The purpose of the Swansea Mall Redevelopment Overlay District
is:
A.Â
To provide
an opportunity for residential and mixed-use development within a
distinctive, attractive and livable environment in the Town of Swansea.
B.Â
To promote
development and redevelopment in the Town that is pedestrian friendly.
C.Â
To ensure
high quality site planning, architecture, and landscape design that
enhances the distinct visual character and identify of the Town and
provides an environment with safety, convenience and amenity.
D.Â
To promote
efficient use of land and existing parking supply and limit expansion
within the district by encouraging shared parking.
E.Â
To encourage
adoption of energy efficient building practices and sustainable construction
methods.
The Swansea Mall Redevelopment Overlay District is an overlay district that is superimposed on the underlying zoning districts of the Town, and the boundaries of which the Overlay District are shown on the official Swansea Zoning Map. The zoning of all underlying districts shall remain in effect and shall not be impacted or modified by this Article XIX or the existence of said Overlay District.
The following principal uses shall be allowed as of right in the Swansea Mall Redevelopment Overlay District, in addition to the as of right and permitted uses of the underlying zoning districts as provided in the Table of Principal and Accessory uses in § 265-4.0:
A.Â
Multifamily
residential development.
Multiple principal uses may occur on the same lot within the
Swansea Mall Redevelopment Overlay District; provided that only one
principal use may occur within or at any given building or structure.
The dimensional requirements of § 265-5.1 for the relevant underlying zoning district shall apply in the Swansea Mall Redevelopment Overlay District, except as follows:

Multifamily
residential developments may contain multiple buildings, provided
that the following limitations are not exceeded for any given development:
(1)Â
Buildings may not be taller than 60 feet;
(2)Â
Buildings may not have more than four stories, excluding a ground
floor parking podium;
(3)Â
Buildings may not contain more than 72 dwelling units; and
(4)Â
The development may not contain more than 2.3 units per acre of the
total land area, both developed and undeveloped, of the Assessor's
lots that comprise the development.
The requirements of Article VI shall apply in the Swansea Mall Redevelopment Overlay District, except as follows:

Notwithstanding § 265-6.1C(3), the parking space ratio for multifamily residential developments in the Swansea Mall Redevelopment Overlay District shall be 1.75 per dwelling unit.
