Whenever any words and phrases are used in this section, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this section, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police of this Municipality is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated hereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this ordinance or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this ordinance are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.

The Borough Council finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above or below the ground which requires blocking the street and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work forces performing these operations.
The Borough of Pitman, in the County of Gloucester, State of New Jersey does hereby adopt the current Manual on Uniform Control Devices for Streets and Highways hereafter known as the M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility that fails to comply with the provisions of the M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility, as required under the public utility, wishing to conduct work on, under or above the street, to contact the Police Department of the Borough of Pitman, in order to arrange a pre-construction meeting and submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work, or whose plans are not approved by the Police Department of the Borough of Pitman is in violation of this section.

The person, contractor or utility shall provide to the Police Department at least two emergency contact telephone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, emergency contacts must be made, or if the emergency contact person does not respond to a call from the Police Department to correct such hazardous condition, the Borough may respond to correct the hazardous condition(s). The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor, or utility responsible for the condition.

a. 
There shall be no construction, maintenance, operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. The officer in charge of the Pitman Police Department may adjust this time limit to permit work prior to 9:00 a.m. or after 4:00 p.m. If the officer in charge determines that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. or after 4:00 p.m.
b. 
There shall be no construction, maintenance operations or utility work on any roadway in the Borough on Saturdays or Sundays unless approved by the Officer in Charge of the Pitman Police Department.

a. 
Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.
b. 
No road closings shall be permitted for an opening on any roadway surface which has been reconstructed by the Borough for a five year period after completion of said construction except in the event of any emergency. The moratorium period shall commence on the date of final acceptance of the road which has been resurfaced or reconstructed.
c. 
No road closings shall be permitted for an opening on any roadway surface which has been overlayed or resurfaced within two years after completion of said overlay except in the event of any emergency.

Traffic directors shall be posted at all construction or maintenance sites when determined that same is necessary to provide for the safe and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicles or equipment are to be placed in the roadway or sidewalk or until all construction, signs, light devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the county jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the county jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which the violation occurs or continues.

The provisions of this Section imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon the streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle, which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and the accumulation is such that it covers the streets and highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated.
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal before regaining possession of the vehicle.

1. 
Residential parking permits shall be issued to residents of the Borough residing on the streets referenced in this section pursuant to a Licensing Agreement between the resident and the Borough.
2. 
Residential parking on the above-referenced streets is limited to vehicles displaying valid placards issued by the Borough.
3. 
Vehicles not displaying valid placards shall receive a summons, and be towed by the Borough at the owner's expense.
4. 
Parking availability on any of the above-referenced streets is not guaranteed by the Borough.
5. 
Permits for residential parking shall be issued by the Borough of Pitman to any Borough resident residing on the streets referenced in this section upon the production of two valid and current forms of identification indicative of Pitman residency, and a copy of the resident's driver's license; valid vehicle registration card; and valid insurance card.
6. 
Parking permit placards will be visibly displayed upon the interior windshield area of the vehicle.
7. 
No more than two residential parking permits will be issued per household.
8. 
There shall be no fee for parking permits issued pursuant to this section.

