It is the purpose of this article to abolish the three elected offices of Assessor of the Town of Geneseo and to establish the full-time appointive position of Assessor under §§ 328 and 310 of the Real Property Tax Law of the State of New York.
This article is adopted pursuant to § 328 of the Real Property Tax Law.
The three elected offices of Assessor of the Town of Geneseo shall be abolished as of 12:00 midnight on September 13, 1989. The Town Board of the Town of Geneseo shall appoint a qualified person to the office of Assessor at its monthly meeting to be held on September 14, 1989.
A. 
The first term of office of the appointed Assessor shall be from September 14, 1989, to September 30, 1989, unless otherwise changed pursuant to Real Property Tax Law § 310.
B. 
The subsequent terms of office shall be for six consecutive years commencing October 1, 1989, all pursuant to § 310 of the Real Property Tax Law of the State of New York.
This article shall be subject to a permissive referendum.[1]

This article shall become effective 45 days after its adoption by the Town Board of the Town of Geneseo.

This article shall be called "A Local Law Changing the Established Assessment Grievance Day from the Fourth Tuesday in May to the Wednesday After the Fourth Tuesday in May, Pursuant to New York State Real Property Law Section 512(1-a)."
A. 
Section 512(1-a) of the Real Property Tax Law authorizes a municipality to change its assessment grievance day to a date other than the statutorily provided date if said municipality has an Assessor that also acts as the Assessor for a different municipality; and
B. 
The Town of Geneseo has an Assessor that also works as the Assessor in a different municipality, causing conflict over the date of the assessment grievance day in the Town of Geneseo; and
C. 
The Town of Geneseo hereby determines that it is in the best interest of the Town and its residents for the Town Board to have change the date of the assessment grievance day to the Wednesday after the fourth Tuesday in May.
A. 
Pursuant to the authority granted by § 512(1-a) of the Real Property Tax Law, on and after the effective date hereof, the Town of Geneseo assessment grievance day will be held on the Wednesday after the fourth Tuesday in May of each year.
B. 
The above assessment grievance day will remain in effect until this change has been rescinded or superseded by subsequent law.
