design, and shall be maintained in operation, as authorized by the department of transportation.
a. 
Traffic Control Monitoring System.
Subject to the provisions of Subtitle 1 of Title 39, the following location within the Township of Ocean shall utilize a Traffic Control Monitoring System:

State Highway 35 and Sunset Avenue
Channelization shall be installed and maintained at the locations listed in Schedule XXIA of Chapter 12.1. The installation shall be in accordance with the provisions of an act concerning motor vehicles and traffic regulations, Subtitle 1 of Title 39 of the revised statutes. It shall conform to the design and shall be maintained in operation as authorized by the department of transportation.
The streets known as Rustic Drive and Garden Drive south of Deal Road in Middlebrook at Monmouth Garden Apartment complex and the parking area therein and the parking area located in the Middlebrook at Monmouth Shopping Center, being owned and operated by the corporation known as Middlebrook at Monmouth, Woodmere at Eatontown, Cold Indian Springs Corporation and Rustic Bern Corporation, shall be regulated and controlled by the provisions of Subtitle 1, Title 39 of the Revised Statutes of the State of New Jersey pursuant to and in accordance with the provisions of 39:5A.1.
There shall be no parking of vehicles along the front curb of any store located in the Middlebrook at Monmouth Shopping Center.
The street known as Provident Court in the Provident Court Townhouse Condominium Complex and the parking area therein, being owned by the Provident Court Condominium Association, shall be regulated and controlled by the provisions of Subtitle 1, Title 39 of the Revised Statutes of the State of New Jersey pursuant to and in accordance with the provisions of 39:5A.1. Under conditions set forth in Schedule XXIII of Chapter 12.1.
In accordance with the provisions of RS:39:4-197 the following municipal property, as shown in Schedule XXII of Chapter 12.1 shall have the movement of traffic controlled by the type of regulation indicated, no person shall operate or park a vehicle in violation of the regulations indicated. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exitways, loading zones, oil fills, any grass area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicles at the owner's or operator's expense.

In addition to the provisions of N.J.A.C. 13:45A-31.1 through 31.10, all nonconsensual private property towing services shall conform to the following standards:
a. 
Request for Private Property Owner or Agent to Have Vehicles Removed at the Expense of the Owner.
1. 
Private property owners shall not permit patrolling for vehicles parked upon their property by private towing companies or their designees, or by posting an observer for the purposes of monitoring and ordering towing.
2. 
No vehicle shall be removed from private property without prior written authorization from the property owner or their agent, issued to the tow service provider. Each request shall include the following:
(a) 
Date and time of said request.
(b) 
Vehicle information including, but not limited to, make, model, and vehicle identification number.
(c) 
The reason said vehicle is being removed.
(d) 
Name of the private property owner or agent authorizing removal of the vehicle.
3. 
The property owner or their agent must be present when the vehicle is towed.
4. 
Any towing service contracted to remove vehicles from private property with the Township of Ocean shall retain the records required under Subsection A2 above, and any other record required by this chapter for not less than two years. The towing service shall make records available for inspection by any law enforcement officer or municipal employee upon reasonable notice.
b. 
Release of Vehicles Towed from Private Property.
1. 
All fees paid for related towing and/or storage services shall include and itemized receipt for services rendered, a copy of which will be retained by the tow service provider.
2. 
The release of any towed vehicle shall not be refused once related fees have been satisfied.
c. 
Immobilization or Booting of Vehicles on Private Property.
1. 
It shall be unlawful to immobilize, by use of any wheel lock device ("boot"), view obstruction device ("barnacle"), or other method, a vehicle which is parked on private property, whether for an authorized or unauthorized purpose, without the permission of the owner of the property, lessee of the property, or agent of the property, in writing, as set forth in § 12-17A2 and 3.
2. 
This prohibition shall not apply to the Township of Ocean or any other government agency directly serving the Township of Ocean.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of the chapter or any supplement thereto shall be subject to a fine not to exceed $2,000, or imprisonment for a period not exceeding 90 days, a period of community service not to exceed 90 days, or a combination thereof.

If any parts of this chapter are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.
All former traffic ordinances of the Township of Ocean are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed except that this repeal shall not affect, or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
This chapter may be known and cited as "Chapter 12 of the Revised General Ordinances of the Township of Ocean."