Vehicles not displaying valid placards shall receive a summons, and be towed by the Borough at the owner's expense.
4. 
No person shall authorize, permit, allow, or suffer the storage, repair, service, maintenance or overhaul of any motor vehicle, of any description, upon any municipal parking lot.
5. 
Parking availability at any municipal parking lot is not guaranteed by the Borough.
6. 
Permits for overnight parking shall be issued by the Borough of Pitman to any Borough resident upon the production of two valid and current forms of identification indicative of Pitman residency, and a copy of the resident's driver's license; valid vehicle registration card; and valid insurance card.
7. 
Permit placards will be visibly displayed upon the interior windshield area of the vehicle.
8. 
No more than four overnight parking permits will be issued per household.
9. 
Parking permits may be purchased for an annual fee of $100 per vehicle.
d. 
Emergency Vehicles Exception. Any Police, Fire, EMS or any other "emergency" vehicle owned or operated by any governmental agency is permitted to park between 0200 hours and 0600 hours to ensure emergency responses without delay.
e. 
Temporary Parking. At the discretion of the Chief of Police, or his designee, residents may be granted permission to park their vehicles between 0200 hours and 0600 hours if the following criteria is met:
1. 
A need for additional "temporary" parking exists.
(a) 
At any time the Chief of Police may deny parking due to the following reasons;
(1) 
In excess of 20 call-in requests for temporary parking per year;
(2) 
Weather emergencies;
(3) 
Road construction;
(4) 
Any reason the need exists where parked vehicles in the roadway would create a hazardous condition or any reason which could hinder police operations.
2. 
All vehicles are registered/insured and must be in operable condition.
3. 
All vehicles are called in to County dispatch no later than 0200 hours of the day permission is being requested.
f. 
Parking Allowances. At the discretion of the Chief of Police, or his designee, parking allowances may be made for certain periods throughout the calendar year where the "overflow" of additional vehicles is expected (i.e. Holidays, events, etc.), or other circumstances warranting temporary parking.
g. 
Ballard Avenue; Reserved Parking Spaces.
h. 
Simpson Avenue: No exception shall exist to allow temporary overnight parking on the east side of Simpson Avenue.

This paragraph is designed to establish a parking design throughout the Borough which will result in a substantial increase of public parking while preserving the parking needs of private property owners throughout the Borough. Three Hour Lots. The municipal parking lots described and identified in paragraph (a) below shall be available for public parking subject to a parking time limit of 3 hours (180 minutes) per vehicle between the hours of 6:00 a.m. — 11:00 p.m. Overnight parking is prohibited except for those municipal parking lots identified in paragraph 3 below. No unregistered vehicles, commercial vehicles, boats, camping vehicles, recreation vehicles and trailers are permitted on any municipal parking lot. All unregistered vehicles, commercial vehicles, recreation vehicles and trailers located on a municipal parking lot shall receive a summons, and be towed by the Borough at the owner's expense.

Overnight Parking Lots; Permits; Fees. The municipal parking lots described and identified in paragraph (a) below are hereby designated as permitting overnight parking between the hours of 11:00 p.m. — 6:00 a.m. subject to the following terms and conditions:

(b) 
Overnight parking permits shall be issued to residents of the Borough pursuant to a Licensing Agreement between the resident and the Borough.
(c) 
Overnight parking on designated municipal lots is limited to vehicles displaying valid placards issued by the Borough.
(d) 
Vehicles not displaying valid placards shall receive a summons, and be towed by the Borough at the owner's expense.
(e) 
No person shall authorize, permit, allow or suffer the storage, repair, service, maintenance or overhaul of any motor vehicle, of any description, upon any municipal parking lot.
(f) 
Parking availability at any municipal parking lot is not guaranteed by the Borough.
(g) 
Permits for overnight parking shall be issued by the Borough of Pitman to any Borough resident upon the production of two valid and current forms of identification indicative of Pitman residency, and a copy of the resident's driver's license; valid vehicle registration card; and valid insurance card.
(h) 
Permit placards will be visibly displayed upon the interior windshield area of the vehicle.
(i) 
No more than four overnight parking permits will be issued per household.
(j) 
Fee. Parking permits may be purchased for an annual fee of $100 per vehicle. The annual fee may be prorated on a quarterly basis based upon the quarter the permit is purchased. For example, permits purchased January 1 — March 31 = $100.00; April 1 — June 30 = $75.00; July 1- September 30 = $50.00; October 1 - December 31 = $25.00.

Overtime Parking. No person shall cause a vehicle to be parked or remain in a parking space after the time for parking has expired.
5. 
Parking Within Space. All vehicles shall be parked wholly within the lines designating a particular parking space.
6. 
Enforcement. This section shall be enforced by the Police Department of the Borough of Pitman.
7. 
Improper Use. It shall be unlawful for any person to loiter, play, congregate, indulge in any games, sledding, skating or bicycling activities on any municipal parking lot under circumstances which would cause unsafe conditions or warrant alarm for the safety and protection of Borough residents or property. In so violating any provision of this section, it shall also be unlawful for any person to refuse or neglect a command from an officer of the Borough of Pitman to remove his presence from any municipal parking lot.
8. 
Violations and Penalties. Any person violating or failing to comply with any of the provisions of this paragraph b shall, upon conviction thereof, be punishable by a fine in an amount not less than $25 nor more than $75 upon a second violation, a fine in an amount not less than $75 nor more than $150 and upon a third or subsequent violation, a fine in an amount not less than $150 nor more than $300 and/or a period of community service not to exceed 10 days. Whenever such person shall have been officially notified or by service of a summons in a prosecution, or in any other official manner, that said person is committing a violation, each day's continuance of such violation after such notification shall constitute a separate offense, punishable by a like fine or penalty.

In accordance with the provisions of N.J.S.A. 40:48-2.46, the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.

The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the current "Manual on Uniform Traffic Control Devices for Streets and Highways" (MUTCD). The cost of signs and installations shall be the responsibility of the owner of said property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Pitman.
The penalty for a violation and conviction of this section shall not be less than $25 nor more than $75 and/or imprisonment in the county jail for a term not to exceed 10 days.

The owners of the premises referred to in subsections 7-40.2, 7-40.3 and 7-40.5 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the "Manual on Uniform Traffic Control Devices for Streets and Highways." The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property. The governing body of any municipality may, by ordinance, authorize the Mayor or other chief executive officer of the municipality, or other officer in charge of streets in any municipality not having a chief executive officer, if he finds that a safety problem exists for ingress and egress to any public or private school or for the provision of recreational facilities for children attending such school, or both, due to a lack of suitable area surrounding the school, to close by regulation any portion of any street within the block upon which such school is located to the use of through traffic during such time as he shall determine, not to exceed one hour between 7:30 a.m. and 10:00 a.m., two hours between 11:00 a.m. and 2:00 p.m., and one hour between 2:30 p.m. and 4:30 p.m., on any days upon which school is in session, and to permit the use of said portion of said street, during said hours, for ingress and egress to such school and for the use by the pupils of such school for recreational purposes under proper supervision, and to provide adequate police facilities for such supervision and for the control of traffic upon such portion of said street, which ordinance shall provide for the posting of proper warnings signs in said street, indicating that said street is so closed and the purpose thereof, during the time when the same is so closed, and shall provide penalties for the violation of terms of such ordinance or of any regulation promulgated thereunder.

b. 
The Student Loading and Unloading Zone may only be utilized in accordance with the following:
1. 
The drop-off and pick-up zone is in effect Monday through Friday on days that school is in session.
2. 
The drop-off and pick-up zone is designed to allow for improved traffic flow and safe student drop-off and pick-up of passengers. All students using this zone are to exit and enter vehicles on the designated side of the road.
3. 
The drop-off and pick-up zone is to be utilized only during school hours and is solely for the purpose of dropping-off and picking-up students.
4. 
Those using the drop-off and pick-up zones are required to line up or queue in an orderly fashion and wait patiently for an available space.
5. 
Parking a vehicle in the drop-off and pick-up zone shall not be permitted for a period of time longer than 3 minutes.
6. 
No vehicles are permitted to be parked or left unattended, or to exceed the 3-minute time limit. This includes, but is not limited to, parents or guardians waiting for a child or children to come-out or go-into the school.
7. 
If the driver exits the driver's seat and/or the vehicle becomes unattended, or exceeds the 3-minute drop-off and pick-up time, he/she shall be in violation of this Chapter.
8. 
All other parking spaces around the school are to be utilized in accordance with existing applicable ordinances.
c. 
Regulatory and warning signs shall be erected and maintained to affect the above-designated student loading and unloading zones.
